i have a charge put on my house from the HSBC for a loan and a credit card my husband once had with them, this was done via DG solicitors in birmingham. I would now like to know how much i have paid off, i keep writing to DG but they are not responding, only with letters saying i still owe over £1000. Now i dont know if that is to them for their charges and i have paid my debt to HSBC, or i still owe that amount.

Please advise as they are now threatening again. I had been paying them £120 for so long i lost count of where i;m at with it all.

thanks

You are within your rights to obtain an accounting for the monies you have paid.

If this were me, I would be sending HSBC (with a copy to DG solicitors) a formal complaint - send it to their Head/Registered office. They should respond to you within 8 weeks. If they dont respond or they do and it is unsatisfactory, then you can take your complaint to the Financial Ombudsman.

You dont simply want to know how much is left to pay, you want to see a full breakdown of what you have paid. Do you have the original paperwork that advised the sum that they required you to pay ?

If you dont, then you might find it easier to simply request a Subject Access Request from HSBC, this will cost you £10.00 and you should receive pretty much all data and activity on your account.

Thank you so much, i believe the total debt to be something like £5k. I will see if I have the original paperwork, but I will definitely write to the HSBC now and copy in DG Solicitors. I had been paying for so long I don't even know how much I have paid , how bad is that on my part !!! So will the HSBC know exactly what I have paid ?

Thank you again

Regards

I am assuming that HSBC are still the owners of the debt, therefore they should have details of all payments made. DG solicitors are "in house" legal team for HSBC and one hopes that they have been passing these payments over !

How have you been making payments, by Direct Debit ? Do you still have a current account with HSBC ? If you have been paying via another bank, it might be a good idea to send a Subject Access Request to them - you are specifically requiring statements covering at the very least the period you have been making these payments.

I have attached a link for a draft SAR request below.

You will need to enclose £10.00 for the statutory fee and they have 40 calendar days in which to respond. I would suggest using a tracked method of mailing so you know for sure they have received the request.
