      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Evening all,

 

Don't know if this is posted in the right section, but here goes.

 

I haven't acknowledged / made payments to any of my debts ( unsecured ) since Sept/Oct 2007.

 

I am not on the voters roll and have not been since I left my house in Sept 2007.

 

My father has just rang me to say that their is a letter for me ( 1st letter in 2/3 years to his address), which I asked him to open.

 

Its from Lowell Portfolio to inform me that HSBC and HFC have sold my bank accounts to them.

 

I am assuming that these debts are ( or very very near ) statue barred, but from what I understand they cant be SB if a CCJ was registered somewhere along the way.

 

Is there any way I can check for CCJ's against me without setting off alarm bells?

 

Also whats the best way to get confirmation that these debts/other debts are now SB?

Trust online is i think what you need. You can enter old addresses. As they are current accounts it is mire difficult to give an exact date as to when they become statute barred. I think it will be 6 years from when the bank made a formal demand for payment if that was after your past payment

Any opinion I give is from personal experience .

Check your credit files and any CCJ's should flag up on them.

So I could use trust online ( say with my dads address / address in 2007 ) and it wont show up on my credit file/against my name?

 

I have let sleeping dogs lie for the last 6 years and I know from January 2008 for DEFINATE that I didn't acknowledge any debts or make any payments to ANYONE.

 

Will Lowell send debt collectors to my dads address, or will they just keep sending letters?

 

HSBC = £800 , HFC = £2500

 

Any help appreciated.

It makes no odds what you check, be it credit files or otherwise, the only person who will know you've checked is you.

 

DCA's would like us all to think checking your CRF's flag up activity but as usual, this is all BS.

 

DCA's ar NOT bailiffs.

They have NO legal powers whatsoever.

 

If the debt is SB then once you have confirmed this, you can send them the SB letter and they will go away!

Yes fletch is right Trust Online, each search will cost you £4, it is worth keeping an eye on the register if you have some debts and have moved around Lowell and other DCA's will try to sneak in the occasional CCJ in by posting court papers to an old address, Lowell once tried to contact me at an address I left 12 years ago.

I thought if you did a CRA that it would log the address that you searched,

but I don't suppose that matters as there is someone else living in 1 address,

and my father in the other.

 

Just worried that if I did a CRA and used my dads address that they would assume I am living there and knock the door.

Thanks alienskumn - Lol, I am from Swansea too! - I might just wait till January 2014 to do any search, any where as I know it will def by SB from them ( assuming they didn't register CCJ's for them all!!!)

A debt DOES NOT follow an address, there is NO such thing as a blacklist.

 

A debt follows the individual, not the address.

 

Any unsolicited stranger knocking the door can be treated the same as a gypsy selling wooden pegs.

 

Hiding won't do anything except exacerbate the problem.

Hit them head on, as Lowlifes are quite litigious of late and will issue a summons if they think they can get away with it.

 

Like I say, checking credit files or the CCJ register DOES NOT alert anyone, as ONLY you will see that you have checked your files.

 

Debt Collection Agencies are NOT bailiffs, they have NO legal powers.

Ok so it necessary its blagging time.

 

Have a look at trustonline although you do have to pay.

 

If the last known address was your dads and you have not had papers through you are probably ok.

 

Of course there is nothing stopping someone returning the letters with not at this address all over them.

 

If they do find you i have a nice little letter that confuses the poor dears.

 

If i remember i will try to post it tomorrow

BB the issue would be that by doing a credit file check they verify your identity and current address. Hence the op would be traceable. I personally know of someone this happened to

 

Again, the debt is tied to the individual and NOT the address.

The issue is that Lowlifes have already found the OP so he needs to check his credit files to see what is on them, otherwise it's back to ostrich fever whereby lowlifes will obtain a CCJ by default and all that entails.

 

Check your credit files with the correct details so you are then suitably informed and can either put this to bed once and for all, or fight them off.

Simply checking your credit file DOES NOT mean that DCA's etc will know.

 

Lowlifes have already been looking at your file and have sent you a begging letter, you are not going to do any harm in checking your own files.

If you don't and they obtain a CCJ by default then you will wish you had checked them, as if the debt is SB, then you will know this by the absence of it being on your credit file, thus you are able to tell them it is SB and to have a nice day.

 

You ARE already traceable.

They HAVE already traced you.

 

By checking your credit file, it WILL NOT show them.

No NO No!

 

PAY NOTHING!

 

Just check your credit file.

And the reason why the letter went to the OP's fathers address, is because that is the address that is on the OP's credit file.

Something so simple as checking your file, should not be this hard.

What does it matter if they can?

I am assuming that you have a mobile phone and a bank account?

If so then you're traceable.

GOT IT!!!! - But I will use just my dads / debt address as since 2007 I have been offline/ not registered since 2007, no CRC, no tenancy check, no bank account, no voters roll etc etc
