Hi, Apologies if this is posted in the wrong section.

I recently sold an item on Gumtree. Buyer paid via Paypal

The buyer was not happy with his purchase.

Instead of simply asking for a refund he immediately lodged a dispute with Paypal and

within a few hours escalated to a claim before I had a chance to reply.

I have offered a full or partial refund in my response on Paypal.

Buyer wants a full refund - No problem. But wants a refund before he returns the goods.

I don't think it is unreasonable to have the chance to inspect the goods before telling Paypal

to refund him.

Is there any legal requirement to return the goods prior to a refund?

The Distance Selling Regulations apply.

You'll have to get him to use 'Tracking' so that you can track the parcel.

I thought it was a requirement to return the item before a refund is issued ?

Thanks for your replies

I pointed out to the buyer that he wouldn't expect to go

into a shop and walk out with a refund on the promise of

returning the goods the following week.

The buyer has now seen sense and is returning the item.

In future, never offer a partial refund. the items are either unsuitable or they are as described etc. so for the former a fiull refund but no partial. All that does is encourage people to try their luck at a reduced proce, particularly inappropriate with an auction.
