Hello my son who is an aspergers sufferer took out membership with a local gym (paid for with his disability money as he is at college) to help build his confidence and hopefully make new friends.

He went for a few months and then as he turned 18 his disability money was stopped through no fault of his own and he therefore couldn't afford to pay it anymore..he doesn't work as he is still at college two days a week.

The gym sold his *debt* to a DCA and now they are constantly ringing day in day out for the money...he lives with his nan and it was her number the gym had and so therefore its her getting the calls.

I have explained to the gym the situation yet these bullies still continue to try and get the money..where does he stand legally if anywhere at all please??

Who is the DCA?

And who is the gym?

Obtain proof of posting which is free from the PO counter.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Im not to sure his nan has stopped answering the phone but I told her next time get their details..the gym is a local independent one. I have also contacted the gym but they are ignoring me..I will send them that letter thanks x

Hi Discod and welcome to CAG

 

Did YS sign for the m/ship himself or did you sign for him.

 

If he signed under the age of 18, the agreement is not enforceable in any way, shape or form. He was a minor and the gym cannot hold him to any such agreement.

 

Let us know about this and we'll advise you further.

OK, let us know asap if it was YS that joined himself and not you or his nan that signed him up for m/ship.

 

Please confirm if there was an admin company that dealt with the gym's m/ship.

 

Please also confirm the DCA that is now chasing for payment.

 

Ignore any phone calls or demands until we know about how YS joined up.
