    • In terms of "why didn't I make a claim" - well, that has to be understood in the context of the long-standing legal battle and all its permuations with the shark. In essence there was a repo and probable fire sale of the leasehold property - which would have led to me initiating the complaint/ claim v SPF in summer 19. But there was no quick sale. And battle commenced and it ain't done yet 5y later. A potential sale morphed into trying to do a debt deal and then into a full blown battle heading to trial - based on the shark deliberately racking up costs just so the ceo can keep the property for himself.  Along the way they have launched claims in 4 different counties -v- me - trying to get a backdoor B. (Haven't yet succeeded) Simultaneously I got dragged into a contentious forfeiture claim and then into a lease extension debacle - both of which lasted 3y. (I have an association with the freeholders and handled all that legal stuff too) I had some (friend paid for) legal support to begin with.  But mostly I have handled every thing alone.  The sheer weight of all the different cases has been pretty overwhelming. And tedious.  I'm battling an aggressive financial shark that has investors giving them 00s of millions. They've employed teams of expensive lawyers and barristers. And also got juniors doing the boring menial tasks. And, of course, in text book style they've delayed issues on purpose and then sent 000's of docs to read at the 11th hour. Which I not only boringly did read,  but also simultaneously filed for ease of reference later - which has come in very handy in speeding up collating legal bundles and being able to find evidence quickly.  It's also how I found out the damning stuff I could use -v- them.  Bottom line - I haven't really had a moment to breath for 5y. I've had to write a statement recently. And asked a clinic for advice. One of the volunteers asked how I got into this situation.  Which prompted me to say it all started when I got bad advice from a broker. Which kick-started me in to thinking I really should look into making some kind of formal complaint -v- the broker.  Which is where I am now.  Extenuating circumstances as to why I'm complaining so late.  But hopefully still in time ??

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thank you to everyone on this forum I have just won £4071.50 back off the Alliance & Leicester edit.

 

It all happened so much faster than I thought it would. I started to look into this and first visit this site at the start of Sept 06. As the A&L hit me with £100 24hours to clear hence the charges!!! That was the final straw. I sent off with my £10 for my statements and toted up the total charges over 6 years. Sent in charges saying to me that the cash I put into the account to cover DD's took the 2 templated letters both refussing to give me my money back. So started my MCOL on the 6th Oct, it was acknowledged on the 10th Oct. On the 26th I checked the status of my claim and it said defence recieved and I started to panic. I didnt need to as when I got home I had a cheque for £4071.50 waiting for me. They defend liabilty however happy to give me my money rather than go to court. Anyone who is taking on Alliance & Leicester and wants advise just ask I am more than happy to help. I have already got most friends and family starting the process. Once again a massive thank you to everyone!:)

hi robbie1 ive just submitted my 1st letter to A&L for £1100 in charges my main concern in doing this was because id read so many storys where people where getting there money back but there banks then gave them 30 days notice of closing there accounts, i dont have the best credit rating & fear if this is the case i might struggle to get another bank account was this the case with A&L ??

Some banks like Nat West have basic accounts that anyone can have. You won't get an overdraft or cheque book, but can do direct debits and standing orders.

 

A&L will close your account if you put in a court claim.

Well done Robbie! I sent the data protection form back on 10th October with the cheque for £10 and they are dragging their heels getting the information relating to my charges back to me. I phoned them for an update and was told that they had 40 days to send me the information. If they think that I am going to back down through lack of patience then they are sorely mistaken!!

Thanks for all yours advice on my worry on getting another bank account thought id inform you all i did some surfing and got a basic account with a visa delta chip & pin from Citibank,2nd letter has been submitted to A&L will keep you all informed of progress

Hi

 

Can you let me know if you just penned a letter asking for the A&L to refund all the charges they had added to your account or do you know where i can get a template for an appropriate letter to send A&L? I've just had my statements for the last 6 years and am amazed to see my charges total £5040!!

 

Has anyone else wrote to the A&L claiming back their charges or should i just go ahead and start the ball rolling in the small claims Court?

 

I'm currently on an IVA and wondered if anyone knows if i'll have to let the IVA company know if i win my claim or, as this is part of the cause for me having to resort to an IVA ,will i be exempt from declaring it to my creditors?

Perhaps you may have an answer to the following?

 

At the time of starting my IVA i owed A&L £1400 which is now part of my IVA. Will they automatically take that off my £5000 charges refund claim, leaving me with £3500 of which i understand i will have to pay 50% to my IVA company or will the debt to A&L still stand as part of my IVA, and therefore the 50% to my IVA will be from the £5000 claim, leaving me £2500 in my pocket?

Hi Clanger.

 

As I understand the way IVA's work, having been through one, any money you receive, must be distributed equally to all creditors, therefore, A&L couldn't take back in full what is owed, but only a proportion of the debt, otherwise, they'll not be abiding by the terms of the IVA, which is supervised by your supervisor.

Inform your supervisor and let them do the donkey work, afterall, that's what these supervisor's are being paid to do!

 

Incidentally, did A&L close your account with them? We have an overdraft with A&L of £1500, which we want to pay off, but they won't give us a loan, despite the fact we owe very little and earn good money! On another note, on your credit record, will be a record of the IVA, which will stand for 6 yrs from the time it was accepted, so be prepared for knock backs.. we are still having them, despite finishing the IVA in 2004 (2 yrs early of the 5 yr agreement).

am filling in my mcol and sent my last two letters to Customer Service centre bootle Merseyside do you know if this is the correct address?

Also is there a statement that i can use to mcol anywhere on this site not quite sure what to write also do I include the court costs in my claim or is this done automatically

Thanks for the info. Yes A&L did close the account but i managed to open a Natwest Account just in time so i've transferred DD'S etc to this account.

 

Will contact my IVA supervisor to confirm your imfo.............thanks once again.

 

Just received my standard reply from A&L letting me know they are correct and justified with charging me the fees they've charged etc etc. Should i wait till the 14 days are up (next Monday)before i send my LBA letter or shall i send that now?

alliance and leicester have charge me £400 admin and a years interest for redeeming my mortgage early, can you advise if this is legal as with bank charges.

Alliance and Leicester have repaid the administration charge on my early mortgage redemption fee after sending them the first letter informing them that I would take court action if not refunded fully including the additional years interst they charged-they called this a gesture of goodwill. however they have not offered me the interest back. Is there a template for the second letter anyone can point me in the direction of?

Well done, a real inspiration!!! I have done things a bit back to front, you'll see from my thread, but i only sent off for my SAR today, how long did it take them to send your statements out as it seems differant people get it at differant times, is it just a lottery on how quick they respond?

Hi

 

Does anyone know if you can claim back these charges if you've been declared bankrupt?

 

I know if you're on an IVA it's pointless claiming because it just goes to the IVA company, if the charges are from a bank that are part of the IVA,so you don't see a penny of it, but wondered if a bankrupt would be entitled to a full refund?

Why do you think you wouldn't be able to claim back the charges the same as anyone else; were you told at bankruptcy that you would have no recourse to the legal system?

Surely you have the same rights as the rest of us.

And as for IVA, why not claim even if you don't see all the money yourself - wouldn't it clear the debt all the sooner? :rolleyes:

Hi Younganfree

 

The IVA company i'm with have imformed me that any 'extra' money above overtime/bonus payments from work go towards paying off the 'rest' of the debt and don't affect the actual amount i'm paying back. So what their saying is any of the charges i get back (estimated at £10,000+ from all my creditcard companies/bank charges) will go towards the part of the debt that has been apparently wrote off by them. ie say i owed £40k and the IVA arrangement involved me paying back £22k over the 5 years this extra 'windfall' would go towards the remaining £18k that i thought had been wiped off!!!!!

 

Whereas if i declare myself bankrupt my creditors get sod all and then any charges i get back after that are mine...............or not?????
