Hi all.

Had a very upset sister ring me earlier.

She stated that bailiffs had visited and demanded full payment of £465 for non payment of TV Licence

and that if payment was not made tomorrow that they would break in and remove goods.

Im assuming that this had gone to court at some point and been ordered by a judge.

My sister cannot recall any letters sent to her with regards to a summons and a subsequent judgement etc.

What would be the next steps please?

Any advice very welcome!!

First things first, were the Bailiffs? Did they identify themselves as bailiffs and produce ID?

If they didn't enter her address then they can't just 'break in' they will have needed to have made a peaceful entry first.

Unless she leaves a door or window open then they will access the property that way.

As for the TVL they must have been inside her property and taken a statement off her regarding non payment?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Hi BB.

Yes..baliffs...ID confirmed. No conversation with TVL inside her property. Ballifs stated full payment tomorrow or they will turn up with locksmiths!

This is actually pretty simple.

If your sister had not received a summons then you needs to contact the court ( that issued the warrant) and they should allow her to file a Statutory Declaration.

She needs to find out WHICH court this was. The information may be on the letter from the bailiff. It should states something like HMCTS Manchester, HMCTS South East London etc.

Please post back and we should be able to provide further info.

PS: Your sister should have received a Further Steps Notice before the bailiff visit. Did she receive this? If no...has she moved address since the offence?

Thank you TT. My sister has moved addresses so any documentation could have been sent there. Letter from bailiff...im not sure has one but i will ask.

Update....the bailiffs are from Swift and have given her a Final Notice letter? No name of court on it whatsoever. Any previous correspondance must have gone to her previous address also. What next please?

At her previous address - as that is what it looks like is involved - did she ever get a visit from TV Licensing alleging she didn't have a licence? The chances are it may have been the Court that was local to that address.

The fine would most likely have been issued in the court close to where she used to live. I would assume that she lives in Wales ( because of Swift being involved). Can you post back with a main Magistrate Court for the area where she used to live and I should be able to provide contact details for you.

Thank you both. Her area falls under Neath-Port Talbot so im guessing that would be that court although they also refer to Swansea. Will tell her to contact
