    • please refrain from posting blocks of text...use sentences and line spacing .... i notice your 1st post had been spaced and ive done your last three.... this is not facebook....its a forum. ........... it does matter how long BS takes i would cease payments now and a DCA is NOT A BAILIFF. they don't own your debts so can do NOTHING!! slow down and calm down , 4 post in 5 mins is no good. Debt management and Debt self-help - Consumer Action Group click the above link and go read a good 20+ thread in the above forum and all your questions will be answered  if you have any outstanding  then please post with them later. everything is explain in numerous thread already here for you to understand at your own pace. there is not rush to do anything today or the next 10days bar simply stop paying. though as explained in my last post, whichever way you go not pay will equal a default which will trash your credit file for 6yrs so the quicker you stop the quicker they will vanish . dx  
    • The funds were taken by eBay, rather than Paypal.  I presume Paypal collects the funds from eBay, and so eBay then sting me for the money.   But either way, before this money was taken from my account, my eBay account balance showed as -£85.  Yes, my bank account has been debited by this amount. eBay say that they are completely removed from the chargeback process, because it is carried out by the buyer's financial institution.  So, conveniently, they cannot help, other than by refunding the chargeback fee of £14. 
    • Perfect, thanks for the detailed response. One question, do you know how long it takes for the breathing space to get applied? Say for example I have payments due in 4 days and I apply today how does that work? Also, sorry for sounding stupid but what do you mean by default once the breathing space is in place? I mean what does "Default" mean.  After the breathing space is over and I wanted more time, what would happen? I can and will afford the payments after a few months but I just need that breather to sort some stuff out, as I have said I have never missed a payment. Sorry for the many replies but after doing a quick search, correct me if I am wrong. If it then does go into default and it goes to a collection agency am I right in saying they will send many letters and they may consider a claim? and I should only response if an official MoneyClaim is made? Also, If it does go into default does this severely affect my credit score? or will this only be in the case if a CCJ is applied.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I stumbled on this news story,link below, That Bas*ard IDS has really lost it, either that or he knows he has done a lot of damage to peoples lives,that he knows was wrong plus he knows he wouldn't last 2mins without his armed guard, He wont have his armed guard after the tories loose at the next election though, I really hope that he cannot sleep well at nights

If they keep on with this way of thinking there will be outrage before election time, and the like of that person will need to hide in a bunker as his so called hench men and armed plod won't be able to protect him or camerloon, who, if gets his way will order web sites like the one i found this story on ,That interestingly doesn't appear to of made the headlines in our unbiased gutter press,And they would probably also want this site blocked/filtered for being extremist or terrorist too (AKA exposing how dodgy and corrupt governments can sometime be)

They want control and seek to control what we can and cannot see , so

if they don't like what a blogger is writing they want to power to block that from the internet, Well i for one do not want a walled garden for an internet connection ,camerloon can stick his web filtering nonsense (Censorship via the back door) where the sun don't shine

Must have been a security alert or threat made in some shape or form for this to ahppen. Although not a supporter of the politicians or party mentioned , this doesn't seem like normal routine for any meeting. But it does make for easy sensationalism .

 

Well that would be fine If this sort of thing hadn't happened before. There was a peaceful demonstration outside parliament a while back which was against the cuts held by a small crowd consisting mainly of old people and wheelchair users, mixed a with a few young folk, and they were ringed with scary look riot police touting automatic weapons. I wouldn't have believed it If I hadn't seen the photos.

Like the authoress of the narratives it's taken me several days to come to terms with the, in my personal opinion, intimidation and oppression. And if my 'blue' Member of Parliament no longer feels comfortable with walkabouts through a town centre in her own constituency, she's only herself to blame.

An interesting situation; would they have actually opened fire? I doubt it very much for they do not want to create martyrs.

If they get in again in 2015 then this country should be ashamed of themselves. To this day I don't know how a Tory got in in my area. There were loads of Labour, Lib Dem and Independent posters, billboards etcetera up everywhere but just two Tory billboards. Are the Tory voters really that afraid to show open support? I believe so.

I'm sorry Conniff but with respect to your opinion I think that you are confusing the point of this thread. I don't believe that tommy456 wanted to highlight how much guts IDS has, although I would like you to clarify said meaning, as in has he got a large gut due to the taxpayer filling it with 'posh-nosh' or is it because he likes hammering the less fortunate in this country? I don't know, but I've served my country and I now suffer with a disability plus other health conditions. I also hold down a part-time job because I'd rather 'soldier on' than battle ATOS again and probably top myself in the process. So, do you think that those like me, and those less fortunate than me, have less guts than some heartless, taxpayer funded, liar? Even in my current state I'd go a couple of rounds in a cage with him :)

 

Now, what I believe that tommy456 is trying to do is highlight the inhumanity and unfairness of the current government. The sick and poor did not create the current financial state did they! Surely it can't be that bad, after all, a Tory Lord can still claim £300 per day in expenses for doing nothing :) And as we are 'all in it together' I guess that anyone visiting their local food bank should at least see one Tory MP there this Xmas. Oh, don't forget that the vast majority of the benefits bill goes to pensioners, who are exempt from the 'bedroom tax' and Council Tax if not working.

 

Remember that we will be judged by how we treat those less fortunate than ourselves, and everyone is less fortunate than a Tory. Unless you feel that Cameron should build an amphitheatre within which IDS can imitate Commodus by smiting the disabled and poor with a club like some Herculean hero...

Yep, the bulk of the welfare budget is spent on SRP and Pension Credit, plus HB/LHA payments to private landlords. And these people are untouchable, for the most part.

He doesn't care about the sick and disabled.

 

I am beginning to think few people really do.

Even the media only see us as a 'news' story.

If not IDS then someone else would fill his role.

It wasnt labour that caused the recession it was the banks.

Also when labour was in government I never heard the tories complain about too much spending going on so its a bit rich to say spend spend spend then get in government and say oh you spent too much.

The cuts is ideology and nothing else. They make cuts but borrow more which in turn burdens the tax payer with a huge debt to pay back to banks and investors who make a huge amount of money. It is basically a way to pass even more wealth to the richest. MPs from all sides have there noses in the trough. The theatre of westminster is a [problem]. There is no left and right. There is no democracy.

Whaaat ? So that means that the poorest and weakest in this so called democratic society have to be made to suffer more than they already were does it, whilst those making the rules are living the high life without any cares about if they will be able to keep warm and eat a substantial diet this winter,

so much for setting an example Those poor and sick did not put the county into debt, the banks caused a big chunk of it,

Have they been forced to repay what they borrowed as yet ?

 

Then you have a phenomenal amount of money being wasted on trying to censor the internet to name just one thing, Plus this government allegedly have spent nearly as much as the last labour government did ,Then there's the cuts to local government, as a direct result all those who are on benefits now have to pay 20% or more council tax , (something they cannot afford out of benefits like JSA/ESA ) does anyone care? how many will end up going to prison or costing the tax payer more money than if they had ring-fenced it ,

 

One of the reasons the welfare bill is so high is an indirect consequence of economic migrants coming here to work, they may well pay taxes on what they earn, but they aren't spending the majority of their disposable income in the uk ,

so not really helping the economy, and as a direct result of the number of asylum seekers accepted and those who have failed it costs a fortune to keep them in holding centres for months before they are eventually deported ,

only for them to return again within 6mths that cost's as much if not more than all those who are in receipt of sickness related and unemployment benefits,

 

In fact the state pension and the other benefits such as winter fuel payment cold winter payments, that are not only being paid to those who are in impoverished but are also paid to millionaires like peter string-fellow, who coincidently did try to return the winter fuel allowance ,But was told than no such faculty existed in order for him to do so,

 

I unlike you I haven't been brainwashed by this governments rhetoric they keep bleating,

Oh and was the country already in debt with high unemployment figures although thatcher had distorted them when labour came into power after the last conservative government ?
