Hi

 

Can some one help with how I should proceed,

Without going into too many personal details

 

My story is as follows

My husband was the sole breadwinner and wage earner,

He had a Mental breakdown whilst at work with a suicide attempt and after urgent Psych evaluation

He has been signed off work for a minimum of 6 mths but docs are saying could be much longer,

 

I am now his full time carer and we are struggling to survive on £86.70 ssp and £25 income support,

 

We have a Mortgage of £510 per month which we will get help towards from Jan 14th 2014

which will leave a shortfall of £144 per month on the interest which I have to Magic up from somewhere!

 

I have applied for PIP for my husband and we are waiting on a decision Not expected until Feb at the earliest!

 

Our Electric alone is £150 per month as we live in an old cottage and do not have Gas and

 

after paying Water,

Tv licence, and

car insurance

 

We are left with approx. £50.00 per week to buy food and petrol!

 

I have written to All the catalogue companies there were 3

explaining the situation and

 

after sending in documentation to fifty plus - which was in My husbands name

they have wrote off the debt of £280 as a gesture of goodwill,

 

However Littlewoods and Very - who I owe ( they are in my name) - a combined sum of approx. £5000

will not even entertain a freeze on my account even though I have sent them proof of benefits,

Bank statements Copies of direct debits etc

 

I have written to them 3 times explaining the situation and that I cannot in any way pay them anything at all

I do not have enough to live Myself but

 

their only reply was to say I had to Pay a minimum of £15 per month on each debt and they will allow this for 3 months!

 

I was never in arrears before this disaster with My husband happened and our income has dropped from £1700 take home to £450 per month!

I have not answered any phone calls from them as I stated in My last letter that I would only deal with the issue in writing,

 

Now I am getting txt messages from NDR regarding the arrears!

 

What else can I do?

 

I can not make an offer to pay and the stress it is causing means I only get a few hours sleep per day in between pretty much doing everything for My husband,

Hi and welcome to CAG.

 

Sorry to hear about the Hubby. The simple answer is don't worry. I know it's easy to say, but they can do absolutely nothing. Should they take you to Court, the Judge will only set an amount you can afford and they wouldn't be able to add any charges.

 

When were the accounts opened? If pre April 2007, you could always ask for a copy of your agreement, Littlewoods never sent these out, so couldn't litigate anyways.

lowest of all priority.

 

do this:

 

TELL [dont ask] them they are only going to get £xxPCM for xx mts

as a goodwill gesture

and as a reciprocal GOGW they must freeze int & refrain from levying PENALTY charges.

if they wont

drop them to £1PCM for life.

to show my goodwill, i am going to pay £5 for 6 mts.

 

i will update you in 6mts time or before, should my situation change.

could you please as a reciprocal goodwill guesture,

as your actions are doing nothing to help me.

This is contrary to the rules you should operate under.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Also remember,

 

if they try to take you to court,

 

you can show the judge of your hardhip and that you notified the catalogue companies of said hardship.

 

They ignored you and kept piling on charges and interest.

 

Therefore you can ask the judge to remove them as they are purely profiteering and is in violation of OFT guidance.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Sorry to hear about you situation.

 

As you are doing, keep everything in writing and also keep copies of everything sent and received.

 

Do not telephone them and if they telephone refuse the DPA questions and tell them to write to you instead. Do not get involved explaining why etc. Just put the phone down.

 

Make sure that all Utilities, Council Tax, TV Licence, car insurance etc. is paid first as these are priority bills, catalogue debts are at the bottom of the pile which is why they shout the loudest.

 

Is your mortgage payment assistance only for a certain amount of time?

Makes Me feel better that I am supported if only in a forum!

 

I am pretty good usually with dealing with this sort of thing

And I have explained to both catalogues that they will be causing extreme psychological distress

if they continue to hound Me when I am no position to offer anything at present!

 

I have said They can willingly take Me to court As I believe that the court would at least look at the evidence

of My situation and understand My position!

 

Re the Mortgage SMI only kicks in after 13 weeks and only pays interest on 3.63%

as our interest rate is 4.24% there will be a shortfall that we have to make up

and unless We get a positive outcome re PIP That will also be impossible!

 

However I am not going to worry about that as We do have a Mortgage rescue scheme in our local council

that helped a neighbour who could not afford their Mortgage

( they both work but on low wages)

 

So I know we have options there,

 

It just make Me stressed that a Catalogue company can be so completely without sympathy to My situation at present,

 

I will send One more letter as described above and tell them that is My final answer

re the situation at present and see what happens,

Catalogues do not care about you. At all. If they are silly enough to take you to court, the judge would run a fine tough comb over your finances, and award an amount you can pay. Even if its only £1 a month. If youa re in severe hardship, he may even wipe most of the charges/interest, or order you to stop paying completely for a set time so you can get back on your feet.

 

People REALLY need to stop listening to the catalogue companies lies.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..
