hi everyone

 

stupidly enough my oh and I both have provident loans

 

we were up to dare until I had a accident at work start of November we still kept up to date but the past 3 weeks we've been paying £10 per week each rather than £17.50 and £25 respectively.

 

today when our agent came she told my oh that her manager will call round as they'll need to investigate late payments.

 

I'm I two mind tbh with this because I'm paying them more than any other creditor (£5 per month) and before my accident (which has caused a brain injury) we always paid on time and in full - intact I always paid more as my payment was £17.50 and I always gave her £20 as it was easier

 

my question is what rights do they are I have in regards to this? tbh I really don't have the energy to deal with them I don't mind paying what I owe but I also don't feel I should have to justify to someone why I am off work if the dr is saying I'm not well enough that's enough for me

 

I've no idea what this investigation entails as I've never had to deal with it before. this is my first loan with them and I'm half way through paying it off

The provident is a doorstep collection company so they can call to your home to collect the payments on the due date. They have no right to enter your home and of course you wont want to be discussing your financial circumstances on the doorstep.

 

If there is any "investigating" to be done, which I assume just means enquiring into your financial circumstances and probably havign a nose at what you have in your home, then I think you are within your rights to deal with this in writing.

 

You might want to consider speaking with National Debtline. Having a Common Financial Statement produced and then send a copy of this with a letter advising ALL your creditors, including the Provident that you are experiencing a financial hiccup and require them to accept £5.00/£10.00 per month until you are back on your feet again. At the same time, you would like them to cease adding interest and charges so the money you are paying is reducing your liability.

thanks I've been honest with th agent from the start that I'm not not paying her by choice I just can't give her what I don't have she knows all about the accident and has done since it happened

 

I don't mind explaining but what I'm trying to make them see it is just a waste of time as nothing will change I am already giving them more than I can comfortably afford I'm still trying my best to pay I just don't see the point in explaining things over and over again

Hi

You don't have to deal in person if that is what you want but it may be that the manager wants to assist. I can't say i have heard that many horror stories from Provi (but there are some)

 

If you do let him into your home and he gets stroppy, tell him to leave. Once permission to stay has been removed, he has to go.

If you are asked to deal with any matter via private message, PLEASE report it.

Dont let them into your home. Tell them that you want everything in writing and they are never allowed to call to your home again.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..
