Hi, Please excuse my ignorance i am sending an S.A.R after receiving an N1 claim form from claimant lowlife portfolio ( lowell:-D) on behalf of Vodafone also mentioned as corespondence address is BW legal.

I have never had a vodafone contract but suspect a family member may have used me as a guarantoor without my knowledge :x:x

Who would i send the S.A.R to?? Thank you in advance for any help.

yo might need to consider a CPR 31.14.

 

type out the PoC from the claimform EXACTLY as it appears please

Contact the CAG Vodafone rep and they should be able to find out the account info, as to why there is a debt in your name.

But in the meantime you must deal with N1...you have 33 days in total subject to how you wish to proceed.5 deemed served ...14 to acknowledge service and a further 14 to submit a defence (if you are defending).

 

Don't take your eye of the dates.

DX100UK i am awaiting a response off Lee @ Vodafone before i proceed with your advice on seeking a cpr 31.14.

nope lee's advise will be in tandem to what you must do for the court case.

 

get that CPR 31.14 off ASAP.

 

we/you need to see what cards they hold

to back up this claim that you DO owe anything

Hi DX Here is a copy of the poc :-

 

The Claimant,s Claim is for the sum of 494.06

being monies due from the Defendant to the Claimant

under a non-regulated Communication,s agreement

between the Defendant and Vodafone Limited.

 

under account reference xxxxxxxxx and assigned to the Claimant on 30/08/2013

notice of which has been given to the Defendant.

 

The Defendant failed to maintain the contractual payment under the terms of the agreement

and a default notice has been served and not complied with.

 

The claim also includes statutory interest pursuant to section 69 of the County Courts Act 1984 at a rate of 8.00% per annum

(a daily rate of 0.09 from the date of assignment of the agreement to the date of issue (22/01/2014) being an amount of 13.14.

 

 

Could you tell me how i make a request for CPR 31.14 and who i make it to?

UPDATE Acknowledgement of service has been sent electronically

CPR 31.14 Has been typed out and will be sent off tomorrow by recorded delivery

Lee from Vodafone is calling tomorrow to speak to my wife

Hi Lee My wife has today received a judgement for claimant (in default) for the above claim i have received no update from yourself or vodafone uk although after our telephone conversation you said you would ask lowell portfolio to put the case on hold until you had investigated the matter could you please get back to me asap please thanks Ian
