    • Hello CAG Team, I'm adding the contents of the claim to this thread, but wanted to open the thread with an urgent question: Do I have to supply a WS for a claim with a court date that states " at the hearing the court will consider allocation and, time permitting, give an early neutral evaluation of the case" ? letter is an N24 General Form of Judgement or Order, if so, then I've messed up again. Court date 25 May 2024 The letter from court does not state (like the other claims I have) that I must provide WS within 28 days.. BUT I have recently received a WS from Link for it! making me think I do need to!??
    • Massive issues from Scottish Power I wonder if someone could advise next steps. Tennant moved out I changed the electric into my name I was out the country at the time so I hadn't been to the flat. During sign up process they tried to hijack my gas supply as well which I made it clear I didn't want duel fuel from them but they still went ahead with it. Phoned them up again. a few days later telling them to make sure they stopped it but they said too late ? had to get my current supplier to cancel it. Paid £50 online to ensure there was money covering standing charges etc eventually got to the flat no power. Phoned Scottish Power 40 minutes to get through they state I have a pay as you go meter and that they had set me up on a credit account so they need to send an engineer out which they will pass my details onto. Phone called from engineer asking questions , found out the float is vacant so not an emergency so I have to speak to Scottish Power again. Spoke with the original person from Scottish Power who admitted a mistake (I had told her it was vacant) and now states that it will take 4 weeks to get an appointment but if I want to raise a complaint they will contact me in 48 hours and it will be looked at quicker. Raised a complaint , complaints emailed me within 24 hours to say it will take 7 days till he speaks with me. All I want is power in the property would I be better switching over to EON who supply the gas surely they could sort it out quicker? One thing is for sure I will never bother with Scottish Power ever again.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have a severely disabled son who cannot talk walk or speak

he also suffers from seizures due to fatigue

 

our neighbour has constantly had a vendetta against us for the last two years

 

subjecting us to loud music

 

doors banging

 

and surround sound on till early hours

 

we are in council property and he is home owner

 

local authorities say there is nothing they can do as he is home owner

 

this man has upset everyone in our village over the years and

 

very few people have anything to do with him and has accused them of being racsist along with ourselves

 

we are most definitely not

 

my sons health has gone down hill fast as has mine as feel really low and alone

 

has anyone got any ideas I do keep a log of what goes on

I don't know what the rules are - but I would suggest that it might be one for the police - if you can get them to tale notice.

Whatever you do, you should start keeping a detailed diary of everything that happens - times, dates etc. Try to get recordings of the noise. If you build up a proper file then you could even consider bringing a small claim for nuisance which could result in modest compensation and maybe an injunction.

Keeping good records is the key to dealing with this kind of thing.

Magistrates can act in cases like this, report the harassment to the police.

 

Keep a diary of events and if possible record excessive noise and/or get witnesses to it.

I have kept diary and have witnesses as my son has a carer come in the morn and eve for an hour to help me get him up and put him to bed she has witnessed the loud music surround sound and drilling into my sons extension wall as I had to get the doctor out who sedated my son to calm him down this is all done at stupid oclock and have had tyres done on vehicle used to transport my son and my mother as she to is in a wheelchair in next village nobody in authority semms to listen or care I feel like im a pest when I ring them he has told people he is sick of us being on benifiets and him keeping us

Make a written complaint to the police even to the chief constable of the county force in writing recorded signed for post.

And of course the Council CAN do something, the Environmental Health Dept can monitor the noise, backed up with your diaries, they may issue a Noise Abatement Notice. If your local council keep insisting they can't do anything, find out who your local councillor is and get them involved.

 

Drilling at night? I'd give him drilling, see how he likes a frontal lobotomy with MY drill. (No, just joking, don't do this!).

would like to thank everyone for advice and support given have been to council and police as he has now taken to the web to spread untrue nasty things about us so printed them off and took them to police they now seem to be taking things more seriously as there is the threat of violence there in black and white for all to see things seem to be moving in the right direction at least will of course let you know what happens still loud music and intimidation tactics going on but am keeping detailed diary and evidence up to date hopefully we will be taken more seriously now

thankyou hope you all have a good xmas to the silly man put comments on police website we have already had benefits office out due to untrue allegations the only good thing was the lady who came out knew the old lady who lived here before us so knew what he had done to her when he drove her out and was very helpful told us not to worry but said the same watch our backs

This type thrives on causing chaos and misery in other people's lives, then sitting back and watching the fall out. Trouble is, when they come across someone they simply cannot affect in anyway, it eats them up and hurts them. So. Other than reporting any little misdeanour to the appropriate authorities in the correct way, this person does not exist.

 

Years ago when I lived at home with mum and nan, we had trouble with a neighbour who took exception to my mum. He used to shout abuse out his windows at us everytime we went out. Nan took great offence at being called things like "a f... ole whore" at 78! So she devised a plan, everytime we were faced with this tirade of abuse we began singing at the tops of our voices "A few of my favourite things". We all knew the words that that one see. Oh did it upset him, and it resulted in tears of laughter for us three. Together we could sing louder than his shouting. In fact, one day he was so upset he was literally hopping up and down like a frog on the front drive! It took him about 3 months but he did stop the abuse in the end. We kept up the singing until nan passed away some years later. I'll never forget her dancing past his window "when the dog bites" "when the bee stings" and the look on his face when he realised she was taking the pee out of him.

 

I expect this person isn't quite right upstairs. Sit tight, sit back, and watch. Hope it all gets resolved very soon for you.
