    • Yep, I read that and thought about trying to find out what the consideration and grace period is at Riverside but not sure I can. I know they say "You must tell us the specific consideration/grace period at a site if our compliance team or our agents ask what it is"  but I doubt they would disclose it to the public, maybe I should have asked in my CPR 31.14 letter? Yes, I think I can get rid of 5 minutes. I am also going to include a point about BPA CoP: 13.2 The reference to a consideration period in 13.1 shall not apply where a parking event takes place. I think that is Deception .... They giveth with one hand and taketh away with the other! One other point to note, the more I read, the more I study, the more proficient I feel I am becoming in this area. Make no mistake DBCL if you are reading this, when I win in court, if I have the grounds to make any claims against you, such as breach of GDPR, I shall be doing so.

    • the Town and Country [advertisments ] Regulations 2007 are not easy to understand. Most Council planing officials don't so it's good that you found one who knows. Although he may not have been right if the rogues have not been "controlling" in the car park for that long. The time only starts when the ANPR signs go up, not how long the area has been used as a car park.   Sadly I have checked Highview out and they have been there since at least 2014 . I have looked at the BPA Code of Practice version 8 which covers 2023 and that states Re Consideration and Grace Periods 13.3 Where a parking location is one where a limited period of parking is permitted, or where drivers contract to park for a defined period and pay for that service in advance (Pay & Display), this would be considered as a parking event and a Grace Period of at least 10 minutes must be added to the end of a parking event before you issue a PCN. It then goes on to explain a bit more further down 13.5 You must tell us the specific consideration/grace period at a site if our compliance team or our agents ask what it is. 13.6 Neither a consideration period or a grace period are periods of free parking and there is no requirement for you to offer an additional allowance on top of a consideration or grace period. _________________________________________________________________________________________________________________So you have  now only overstayed 5 minutes maximum since BPA quote a minimum of 10 minutes. And it may be that the Riverside does have a longer period perhaps because of the size of the car park? So it becomes even more incumbent on you to remember where the extra 5 minutes could be.  Were you travelling as a family with children or a disabled person where getting them in and out of the car would take longer. Was there difficulty finding a space, or having to queue to get out of the car park . Or anything else that could account for another 5 minutes  without having to claim the difference between the ANPR times and the actual times.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

After chasing up my own request made in November and being told by the BDC that they hadn't received any such request, I did a bit of research.

 

It seems that this is not an uncommon event, BDC's up and down the country routinely mislay, erase, or as in my case just refuse to admit they received a request.

 

The 40 day response time is also routinely ignored, one person I contacted told me they finally got the information six and a half months after requesting it, and that was after sending in three applications.

 

Interestingly the DWP state that the address to send SAR requests is 'found at the top of letters we write to you', which is what I did. I was somewhat bemused to be told by a spokesperson at my local BDC which is supposedly based in Hackney East London but has a Nine Elms Lane SW95 address, that it's actually Glasgow benefits bentre that process London claims, and any correspondence to them gets routed through Wolverhampton first!

 

So I suppose Hackney processes Glasgow's benefit claims then?

 

All done in the name of efficiency of course. I often feel the DWP are obtuse at times, I've now come to the conclusion that they are round the bend.

I had "issues" with a SAR I had personally delivered to my local JCP office - They provided a CD of (some) telephone calls along with a fairly comprehensive printout from Newcastle and an incomplete file from A4e (who were running the FnD programme in my area). Played letter tennis for a while with the data controller in the local DWP office pointing out the omissions in the A4e file. The last letter I sent to him, I informed him that I would hold him personally responsible for the missing data and name him in any complaints raised with the ICO and/or my MP.

 

Did it do any good. No, but I still have his name on file should I ever need it.

Regarding the location of the processing office, there are three factors at play.

 

1) Some offices are allocated an area remote from their physical location. I worked at Glasgow BDC, which deals with claims from Central and West London. This is political and pragmatic - it's harder to recruit staff on DWP wages if they also have to live in London.

 

2) Offices sometimes export work if they are overwhelmed. For a time I worked in a team that variously processed claims from Romford, Stratford (London), Makerfield (Lancashire) and some others. We were the most efficient office and we had spare capacity.

 

3) Specialisms: some things, such as debt collection, are handled in offices that don't actually process the claims for that area. Habitual Residence Tests are all processed at an office in Wick, on the far north coast of Scotland.

 

Addresses: the address you see for any given BDC will not usually be the street address of the building where it's located. The address is that of a secure Royal Mail handling facility which tends to process mail for a number of Jobcentres and BDCs in the area. Mail is then redistributed to each office, with predictable consequences.

 

Right, so - the place to send your SAR is the Royal Mail standard address for the office that holds your claim. That office is the one that is ultimately responsible for what happens, and will typically be the BDC associated with your local Jobcentre, but not necessarily the closest BDC. Mail such as that should be sent Recorded, and I really do feel more people should be complaining to the Information Commissioner's Office about tardy responses to SARs by the DWP.

Which is what I thought antone, however the guy I spoke to at Hackney BDC which is the office I've always dealt with, regarding payments, claim inquiries, etc. Insisted that Glasgow is the place to contact. It's confusing.

I'm just going to print off three copies and send one off to JCP, one to Hackney, and one to Glasgow all recorded delivery.

One has to get to the right department..................hopefully.

 

This is all part of the evidence trail that I'm putting together with regard to the wrongful sanction I received in December (still unresolved by the way), there's a heap of stuff that just doesn't stack up. Things like my prognosis changing magically from 12 to 24 months ( I was referred to the WP by JCP's ESA advisor in Feb 2012 because she said my pronosis on her system was 12 months, therefore a mandatory referral) when it was definitely 24 months to begin with, Hackney BDC have confirmed that the status was put on the system as soon as they processed the tribunal decision.

 

Being told by JCP's WP liaison officer on Christmas eve that the sanction had 100% been overturned and that she was looking at that info on the screen as she spoke to me. The story changed in the new year to it's still being hammered out between JCP and the LM DMA,so she imagined it then? A hallucination?

 

Apparently everyone concerned with the case at Stratford JCP is in full agreement that the sanction was 'unlawful' that I've been treated abominably , but seem powerless to do anything about it, I feel I'm being given the run around big time.

My MP has raised the issue with the Director General of Operations at JCP but that's going to be a drawn out affair methinks.

If you're sending multiple copies, also address one to central office at Caxton House, Tothill Street, London, SW1H 9NA. It shouldn't be necessary to send three/four/five requests to different offices - I'm sure the ICO would agree that a single SAR delivered to the local DWP office should be sufficient.

I sent my first SAR in September(sent the 17th), I have proof of posting for that - ignored

Made a complaint on 11 November. Took it to my local JCP who stamped and took a copy and sent it to the complaints team.

The complaints team then responded by promising me it by the 24th December 2013. IT still isn't here on the 4th January. I sent a complaint to the ICO on the 29th December 2013, and am waiting to hear from that.

So far I have waited 4 1/2 months for this info.

The DWP plainly don't want this info being made readily available, hence the hassle.

 

I guess the expectation is that people will eventually give up.

SAR information received from DWP today, two A4 sized parcels containing 830 pages in total, many printed on both sides. Crikey! And that lot is just the info for an ESA claim spanning 18 months, luckily the vital info was near the top, I really didn't fancy going through that lot page by page.

Did you request all information held by subcontractors (i.e. Work Programme providers) ?

 

If not, another SAR targeting Seetec's records (sent to the DWP) would be in order.

Yes, Seetec's stuff was among it all including their contract with all financial figures redacted.
