Hello I received a parking charge from ukcps for parking outside a marked bay at a retail park on the. 29th dec 2013 to which parking is free if I pay the fine within 14 days it is £60.00 if not it them goes to £100. The markings spare a pale yellows colour done in block paving against the pinky red colour also in block paving I have taken pics and also of parking bays in a local supermarket to which are painted in bold white lines much clearer to see I think how they should be marked do I have to pay this fine as I am worried if I ignore it completely I will end up going to court etc and paying a bigger fine please help.

I have moved your post to a thread of its own so that you don't get lost in another persons thread.

 

As to UKPCS, this is NOT a fine, it is a speculative invoice or in other words, a begging letter.

You do not have to pay this but you can cost them.

 

Send in an appeal to this ticket and when they reject it (and surely they will) you can then go to POPLA which will cost UKCPS so a win win as even if POPLA reject your appeal, you still don't have to pay.

 

The only time to get mildly concerned is if they are foolish enough to initiate court action but they can only do that if they have the landlords permission.

If they don't have the permission then only the landlord can initiate the action.

Hello and thank you for both replies how long does it normally take once you appeal for them to not to continue to ask you to pay this as I don't want to end up with them wanting a larger amount off me and I am really anxious about if they threaten court

Please try not to worry. Yes this could go on for some time. You are likely to get a few letters from them followed by a debt collection letter (who are dead easy to see off) and it matters not if the amount goes up. It is still just an invoice.

Please read other threads and you will soon see what we are going on about.

 

I did mention court action just to make you aware but the chances of them going there are very slim.

Thank you I have read the letter that you posted on here. I must definitely appeal and not ignore the charge altogether and in my letter of appeal I state my reasons do I need to include anything else as I have never done this before.

 

That letter will cover most situations. Nothing else to add to it apart from:

If this was a windscreen ticket you do nothing until you get something through the post.

Which should be between 29-56 days after the windscreen ticket.

Yes it was just stuck on the windscreen but even if it says to pay with the stated time I shouldn't appeal just yet

 

No you shouldn't. A windscreen ticket is a Notice To Driver.

They don't know who you are. After 28 days they can pay the DVLA to get reg. Keeper details.

If you get something in the post you then appeal as reg. Keeper. ..

There are signs placed at the retail park but I thought they were just stating how long you could stay for it wasn't till after that when I read it in smaller print it states about being charged for parking outside a marked bay I am just worried I end up with a bigger parking charge .

You need not worry. You may not get a NTK in the post but if you do, the parking charge notice will be cancelled when you appeal toPOPLA.

You do not need to do anything yet, apart from read up on this 'industry'...

The Road Traffic Act determines the minimum size and markings required for parking bays on a road or in public (council owned) car parks. There are no such definitions for parivate land so you cannot be said to have breached any requirement as there is none to breach. Your parking has undoubtedly not cost the landowner or occupier a penny so any claim by UKPCS doesnt have a leg to stand on. They rely upon people just paying up without complaint. Your argument could be that theere were no marked lines and you thought that the block paving was very pretty but it wasnt indicated anywhere that the different coloured blocks signified anything and if UKPCS claim otherwise please let them show the necessary planning order.
