    • Perfect, thanks Dave.   You're right, a whole dodo storm this has been. As sons of first-generation immigrant parents, whenever something like this happens the old man panics. There was a whole "appeal this now" because my dad paid for the parking as he was with the hirer at the time and he isn't as tech-savvy as my brother so he ended up doing what he did and because I don't live there anymore it came all the way down to this.  But yes, we'll do this SAR and see what comes of it.  Will keep posting here with the hopes that it may benefit someone in the future.  Thanks again, everyone.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

a year ago we had got one of the new free range cookers from brighthouse but

 

recently the pan storage door kept popping off and

 

we got fed up called the engineer out who came on Saturday

 

i thought would been an easy fix to replace the rivets but was shocked to find out the engineer saying it can not be fixed so

they gave us 2 options which in reality enraged me

 

when he left we spoke to the manager of the local store

they want to write the cooker off scrap it and they will claim their money back via the insurance

 

they were ever so nice though and offered to collect it asap lol

 

but the situation i am in with having children thats not a viable option meant we would be without a cooker

unless we took out a whole brand new contract starting from scratch

which meant we would lose the years payments we made well over 800 quid

 

2nd option was to live with it and not worry about the door keep falling off lol and

they would generously deduct 10 weeks off the overall contract ( big wow )

 

but what had me confused as we all insured via the dlc and osc

 

on their osc doc it claims they aim to repair or replace an item quickly

If they are not prepared to honour the contract then I suggest you reclaim the OSC and dlc as it is obviously not fit for purpose and go to a proper store and purchase a new cooker at half the price !!

Do be aware that entering into a new contract with this company will cost you even more.. as they have built in these expensive insurances into the prices of their items thereby increasing the cost by some 50-60%

ANYTHING you buy from Bh is already 2-3 times the RRP, and is front loaded with a ton of extra value, purely for their own profit. This doesnt include their stupid insurances or interest. Add it altogether and you could be payind 3k+ for a cooker that you can get for maybe 500 from currys

Reject it under SOGA

Treat it as a lucky escape and rid your life of vermin

It would be cheeper and half the price elsewhere look at catalogue if you need pay monthly

One of the benefits of Optional Service Cover (OSC) is that if a customer has to report a fault with their product, the cost of product repairs would be covered.

 

Once the fault has been reported, a Service Call would take place within 72 hours and a 'loan' item would be provided if need be.

 

In the event that the product is beyond repair, you would receive a 'like for like' replacement.

Exactly. jason, if youa re giving out information, please post FACTUAL information as it pertains to the law, and not just BH's interpretation.

Brighthouse admit this is scrap! Then generously offer you 10 weeks off payments? LOL!!!

 

Ideally you should be demanding a full refund of all money you paid to Brighthouse. By full refund, I mean the cost you have already paid for the product PLUS the insurances.

 

Is there an update to this?

If I've given you advice, then it is just my thoughts / opinions - doesn't mean I am right!

Good Morning all,

 

I just wanted to update this thread and confirm that this matter seems to have been successfully resolved at store level.

 

The Store Manager confirmed that a suitable arrangement was identified and implemented, in order to resolve the customer's concerns, following a discussion held in the store.

 

In addition to this, the store arranged for a replacement cooker that was successfully delivered and we understand that the customer was happy with the resolution.
