hi there

 

I had a outstanding water bill sherforce debt company were dealing with it

 

I could not keep up with the payments they were demanding me to pay

 

next thing I get is a letter from southern water with a interim charging order obtained

 

there is a final hearing to take place this coming Monday

 

this is the first letter I have received from them.

hi it just says on the letter that it is southern waters solicitors company secretary.

 

Thank you for that, sorry for the questions but trying to establish which is the best place for you.

 

When did you get your original CCJ? When did Sherforce become involved & when was the last time you heard from them?

the ccj was in 2009 which we weren't aware of and sherforce got infolved in 2012 and last payment made was 16/11/12

when did you become aware of the ccj? you say you could not keep up with payments, was there an instalment order in place?

Then there is little you can do but accept the Charge...you cant set a side the CCJ as you have no defence and owe the money.

A charging Order simply secures the debt against your property until paid.

 

 

This is the last option available to the creditor as the debt has never been paid.....arrange payment. Clear the debt and then you can clear the Charging Order.

No Charging Orders are nothing to do with bankruptcy..that's a Statuary Demand...but at the hearing tomorrow you would be wise to get an agreement/payment plan in place and never default on it.
