    • Good Evening, I've got a fairly simple question but I'll provide some context incase needed. I've pursued a company that has operations in england despite them having no official office anywhere. I've managed to find a site they operate from and the papers there have been defended so I know they operate there. They've filed a defence which is honestly the worst defence ever, and despite being required to provide their witness evidence, they have not and have completely ignored the courts and my request for copies of it. I'm therefore considering applying to strike out their defence on the grounds the defence was rubbish and that they haven't provided any evidence for the trial. However, it has a trial date set for end of june, and a civil application wouldn't get heard until a week before then, so hardly worth it. However, my local court is very good at dealing with paper applications (i.e ones that don't need hearings, and frankly I think they are literally like 1-2 days from when you submit it to when a Judge sees it. I'm wondering if I can apply to strikeout a defence without a hearing OR whether a hearing is required for a strikeout application.   Thanks
    • I have just opened another bank acc with lloyds (i have a few already) After doing some research they may have some relation to tsb or be apart of the same group will this cause me issue if my salary is paid into my lloyds account? Also, if the debts do go into default and nothing is paid then after 6 years it all goes away? As the DCAs cannot do anything? I do want to start paying in like 3/4 months or do you advise I leave it if it goes into default? again sorry for all the questions, i am just processing everything

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all, after any experiences, advice etc.

 

My mum suddenly passed away last week leaving my dad on his own.

 

She left a will - making my dad executor.

 

There was no insurances, pensions, savings just a mortgage - converted to tenancy in common a few years back.

 

Looking at the debts there are 3 cards solely in my mum's name.

 

M&S £5k,

Nationwide £7k,

Band of Scotland £7k

- none were covered by any insurances.

 

My dad is retired, 71 years old on the state pension.

 

It was my mum who was a few years younger who provided most of the finances.

 

After a hectic week its down to dealing with the debts.

 

What I need to know is how do I go about proving to the companies concerned there is no estate?

 

My dad has written a letter to each company with a certified copy of the death cert

and a copy of the will showing him as executor.

 

I can't see the company's accepting this and wanting payment

- but as the debts are solely in my mums name

and no estate how do we go about showing this to the companies concerned.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Many thanks, some useful info. We are planning to send in the death cert to the companies, state there is no estate and await their response. In the meantime I feel we need to make an appointment at the CAB so that once the reply letters come in we can tackle it together.

National Debtline would be worth phoning.

 

Your Dad is not responsible for the debts,

but as executor he would have to evidence to any creditors that there was no money left by her to pay the debts.

 

They are unsecured debts, so cannot now be secured against a deceased.

 

See what National Debtline advise.

 

They may say that your Dad should see a Solicitor to draft letters to any creditors of your Mum to explain the situation.

 

Or perhaps to see Citizens Advice if a Solicitor is not affordable and they may be able to send letters on your Dads behalf.

Sorry to read about the loss of your mum, not a nice way to start 2014.

 

Send copies of the Death Certificate only, if the company needs an original then they can apply and pay for one from your local office of Birth's, Marriages & Deaths.

have you not already got a solicitor dealing with the legal side?

 

its for them to deal with the debts.

 

no estate = no money so tough really for them is the bottom line.

 

it will look better coming from a solicitor.

 

one of my neighbours wanting help simply got his solicitor to send him a generic word letter template .

 

all he did was fill in the creditors details and sent them off giving 14 days to reply.

 

all her creditors accepted the letter and debts as high as £14k in one instance were written off

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Many thanks to all

- after a hectic and emotional week its hard sometimes to get your head around the legal ins and outs.

 

We have been to branch and took in the death cert which they have certified and forwarded onto the relevant dept.

Its time to await their response.

 

My dad has made an appt with the Age Concern money advisor.

 

There is £20k left on a £180K house with 4 years left to pay - I can contribute to keep this going.

 

My dad's health is deteriorating and wants to stop in the house as is 71 years old now.

Its a case of lets see what they reply before seeing if a solicitor is needed

- he has been able to get on pension credit now which albeit only £5 extra a week it opens up a range of benefits with council tax etc.

 

Your advice is truly appreciated - I will keep the post going with the responses so if anyone does search for help there is a bit more info.

Strange thing happened today.

 

I was expecting a fight with creditors as my parents did tenants in common back in 2008.

 

I advised them of the death and they wrote back today they don't need to know because my dad is the sole name on the property.

I was puzzled as I remember when seeing a confirmation letter received a week after it was done.

 

I called them today and even they were puzzled as since computer records at the Land Registry began

there was just my dad's name but it did have the tenants in common restriction below it.

 

The guy said that shouldn't have happened as needs 2 names on title for tenants in common.

They have agreed to lift the restriction.

 

Looking back on the paperwork it does show just my dads name, my parents just filed it and forgot about it.

So now that the house is sorted its time to read up on probate.
