I've had a magistrate court summons through this morning,

 

Its for non payment of corporation tax, spoke to accountant he says its nothing to worry about, been issued in error he will sort it today.

 

Just wondered though why its magistrates and not small claims, the amount is £1598.

 

Does inland revenue have a different procedure, or could we take banks to magistrates if we wished?

Magistrates court is 'part' of the crown court. This deals with criminal law. As the summons was for a tax it is deamed criminal.

 

What we are doing with the banks is Civil law and is dealt with in the Small Claims or County court.

I don't want to overally panic you, but I would contact the court yourself to make sure it is sorted.

 

Otherwise, if you don't attend - the court could issue a warrant for your arrest not backed for bail.

I would certainly advocate talking to the tax office about this. It's OK if your accountant really has got it all sorted but what if he/she hasn't? It's you that carries the can if not. It happens quite a lot and the responsibility remains yours so better to be safe than sorry as my Mum always says!
