Not sure whether this the right board (perhaps someone will redirect if not)

 

I've been making payments in accordance with the terms of a court order and the debt will be cleared in 13 years.

 

The (new) DCA says my arrangement is due for review

and wants me to complete income and expenditure together with an outline of my circumstances

and where I expect to be in 12 months!

 

Should I do this?

 

I thought once a court order had been set only the court could vary it

and then only if one side made a suitable application.

 

I recall the CCCS telling me that as an unsecured debt the DCA wasn't

entitled to such info as they are now requesting.

 

Is that correct?

What should I do?

Hello there.

 

The DCA would need to apply to the court for a variation.

 

If you can show that your circumstances have not change it would be unlikely that the variation would be granted.

 

You must continue to pay what was ordered by the court,

 

any deviation to this (even if you pay more) could be seen as a breach of the order.

 

It is standard practice (usually) to send an income & expenditure form

- but since we're talking here about a CCJ where there is already an order to pay via instalments

 

I wouldn't bother sending anything to the DCA.

I take it you mean you had a CCJ against you.

 

If so, then you need to check if the new owner actually has the CCJ transferred into their name.

 

If they havent, then you continue paying the creditor named on the CCJ.

The new DCA can take a running jump.

 

Edit: I take it the new DCA does own the debt right?

 

And simply isnt employed by the owner to chase you.

 

Regardless, the above applies,

 

and if they want the amounts changed,

 

they would have to go through the court to get it changed.

 

If they arent the registered claimant, tough luck to them.
