    • Good Evening, I've got a fairly simple question but I'll provide some context incase needed. I've pursued a company that has operations in england despite them having no official office anywhere. I've managed to find a site they operate from and the papers there have been defended so I know they operate there. They've filed a defence which is honestly the worst defence ever, and despite being required to provide their witness evidence, they have not and have completely ignored the courts and my request for copies of it. I'm therefore considering applying to strike out their defence on the grounds the defence was rubbish and that they haven't provided any evidence for the trial. However, it has a trial date set for end of june, and a civil application wouldn't get heard until a week before then, so hardly worth it. However, my local court is very good at dealing with paper applications (i.e ones that don't need hearings, and frankly I think they are literally like 1-2 days from when you submit it to when a Judge sees it. I'm wondering if I can apply to strikeout a defence without a hearing OR whether a hearing is required for a strikeout application.   Thanks
    • I have just opened another bank acc with lloyds (i have a few already) After doing some research they may have some relation to tsb or be apart of the same group will this cause me issue if my salary is paid into my lloyds account? Also, if the debts do go into default and nothing is paid then after 6 years it all goes away? As the DCAs cannot do anything? I do want to start paying in like 3/4 months or do you advise I leave it if it goes into default? again sorry for all the questions, i am just processing everything

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

No prob imp, if i paid this tomorrow id owe £1168 , when its due its £1400(i rolled it ova stupidly paying £150 on the 7/2) so are you saying they will wait till its due and slap even more interest on it? Christ , they have you all ways ive told them i cant pay and its frustrating them messing around , iys quite clear im being up front with them , its another ploy to fleece me, guess i just have to sit tight and wait to hear , im not backing down from my offer, they can take me to court and get less .

Wonga seem to think that they cant do anything until 3 days before your loan is due to be repaid. Plenty of people have said that they try and add on charges etc as the payment date will obviously be missed.

Im literally pleading with them to accept my offer to give me peace of mind

 

I hate myself for getting into this mess, never again, so learnt the lesson and im seeing these people for what they are. Guess i need to just sit and wait now, its sickening

It may feel sickening, it's not.

 

That's why I asked in a previous post WHAT you owed, not what they SAY you owe.

 

Now answer the question that I asked you, WHAT do you owe? (How much did you borrow? How much have you paid back?)

Ok i will calm it down its just difficult when i just want it sorted

 

I borrowed £1095

 

Rolled over 1 month and paid £195

 

If i paid it today in full id owe £1175 and by the due date which i think is 5/2 roughly its £1403 give or take

 

Ive offered £150 pcm they are just giving me a genetic email obviously putting me off to raise more interest

 

How would yous two play this now?

Update: GREAT NEWS

 

Ive got my payment plan sorted, theyve agreed to freeze it and im paying £153 pcm over 9 months, im happy with that as its very manageable

 

NEVER AGAIN, thanks to all the help off this forums on how to stick at it and take the lead, to be fair wonga were very quick in hindsight to agree and its a lesson to me to never get involved with payday loans. The advice here has been invaluable. Im paying them back into their bank via standing order

Just to check. You did get it in writing and are paying by standing order right?

 

In an email yes, listing payments and yes im paying them by standing order, i got their bank details off them.

 

The email matches the payments on their website so i will see how it all goes, im making my first payment 3-4 days before its due so i can record they got it. I trust none of them but wonga seem the less scrupulous ones of the lot

Every thing is in writing, i used advice on here and did it all by email and kept a file, if they mess it up ive got every email sent and received

Just a quick note to say have a look at your credit file as they may have put an arrangement on it regarding the outstanding loan just in case you wanted credit in the near future, i think they just report to Experian, but this did not hinder me getting credit (through a high street bank at there best rate as well) when i had one on my report, and about 3 weeks after being put on my file it dropped off even though i had about 3 months left to pay, not sure if I was just lucky there though...? I agree I will never never touch these companies again as long as i live I would rather have no money than go through that Hell again....! and well done for facing up to them.

 

Without the help of this site and people on it I would have not known what to have done. it has a wealth of information on it covering everything and is so valuable to have this resource..thanks...

To be honest my credit rep is shot to pieces, im hoping this learns me a tough lesson and never deal with a payday lender

 

 

Its too expensive, ive been bankrupt 6 years ago so they obviously done no checks, ive got no real beef with wonga, after the dust has settled i must admit they could have easily said no, and acted as i was told they would but agreed pretty quickly to my offer( i did demand to speak with various directors and said i was close to breaking down) maybe that helped, but this site taught me to play hard. Wonga are legalised loan sharks they all are, its a horrible way to borrow money because its difficult to get out of the trap and believe me its a massive trap. Im recovering, thousands are worrying and need to front up their debts with these lenders and learn to pay it back if possible and never use them again

 

Easy said guys but i say this if you are in trouble, stop worrying and make them an offer and stick to your guns, they cant get what you dont have but use the advice on here and dont be scared , ive had sleepless nights and now im at peace and prepared to learn from it.

Hello,I was in the same situation as holycrosser however I read alot of good advice on this forum and went ahead and changed my wages to another account and cancelled my debit card. I went onto the "my account" section of the Wonga website 3 days before my due date and filled in the I&E form and to be honest it isnt intrusive but saying this i do appreciate that we do not have to provide as much detail but it wasnt really a problem for me. I managed to set up a repayment plan of £160 over 12 months which is also showing on my account. Fingers crossed i dont get any problems with Wonga trying to take the full amount but I think I should be OK. To anyone who may be stressing just know that i didnt speak to a single person or have to explain anything, I just done it all online and it was painless.Thank you CAG members.

Good to read you got there in the end :) im almost on my 4th out of 12 repayments and to be fair they were pretty good in sorting out a repayment plan for me... just poundstopocket to deal with now

 

 

Wilko GOOD LUCK with Pounds to Pocket. If theyre anything like QuickQuid, their sister company, then you will struggle cos they wont take repayment plans unless its by debit card/direct debit.... ( they do of course do it by standing order too but you have to go higher than the customer service team and the collections team....
