Hi there,

 

I'm very new to this and I'm probs a little late with things...

 

I have an old debt with Orange. Long story short, I've received a letter from Bryan Carter acting for Lowells. They have now issued me with a Claim Form.

 

At first I was a little confused because the debt that I have with orange, I've been paying a totally different debt agency. But looking further in to this, I must have two separate contracts.

 

I can't get a CCJ because I won't get a job that I'm applying for in the new year. So, I rang Bryan Carter up and said is there anything we can do to stop this CCJ. I was told that I could either pay it in full, which I can't afford [£480]. I could return the admision form back to the Court and offer what I could afford, but would have the CCJ against me [which I can't get the job I want]. I could arrange to pay the debt off in three months, but then they said that I could pay it off in six months if I agree to £80 a month, which I have done today.

 

However, I have now since been reading many threads on here where people are stating that Bryan Carter don't always have the correct paperwork if I defend the claim. I was wanting to know how I find out if the orange contract is mine or not.

 

Saying that, I think I've left this too late in the day because in the morning I've to ring up with my first payment of £80 and I've given them my bank details to set up the direct debit for the second payment to come out of my account in January.

Hi Loubie and welcome to CAG

 

 

As you state a little late now you have agreed to settle. The problem with telecom agreements is that they are not covered by the CCA1974...its merely a service contract.

 

 

I think on reflection with your post above the avoidance of the judgment far weighs out gambling on none disclosure of paperwork...
