Hi there,

Where do I stand with this one ?

 

I had an overdraft with Lloyds bank for £2400 back in 2004 which was sold to Lowell's.

 

They are threatening to take me to court and say that the balance is £2,703.92.

 

I asked Lowell for proof of ownership of this alleged debt and to prove it.

 

They send me a bundle of "statements" from 2004-2006.

 

Can they enforce this?

The history of the debt is that

 

in 2006 it was an overdraft with Lloyds TSB for £2400.

 

It was then passed to Apex in 2009 (who I was paying £1 a month to)

then stopped because I heard that some debts are to be legally assigned (but I'm not sure about O/Ds)

 

Then have paid nothing since but it was passed to Moorcroft in 2010

then Credit security in 2010

then Westcot in 2011,

Gpb in 2012,

then iQor in 2012

now Lowell's.

 

They have sent me a bundle of statements from 2004 - 2007.

 

I notice that some charges applied to the original debt with Lloyds and it now is for £2703.

 

Lowells gave me 7 days to reply (that was on 17th Dec) and are now passing to BW Legal LTD.

 

They said that this will go to county court and CCJ's and charging orders etc against our home.

 

Do these statements give them any legal powers and what now ?

Then the limitation period runs from that date. So you've another year before it becomes time barred.

 

How much of that O/D is the banks fees and charges?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!
