Hi everyone,


Great to hear the success stories on this site of people being able to get their mis-sold PPI back. Hope I can do the same!


I have just put in a phone call with HSBC/HFC for a loan that I settled in January 2008 (so just within the six-year point after which my information will be deleted). They said they would send out an acknowledgement letter within five days along with a questionnaire which I needed to fill out and send back.


I don't have any of these statements or the loan agreement any more, I chucked them a few years ago, so it's vital that I put the complaint in before my records were deleted. However, as they take 8 weeks to investigate the complaint and make a decision, this 8-week deadline is obviously after the date on which they can delete/shred my records so I am concerned that this will be done before the complaint will be processed!


Can anyone advise on this? Now that I've lodged the complaint are they obliged to keep my records open until it is resolved?

Hi Lee - the Banks are obliged to keep the information for a minimum of 6 years after an account is closed. There is little evidence then any of them are so efficient that they will be shredding your details on the 6th anniversary. I certainly think they will be on extremely dodgy ground with the regulator if they shred anything connected to an ongoing complaint.


When you get the acknowledgement and questionnaire ensure that this is the standard Financial Ombudsman Service (FOS) Questionnaire and not one that they have assembled themselves with an inherent bias that you weren't mi-sold.


I would always recommend that you complete the FOS form downloaded from the FOS site and copy across any reference on the HFC/ HSBC form. I would also ensure you keep a copy. If HFC question you on this, explain that the FOS form is the standard one for PPI claims and it will avoid you filling in an extra form if you have to take the case to FOS

Hi Andy,Thank you for your reply. I've sent the questionnaire back today - it's the FOS one for sure and I've got a copy. Have sent it as Signed For First Class to so I'm sure they're going to get it.I'm going to call them in early January to ensure they've received the questionnaire and it is being processed, do you think this is a good idea?Again, thanks for your help.Lee

if you've sent it signed for you will be able to check that it has been received with Royal Mail. HFC have a duty to respond to the complaint within 8 weeks of your initial complaint to them. You have received an acknowledgement so my own view is that there is no benefit in chasing this until 8 weeks have passed since your initial call.

Success! Had a letter from HSBC today upholding my complaint. £3,300 - which includes PPI from the Personal Loan Plus account I had open before I took out that loan to pay it off. Safe to say Saturday was a grand day! I sent the 28-day payment written confirmation back today so hopefully that goes into my account sooner rather than later. Thanks for your help guys, and good luck to those still locked in battle to get their taken money back!

you trust HFC to get the calcs right?

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

To be fair, no I didn't, but judging from how much the loan was and how long it took to pay off I'm quite sure the amount offered was near the mark.


I'm going to SAR Barclaycard though, I definitely had some PPI on a card years ago.
