Precis of letter from Restons this morning

 

Marlin Europe v NM

 

We are instructed by Marlin to claim immediate payment from you of the outstanding balance plus interest as appropriate.

 

We must ask you to pay xxx by Feb 6 we have strict instructions to issue a CCj

 

Our client may be prepared to accept installments by filling in an I&E

 

Receipts will not be given unless you enclose an SAE

 

They draw my attention to an opportunity to clear account at discount settlement figure (but give no details)

More info would be helpful here.

 

Right as for the letter you have received, You DONT have to fill in their I+E, you can make them an offer in writing per month.

So its a current account, if so let me guess "Overdraft" full of "Charges"?

 

Discount settlement figure? Why do i get a feeling they may try to get a judgement by default.

Well well well, they do like to threaten legal action early on don't they!

 

I'm guessing if they were so foolish as to issue a summons you would be able to defend and counter sue??

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Yes it is an account that has fees, I am just noting them all down and which calculation sheet should I do them on?

 

Can I include the unauthorised overdraft fees of £75 per month for a few months.

 

The last time I did any transactions on the account myself was November 2007 an amount was paid in and I withdrew £100 and at that time the account was below my overdraft limit.

 

Lloyds closed it in January 2009.

I have done my calculations on this account with Marlin.

 

Yes it is a Lloyds Current Account and the overdraft fees, returned payments and account charges without interest come to half of the amount outstanding. The account ran smoothly at first but with divorce everything went pear-shaped and the charges occurred. They knew I was in a financial mess trying to keep a roof over out heads.

 

(btw have Lloyds 2nd CA with Lowell and that one is all charges because that started from a zero balance and the charges on that one cover the whole amount outstanding without interest)

 

I've now got the figures for both so am wondering how to proceed.

 

I've used spreadsheet 4 but do not know what rate of compound interest I should use. I was thinking about using the 11.4% charge as on my credit card for the amounts,

This 2nd LLoyds account with Lowell are you positive that the amount outstanding is solely made up of fees and charges?

Were no transactions ever made on this?

So account had a credit balance of £16 which was off set against the charges when the account was defaulted?

Marriage break up 2005/06

In Hardship from then, bank knew all about it.

 

2 Current Accounts …

2k overdraft on one Zero on other.

 

This is dealing with the account with overdraft.

 

Changed banks in 2006/07 because of bank charges

But still used account occasionally in 2007

Last transaction by me was 22/11/07 cash deposit and the account was still within overdraft

It went over overdraft in January 08 due to fees and account interest.

I am getting all the information together and coming up against a brick wall

 

In my PDF between the Lloyds letter of April 08 and the SCM one of June 08 there is one missing from SCM

 

I phoned SCM and they haven't got anything on their system as it only goes back to September 08

 

They say Lloyds DSAR Andover are the people to get it from

 

so i rang them but can't get into accounts re Data Protection, so what else is possible?

 

who should I talk to to get this copy?
