    • I'm not sure we were on standard tariffs - I've uploaded as many proofs as I can for the ombudsman - ovo called last night uping the compensation to 100 from 50 pounds for the slip in customer service however they won't acknowledge the the problem them not acknowledging a fault has caused nor are they willing to remedy anything as they won't accept the meter or formula was wrong.   I'd appreciate more details on the economy 7 approach and I'll update the ombudsman with any information you can share.

    • No, reading the guidance online it says to wait for a letter from the court. Should I wait or submit the directions? BTW, I assume that the directions are a longer version of the particular of claim accompanied by evidence, correct?
    • Thanks for opening, it's been another rough year for my family and I've procastinated a little.. Due to the age of my defaults on this and other accounts (circa 2021), I really need to avoid a CCJ as that will be another 6 years of credit issues. Mediation failed as I played the 'not enough info to make a decision' however during the call for some reason they did offer settlement at 80%, I refused. this has been allocated to small claims track, court date is June 3 and I've received their WS. I'm starting on my WS. They do appear to have provided everything required of them (even if docs could be reconstructions). Not really sure what my argument is anymore but I do want to attend court and see this through. Should a judgement be made against me then I will clear the balance within 30 days and have the CCJ removed - this is still possible isn't it? I'm going to be reading up today and tomorrow and hope you can provide me some guidance in the meantime. Wonder what your advice would be given the documents they have provided? I am now in a position to clear the debt either by lump sum or a few large installments - Is this something i should look into at this late stage? Thanks as always in advance
    • I have now received my SAR. It includes a great deal of information! Is there a time limit on how long account information is kept and/or can be provided to debtors? I have received many account statements which were not previously sent to me. I remember that the creditor should provide explanations of any acronyms and abbreviations that maybe used in the documents. Is this still the case? Also what, if any, are the regulations in regard to adding fees to a debt? Can fees be added to a debt after the court has approved a charge on a property. Perhaps due to the numerous owners of the debt, many payments I made were not properly recorded on the account, some were entered over a year after the payment was made! Following the Legal Charge, I paid every month until my payments were refused. I am trying to compute the over payments, but the addition of fees etc. is confusing me. Any comments and/or help would be appreciated.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes we can close threads which may be done for various reasons but we are not in the habit of removing threads.

 

I can see no personal data in the original post but am happy to be corrected if I have missed something but it doesn't alter the fact that the web archives cannot be edited and will remain available for those who find it on a web search for example.

 

IMS....... most unlike you to intentionally miss the point........ editing/removing data, what gives you the god given right to compromise that decision and reinstate data specifically removed from this site?

 

This is not about web archives, spiders and bots this is about your interpretation of the site rules and the rights of posters within it

Believe me Mike, I want to see crooked traders out the game as much as everyone else. But I can also see it from both sides.

 

The OP here bought a car aware the advisories it required. She even had somebody inspect the car on her behalf prior to purchase.

 

She then had an inspection carried out which included dismantling of steering components. The problems found are by and large just an increased wear on those previously outlined advisories. Now, in law as soon as another garage has actually dismantled parts the selling garage can wash their hands of it. I'm not saying that is ethically right or wrong, it is simply what the law says. After all an MOT tester cannot remove any parts during a test.

 

At some point we are all responsible for our actions. I think yes probably OP has bought a bad 'un. But in the eyes of the law I don't think the trader is being unfair in saying you bought an £800 banger, now live with it.

 

I guess it boils down to the selling s**t and risking litigation

Pops see again below and also I checked with the Citizens Advice. I read them exactly what was stated. They said if the vehicle had been repaired then that would be a problem. They had to have changed something. That was their info to me.

Used motor vehicles - consumer rights

 

 

When you buy a used motor vehicle from a trader, you enter into a legally binding contract and you are entitled to expect that it is of satisfactory quality, fit for purpose, and as described. An older vehicle with high mileage may not be as good as a newer vehicle with low mileage, but it should still be fit for use on the road and in a condition that reflects its age and price.

Traders cannot take away consumers' rights by using terms such as 'sold as seen' or 'no refunds'. If you buy a used vehicle from a trader online, you may have additional rights under the Consumer Protection (Distance Selling) Regulations 2000. You do not have the same legal rights if you buy a vehicle from a private seller or an auctionlink3.gif.

If the used vehicle is faulty, you have a short time after buying it to reject it. You may have other remedies such as repair or replacement. If the vehicle is faulty then you need to write to trader you bought it from. You should confirm the details of your complaint and the remedy you are seeking and keep copies of all correspondence. As a last resort, you may need to consider taking court action. Remember, used vehicles may have some faults, but they should not be excessive. Fair wear and tear is not considered to be a fault.

The car salesman will be getting a letter tomorrow and has already received an email. Since you have already altered it, why do you not remove the obvious details to protect me?

The vehicle is being held currently at XXXXX garage, in glastonbury, for you to pick up upon the payment of the above sum of money.

However I must advise you that you will need a trailer as this vehicle is not roadworthy.

 

what is the legal position regarding whats i have quoted. i would of thought YOU would have to return the vehicle to the trader with him giving you the refund.

Why do you fear the seller reading this thread? There are no details which identify you personally in the opening thread. Even if someone did manage to trace and contact the seller. Wouldn't it be in the interest of fairness for him to be able to give his side?

You can't leave it in the hands of the CAB and Trading Standards. CAB does not do things for you except give advice and TS are the same except if they receive enough complaints about a trader they will investigate, but not for you as a singular.

Viv. Perhaps you would care to give us some idea of what sort of help you initially asked for?

It appears that you criticise posters for their replies, but they are not responsible for your own shortcommings.

I was asked to help and gave an honest reply to a PM, setting out your options.

However, it has just occurred to me that it might have been wise to return the car as soon as you realised it was dangerous. IE shortly after starting off for home.

In a bid to offer further help could you say if car is Red in colour and have the letters ST as part of the registration number. I ask this as a long shot in case it's a car i may have knowledge of.

I have, in the meantime, received support from 1 ex solicitor, and 2 ex policemen who have contacted me with regards to this.

This coupled with the CAB who said that at each stage I can check with them for anything I need to ask.

There is a local forum where I live and lots of people who know me are helping to support.

If you had read all the replies I made you will see that the man had already been hostile to me in his office. I realised that returning to him alone was not an option. This was because I had asked to count the cash again as I had such a migraine that I couldn't think let alone count.

He was particularly unpleasant and not a little unnerving by the manner he refused to let me check the money.

I have in the meantime found out that the "friend" who test drove the vehicle, has a history with carsales man. This could of accounted for some of the hostility. And as he is also an ex car sales man, maybe he did have designs on my vehicle? Which had been pointed out.

Thank you all for your concern but I do not need any more assistance.

I will not be returning after this. I am deleting all that I can and stopping all emails as the admin do not seem to get any of my emails or seem to respond.

 

I would like to thank, however, Mike Hawk for making a newby feel like there was some support.

Hang on a minute. From the very start you said your friend wasn't a motor trade professional. But as it turns out, you now admit that he is.

 

Sorry to say this, but as you have contradicted your story several times over the course of the thread. I am disinclined to believe anything you say.

 

PS. The police (ex policeman or not) have never taken anything to do with consumer law as it is a civil matter not a criminal one.

Ex solicitor just managed to email you, but at the same time you complain of not being able to contact a moderator through email. :???::wink::!:
