Bailiffs? letter, an unknown CCJ from Marlins & me - help!!

Hi

 

Before Christmas I had some court forms forwarded from an old address,

 

Saying I owed HSBC £400,

 

I replied and said I had never banked with them,

or had heard of 'Marlin'

and thought that would be that.

 

I have since received a bailiff letter to pay £197.

 

Due to the time constraint and not wanting the bailiff action

I was put in contact with Restons solicitors,

and paid £197 on a card

 

They say I owe money from the year 2000 (I don't)

 

Where do I go from here please?

 

I need to prevent Restons claiming the rest of this (now) £600

 

I find it hard to believe this is happening...

if you've never had an HSBC[HFC?] account

 

then get that money back using CHARGEBACK.

 

you should never blindly pay anyone over the phone!!

 

can you please type out the JUDGEMENT box of the CCJ please

 

 

scan up the bailiff letter please too

 

if it was from 2000 you owe nowt statute barred!!

 

**you can post up images/letters by this method immediately..you don't need 10 posts**

set your default scan page size to A4 less than 300DPI [150 will do]

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

ENSURE: remove all pers info inc. barcodes etc

but leave all monetary figures and dates.

goto one of the many free online pdf converter websites ...

if you have multiple scans/pics

put them in a word doc FIRST and convert that to PDF

or http://www.freepdfconvert.com/

or

use www.pdfmerge.com

 

convert existing PC files to PDF [office has an installable print to PDF option]

..

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

.

or if you have PDF as an installed printer drive use that

or use word and save as pdf

try and logically name your file so people know what it is.

though dont use full bank names or CAG in the title

i'e Default notice DD-mm-yyyy TSB

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

...

YOU DONT have to put a link to the attachment in the msg box..just upload it ..job done

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

You need full details of the CCJ against you, including what particulars of claim were used. Perhaps Restons can provide this to you. Or you can get it from Northampton county court bulk centre if you know the CCJ reference.

 

It is highly unlikely that a debt from 2000 is still enforceable, unless it was a mortgage or secured debt.

 

Post back when you have more details. The bailiffs will be from the country court. It is a civil matter, so you don't have to deal with them. If you had the CCJ details, you may be able to get it set aside.

Thanks for your replies. I am about to contact the bulk claims people and I have a reference numberNow regretting making that payment to Restons BUT I had a bailiffs letter and real reason to believe they would try and enter my house!

They can't for civil debts, unless you invite them in. They can only force entry, if it relates to a criminal fine.
