Hello peeps and Happy New Year to everyone.

Im on here today to ask for help regarding Vanquis.

I have had a credit card with them for quite some time and up until now ive had no problems meeting payments etc.

Unfortunately I lost my job at the beginning of Aug and even though ive still managed to keep on top of things,

I am now struggling to find the money to make my next payment that is due at the end of this month.

I have already contacted them last month to explain that I was out of work and I was struggling to meet my monthly payment then.

They allowed me to pay less (for Dec) by refunding some charges but told me that this was a one off good will gesture

and they would not be able to do this again next month.

I have had my statement and as I anticipated I am not going to be able to make my monthly payment for this month,

before I ring them to discuss this again,

please could someone advise me what the best course of action would be.

When I contacted them in Dec I was told about a payment plan that they do,

where I could choose from my account being frozen for 12 months along with any interest etc or taking a payment break,

but this costs £1.75 per month for every £100 that is owed on the card.

for me this would cost approx £35.00 per month, which doesnt really help things :|

as ive said, before I ring them I would like to know what rights I have.

For instance,

can they force me to make the full payment,

or do they have a right to accept any offer I make towards the payment.

Thanks

Hello there, when did you take the card out originally?

If there are more missed/late payment charges you should look to try and have those refunded - there is plenty of advice here on CAG to help you do that.

It should be possible to try and get the interest and charges completely frozen - to do this creditors generally will want to see a statement of your financial affairs so that they can ascertain that the offer of payment you are making is fair and reasonable. If you have other creditors too you should be looking to make pro-rata or token payments to all. You can read more about negotiating via our self-help guide; http://www.nationaldebtline.co.uk/england_wales/debt_advice.php#4

Best wishes,

David @ NDL.

firstly stay off the phone!!

everything in WRIYING ONLY.

if they have already refunded 'some' PENALTY £12 charges, I bet there are more?

and did they refund the interest they charges on them?

it appears you might have been paying ROP, there eqiv of PPI?

does that show on the statements?

as for paying them

follow this:

TELL [dont ask] them they are only going to get £xxPCM for xx mts

as a goodwill gesture

and as a reciprocal GOGW they must freeze int & refrain from levying PENALTY charges.

if they wont

drop them to £1PCM for life.

.

as an example>

.

I am currently in financial difficulties and not able to meet my normal monthly repayments.

to show my goodwill, i am going to pay £5 for 6 mts.

i will update you in 6mts time or before, should my situation change.

.

could you please as a reciprocal goodwill guesture,

.

refrain from levying any penalty charges & freeze the interest on my account.?

.

Should you fail to assist me during a period of financial difficulty, contrary to all the guidelines and codes

issued by the relevent bodies and authorities that govern you and the way you conduct yourselves.

.

i shall have no alternative but to reduce my offer to £1PCM for the rest of the life of the account,

.

.

as your actions would do nothing to help me.

.

i thank you for your time.

..

.

dx

.

then pay by your internet banking site

.

and get reclaiming

.

TAKE CONTROL

.

or

if you have sent the above and they refuse

then write back........

.

.

i'm sorry, but you have failed to assist me during a period of financial difficulty, against all the guidelines and codes

issued by the relevent bodies and authorities that govern you and the way you conduct yourselves.

i repeat again, the contents of my letter dated dd/mm/yyyy, for want of clarification:

to show my goodwill, i am going to pay £XX for XX mts

could you please as a reciprocal goodwill guesture, refraining from levying any penalty charges & freeze the interest on my account.

i will update you in 6mts time or before, should my situation chance.

should you fail to help by refraining from levying unlawful PENALTY charges & freeze my interest,

i shall have no alternative but to reduce my offer to £1PCM for the rest of the life of the account,

as your actions are doing nothing to help me.

This is contrary to the rules you should operate under.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
