parked in a restricted street??

Hi all,

 

I can always rely on you guys for advice I'm certain this will be straight forward, but I thought I would ask here just in case. I have recieved a PCN and the reason for this was "Parked in a restricted street during prescribed hours (01)". This was on Friday at 20:46, in Portsmouth. There was a PVC sleeve over the meters and a notice on it stated "NO WAITING BETWEEN 0800AM TO 0500PM MONDAY TO FRIDAY" (I have pictures of it right next to my car). So I assumed I'm safe to park as it was outside those times.

 

Before I challenge it I wanted to ask your advice, although like I said it's probably as simple as stating the facts?

Hi, it was with portsmouth city council and I was parked in a meter Bay Area only the meter was covered with a PVC sleeve with the notice on. So no yellow lines, no

i sound like you where issued a pcn with the wrong contravention code.....can we have a look at the picture you have of the sign where you were parked

The bays are suspended, which means they are not available for parking.

Location please!? Was there a yellow line running through the bay? It may be the parking was suspended during meter hours but there is also a regular yellow line still in force outside those hours?

So even though the bay is stated as no waiting between 0800am to 0500pm Monday to Friday and normally I could have just paid to park within the times I was there if the meter wasn’t covered, I’m still at fault?

It's a bit hard to understand what you are saying. I thought the meter was covered when you parked?

if the bay/space was suspended,from what you are saying and by what the pictures indicate, then, with you being parked there you should have had a PCN for contravention 21, Parked wholly or partly in a suspended bay or space and not for contravention 01.

ah no problem, I was parked on Exchange Road, Portsmouth (Right next to the guild hall) about half way down the western side of the road.

 

Jamberson, the meter was covered when I parked yes

As I suggested there is a yellow line running through the bay with a restriction on parking 6pm to 7am which covers hours outside the meter suspension

If its still within the 14 days you have nothing to lose trying an informal appeal on the grounds the signage is misleading.
