and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

ok a hardship claim is usually to do with trying to escalate a complaint already in the system

 

as there is..you need to ask the FOS to pull their fingers out.

 

if she cant afford the monthly

then tough luck for them sent this to lloydstsb

 

TELL [dont ask] them they are only going to get £xxPCM for xx mts

as a goodwill gesture

and as a reciprocal GOGW they must freeze int & refrain from levying PENALTY charges.

if they wont

drop them to £1PCM for life.

to show my goodwill, i am going to pay £5 for 6 mts.

 

i will update you in 6mts time or before, should my situation change.

Hi Suvin,

 

Thread moved to the Lloyds forum.

 

If YW is charged any penalty charges for not making the full minimum payments, they should be reclaimed in full. As they are fixed penalty charges, they are not enforceable in law.

My ex has just received a Default Notice from LTSB.

 

She has written twice but has had no reply apart from when they asked for details of income/expenditure which she has provided.

 

They have not stopped adding interest and have applied penalty charges.

 

She has written advising that they are not following COBS guidelines.

 

Where does she go from here?

Hi Suvin,

 

You need to list all penalty charges added to the a/c for however long the bank has been charging her these penalties.

 

Although this is a PPI spready, it'll calculate 8% simple interest on the charges for you, to show the very minimum you should be reclaiming - http://www.consumeractiongroup.co.uk/forum/attachment.php?attachmentid=32296&d=1324293397

 

You could also consider claiming restitutionary interest at compound rates, which may significantly increase the interest you claim depending on how old the charges are. This will probably involve taking court action against the bank.

 

When you have the figures ready, let us know how the penalty charges and interest compare with what is owed on the a/c.

Letter from ltsb Customer Services today. Apologies for not following COBS rules and a cheque for £50 as a goodwill gesture. Also they have refunded penalty charges and the interest which was added to the account for the previous two months. They have also agreed to accept £5 pm for the forseeable future.

Are you happy with this outcome?

 

Have you used a spreadsheet as suggested. If so, how do their refund figures compare with yours.

 

Result with the £50 compensation but don't let them get away with anything.
