      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

 

In september i got myself in a position where i applied for a loan with Quick Quid.

 

The loan was approved but the funds never appeared in my account.

 

When i queried this they told me i had put an extra digit into my account number online.

 

to cut a long story short

i never received the money after chasing numerous times i got fed up.

 

Got past the rough patch with money and forgot all about it.

 

Now they are chasing me for payment.

 

I have spoken with a manager in resolutions department today and he confirmed that the money won't have been funded to my account

but i might still be liable for it?????

 

Is this legally correct??

 

i explained that all the details i gave were verified over the phone to an operator etc.

 

i thought best to start e-mailing them regarding this.

 

Below is what i sent them today.

 

Walter,

 

Just confirm the conversation we had on the 04/12/2013 at 21:00 in regard to account number xxxxxxxx

 

1. I explained to you from my perspective what the process had been start (Point of application) to where we currently stand.

 

2. You confirmed to me that there had been an error made when inputting the account number for my respective banking provider.

I confirmed that this appeared to be the case

however i pointed out that the process of confirming details by a Quick Quid representative had not picked this error up.

 

3. You confirmed that the account was being put on hold with immediate effect

and that you would be tracing the funds to confirm exactly where they had gone.

 

I have re-iterrated that they were never received by myself and am happy to provide bank statements to confirm this.

 

4. You advised me that i may be liable for the loan amount even though the funds had potentially not reached my account.

I advised you that if this was the case i would seek legal advice as i do not beleive this is a fair

and just course of action nor is it a legal course of action.

 

5. You confirmed to me that you would be personally handling this case

and would contact me on Friday to discuss the findings of your initial investigations.

 

6. I advised i would be able to take a call from you on Friday evening but that i would also like correspondence via e-mail

now to ensure sufficient information is available to both parties as at present only Quick Quid have a record of correspondence.

 

To pre-advise you i will now be following every phone call with an e-mail detailing what i believe to be the main bullet points of the conversation.

I would appreciate confirmation back via e-mail that this is correct

and a true reflection of the conversation had.

If no response is received within

 

48 hours of the e-mail being sent

i will take this as acceptance that it is a true reflection of the conversation.

 

I look forward to your response and will update via e-mail as and when i have further information to add to this case.

ignore them.

 

I bet THEY made the mistake and they are trying to chase you for it.

All you have to do is send a prove it letter.

If they dont have any evidence it went into your bank,

then tough luck to them.

 

Plus an extra number on the end?

 

I thought all UK account numbers were 8 digits?

 

The problem you had was that you called them.

Ask them to put it in writing and i bet you they wont.

 

From now on do NOT use the phone at all to them.

If you have to, make sure you record the call in full.

Otherwise dont bother.

You need to put in a compliant in writing by recorded delivery, just in case it drags on for ages and some DCA starts threatening court. It is always easier to deal with these matters, as soon as you can. Ask QQ for a copy of their compliants procedure and follow it through.

 

Check your credit record as well.

 

You should remove the account number from your post, as you should never put info which could identify you.

 

Not all accounts have 8 numbers. I think one bank has 7 digits and there is one that shows 9 digits on a cheque book, but you ignore one of them. Can't remember which banks have these differences.

regardless, the OP never received the money so they arent liable. QQ has already admitted the OP didnt get the funds, but because they know they cant chase the other account owner, then they are going to try and chase the OP instead.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

QQ cannot do ANYTHING but sell the debt on. They reside in america and not the UK. The only office they have over here is a mail redirection box. I cant remember a single case where they did anything but harass and sell it on.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Thanks for the comments. I did think that this would be the case but when you are getting final demand letters etc difficult not to contact them.

 

Check your credit record. Registering a complaint is useful, as you can evidence that you have told them of the problem and they should deal with it.

 

You will regret it, if you do nothing. Always better to get matters sorted, rather than continue to be hassled for years.

If you don't get anywhere with a complaint to QQ, then you should escalate it to the Financial Ombudsman.

Agree. If QQ don't respond to a complaint letter within 8 weeks, you are entitled to pass on the complaint to the FOS. I would suggest that you do so if needed, so you have evidence of having tried to resolve using the means available to you.

It's not really clear who made the error, was it you who gave them the wrong digit or them misunderstood and wrote down the wrong digit ?

 

All bank account numbers are divisible by 11 (if my memory is correct). Therefore, if you get one digit wrong, it is unlikely that the money would have gone into someone elses account. It is more likely that the account number was incorrect and the bank who received the credit bounced it back to QQ.

 

From my experience, when credits manage to go into the wrong account, it happens more often when the wrong sortcode is entered.

 

There is also the issue of Money Laundering checks required of QQ. What checks are required of QQ to ensure that the bank account details provided by the loan applicant belong to them ? I would have thought that QQ would have had to check the validity of the account details.
