Hey guys,

I have a payday loan with Quidmarket which I defaulted on several months ago. I've recently started a DMP with Payplan and have done the following:

  • I've informed QuidMarket about the DMP
  • I've requested in writing, via email, that they do not call me at work
  • I've advised them on several occassions that everything must be in writing as I have learning disabilities and struggle to remember things

However they are constantly calling me at work....today for example they have tried 3 times in the past hour despite me repeatedly saying that they cannot contact me at work as personal calls are not allowed.

Can someone please help as I'm going to lose my job if this continues

Thanks

Katpuss

UPDATE - They have just sent this text to me in an email:

XXXXXXXX,

Your DEFAULT NOTICE expired on 05/12/13. You now have 14 days before we issue notice of your impending CCJ and ATTACHMENT OF EARNINGS ORDER whereby XXXXXXXXXXXXXXXXXX would be ordered to pay us direct by the COUNTY COURT.

Not arranging to repay the money you borrowed will force this course of action to be followed whereby you will end up repaying the money borrowed, plus interest, plus court costs.

Contact me now to avoid all this.

Regards,

XXXXXX @ Quidmarket

Hi katpuss.

I have just been looking at DMPs.And this problem of calls at work.

It seems when DMPs are first set up calls can sometimes continue for a while.

How long has your DMP been going.

And have Payplan been in touch with Quidmarket about your debt and what did Payplan say about these calls.

Seems the CCJ threat is trying to scare you.I mean when and if they were to go this route, you submit a defence telling them about your DMP what would they gain.

If you have not already been in touch with Payplan already about these calls i would ask their advice about this and the CCJ threat.

I understand the urgency and a phone call to the company telling them you have no other option but to immediately complain to the OFT about these calls if they do not stop. You in my mind have done everything to sort this debt out fairly. If you do phone them try to get names and take the time of the call.

A few hours have gone by since you posted so i thought i would offer you my support.I expect others will advise you and i will watch how things develop.

Best wishes Tawnyowl.

Unless and until they issue a claim, there can be no suggestion of an attachment of earnings.

There is a telephone harrassment letter in the CAG library HERE

There are a couple of drafts, so read them and choose which one is most suitable - adapt for your own situation where necessary. You need to inform the OFT as well.

Thank you for your help and advice. I'll send one of the template letters to them after I've personalised it to them :)

it's illegal for a company to say a certain course of action will take place unless they actually follow through so if they have said this, it means they will do this and i know for a fact this company do process CCJ and use the CCJ to obtain an AOE.

if you've told them you're with a DMC and they keep phoning it will be due to the DMC not contacting them to provide the LOA and offer of repayment etc - chase your DMC up and find out if the offer of repayment has been sent and if so, been accepted or not. companies have to hold your account for 30 days once you inform them you are on a DMP and if they then start chasing again it will be due to the DMC not providing info to them in time - they are more than likely asking you to set a plan up with them direct that's all which is easier, cheaper and FASTER way of getting rid of debt than a DMC, especially one that is free like pay plan as their backlog is huge.

also, just be wary of using these template letters - it's not as if the companies you send them to do not realise where they come from and will just create more problems than they help. while they are good for reference it will not help your specific case
