    • moved to the debt self help forum. plenty of like threads here to read along with the ones you've done so far..good work. last thing you ever want to do is look at any kind of IVO/BK or anything alike concerning consumer debt, never do that, turns unsecured debts into secured ones in many instances. your best bet for now is p'haps looks at  Options for dealing with your debts: Breathing Space (Debt Respite Scheme) - GOV.UK (www.gov.uk) sadly you have to go thru one of the free debt charities to invoke that but DON'T be tempted to also open up a DMP with them, just get the Breathing Space done. get that in place that gives you at leasy 60 days buffer you've also goto to realise you'll probably get a default once breathing space is in place, bit if not it might pay you to withhold payments even after BS then p'haps re start payments once a DN for each debt is issued and registered. at least that way, whatever happens in 6yrs the debt will drop off dx  
    • Hello, I am a private seller and recently sold a pair of trainers on eBay.  Everything seemed fine until just after the eBay 30 day mbg had expired.  The buyer contacted me with photos showing me that both shoes had ripped.  He wanted his money back, and after refusing to refund him, he then left me retaliatory and defamatory feedback on my profile to the effect that I had sold him fake trainers (this was removed by eBay).  He then initiated a chargeback via Paypal.  Invariably, the outcome was in his favour, and I have now been charged for the cost of the trainers.  I would have also been stung for the chargeback fee, but eBay refunded this.  Incidentally, I do have the email receipt of the trainers from when I bought them from a well-established and bona fide online retailer.  The susbequent conversation with eBay followed its predictable course, i.e. the chargeback is out of their hands etc. I have been in contact with citizens advice, and my bank.  Citizens advice told me that as a private seller I'm responsible for the "Title and description" of the goods, but not the performance, or the fitness for purpose.  To me it is clear; if you receive something that's not as described, you don't then use the goods, and more than 30 days later claim 'not as described'.  In my mind, this makes the claim fraudulent.  He's used the 'they're fake' card to give credence to a 'not as described' claim here, obviously, without any evidence.  My understanding is that the chargeback is unlawful, because the trainers were shipped as described.  However, I read something on an eBay forum regarding sellers having no statutory rights, i.e. no right to appeal against a chargeback decision, or to complain to the financial ombudsman.  Does this mean that if my bank disputes the charge on my behalf, it will be to no avail, even if it's recognisably a fraudulent chargeback?  I have reported it via the Actionfraud website. Any advice, anyone?  Would be most grateful!
    • Thank you, I have drafted my letters and started to complete the reply form, printed from this site and not using the one they provided.    2 questions, on the forum link it says to tick box D & I, the reason for box D will be given on my thread, what would my answer be to "I dispute the debt"?  Do I send anything for the Vodafone debt they have included?  I've only done 118 loan s. 77 & capital one credit cards so. 78    Thank you

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

We have no problem getting the evidence from his GP.

 

We were getting private treatment through work but this ended when he lost his job. He is now seeing a ENT specialist, BP specialist and a nurologist as there is some query on whether the spinal surgery he had done (disc replacement in his neck) is the cause of the problem although they won't admit it eben though the blackouts started straight after the surgery.

We submitted my husbands ET1 and received a letter to say that the claim had been accepted and his employer had until 20th December to respond.

 

Well the 20th has been and gone but we have heard nothing. I know with it being Xmas most places will be closed but what happens now? Shall I wait a bit longer?

I know very little about employment tribunals, but would assume that the employer responds to them, and then anything would be forwarded to you/your rep. My experience of benefit tribunals is that the forwarding of information can be pretty slow, even without christmas holidays.

Hi, hoping someone can offer a little help.

 

My husband began receiving ESA CB in Setpember 2011. He returned to work in June 2012so it ended. In September 2012 he lost his job due to his health and that they considered his blackouts to be a danger to others.

 

He then claimed ESA again in the September and was told he would receive this until 5th Jan 2013 as he can only claim for a total of 365 days.

 

We have since appealed the group he was placed in and received a call on 27th December 2012 to say they have received his appeal. A few days later we have received an ATOS limited work medical to complete.

 

We have been advised the appeal can take 6-9 months. Do you receive any payment during this time or not. We rang DWP and the lady advised out payments weren't stopping even though we had a letter telling us they would end 5th Jan 2013. I'm only asking as I find it hard to trust anything the DWP says.

Prior to his payments ending we appealed the group he was placed in as we felt suffering blackouts should put him in the support group and not the work group.

 

They have received his appeal but we have been told he won't receive any money during the appeal and if he wins the appeal which we have been told can take 6-9 months no money will be backdated and would only commence from the day of his medical.

 

Any advise would be appreciated.

Im sure someone will correct me if i'm wrong but because this sounds like a supersession, that might be why you do not receive any money.

 

You only have 1 month from the date of a decision to appeal. Unless you can prove that you didn't know that you could etc.

 

I hope someone else here can give you more specific advice but if not it would be best if you see someone from Welfare Rights or CAB.

Yes, this is correct, if he has been assessed as not being eligible for income based ESA (for instance if you work), then he won't receive any payments unless he is successful in being put in the support group.

My husband was in the WRAG group and in Jan 13 he had received his 365 days of CB ESA.

 

He appealed as believed he should be in the Support Group as he suffers blackouts. They last from a few secongs to around 20 mins. He can have between 7-20per week and yesterday was the 1st time he lost control of his bladder and last week he blacked out coming downstairs at home and landed on our 13yr old daughter who was in front of him. Luckily she only twiested her arm and a bruiseon her wrist.

 

Today we have received a letter to attend a medical on the 27th Feb but as he is at hospital that day they have moved it until the 1st March. I have also asked for it to be recorded.

 

What we are wanting to know is what are they looking for? He does walk with a stick since he had spinal surgery 18 months ago but he can live and work with that no bother. Its the blackouts that are the major problem but this isn't something that can be visably seen its something that happens whenever/wherever and he has no control over them so very unlikely he would have one during the medical.

 

So if they can't see it how can they assess him?

Firstly, it isnt a medical at all. It is an assessment of someones ability to mobilise and work.

Every indication should be given about your husbands problem and how it actually affects his ability to move and do anything repeatedly and safely, and it should be pointed out that he would not only be a danger to himself if allowed to work but a danger to others if he falls on them etc etc etc.

My husband began receiving ESA (CB) in Sept 2011. In June 2012 he decided to return to work but in the September 2012 and due to ill health he was dismissed. The same month he began reclaiming his ESA (CB) which ran out in Jan 2013 due to receiving the maximum allowance.

 

A few weeks prior to the end of his ESA we appealed the group he was placed in as felt he should be in the Support Group as he suffers blackouts anything between 7-25 per week lasting from a few minutes to 15 minutes, causes himself some injuries and our poor daughter who he landed on and twisted her wrist.

 

I keep reading that you get 1 month to appeal a decision you think is wrong but my husband reclaimed ESA in Sept 2012 and we appealed in the December.

 

At the moment he receives no money as this ended on the 5 Jan 2013 but we did have to complete the Medical Questionaire and he has an app with ATOS on the 1st March for an assessment.

 

So does that mean he appealed in time although it was outside the 1 month from he re-claimed ESA.

Even if the appeal is out of their stated time, it can still be appealed due to mitigating circumstances, I have done similar for an alleged overpayment by the DWP some six months after I told them (in writing) I wanted to appeal.

 

I hope all goes well in March, and that you don't have to join the ever growing queue of disabled people who score no points and told they are fit to work.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

A formal appeal via letter/completed GL24 form against your husband's award of employment n support with the work related activity component?

 

Or

 

A request for a new decision (supersession) on your husband's claim because you believe he meets one of the criteria for an award of the support group component?

 

The current work capability assessment could be a routine reassessment for entitlement to national insurance credits or, if you've asked for a new decision, part of the response to your request.

He was placed in the WRAG in Sept 2011 which is when he had spinal surgery and we were told a recovery of 12 weeks. However the blackouts started not long after the surgery. In June he returned to work but was dismissed in the September. We filled out the ESA forms again in September 2012 but stating he now suffered blackouts and he was placed once again in WRAG. In December 2012 I completed the GL24 as we believed he should be in the support group.

When, in relation to the September 2012 re-application did you receive notification that if had been placed in the WRAG group? This is the important date - you have to appeal within a certain period of time of receiving their notification (the bit in the letter that says 'if you don't agree with our decision') not based on when you apply for ESA for the second time.
