Please dont judge,

i honestly feel so sick, i cant sleep, and i cant eat. I need help asap.

 

I have a partner, who doesnt live with me, due to the fact hes getting help for anger problems, and tbh we cant afford to live together. He stays on his mates sofa 3-4times a week and then at mine the rest. Obv he leaves for work and comes home when hes staying here.

 

He pays £100 to my landlord for the extra hb doesnt cover, which helps alot else i would be in debt.

He doesnt pay any other bills,apart from halfs on sky internet, which he uses when he stays.

 

we have two children together, he has never "lived"with me, apart from when we lived at my mum n dads for a year, but he had his own room, and paid rent.

 

I have a feeling i know who has "grassed" on me, a women we had a kind of thing with a year ago. OH ended up cheating on me with her. I finished, He realised what he did, so stopped it with her and came back to me. She was jealous, and said some very hurtful things, and did hurtful things.

 

Anyway, heres the awkward bit. Were engaged. He proposed last year. weve set a date for July 13th, and have gave notice of the marriage. So i dont know if there going to believe were not living together, even though we have two children and are "getting married". Although the wedding is on hold until he sorts his anger out. He has until Jan.

 

I feel sick everyday, I have postnatal depression, which is all time high, So feel like breakingdown all the time.

 

Forgot to add, he did stay with me for a few weeks this year, As my depression got so bad that i couldnt even get out of bed. [my mum passed away two years ago].

 

WHAT evidence could they have on me? I know all his bills ect does get sent to the house.

 

what am i going to do? i cant live without my own money, i feel sick and worried

Have you seen your local CAB? They've helped people here and have contacts with local specialised lawyers.

(((Mummy))) I don't judge. However in the eyes of the DWP you have been living as a couple even though he hasn't lived there full time. he has stayed there (they don't even need that to exist to prove you are a couple) has helped you financially and does contribute to bills and you are emotionally a couple. I think accepting that in the eyes of the DWp you are and have been a couple is an important realisation. But you can move on from here and you will get through this.

 

If at all possible you need a solicitor who specialises in benefit cases. If you can't afford one and are not eligible for legal aid then I would go to the Citizens Advice Bureau as soon as you can and gain their support and advice. Take someone with you to the IUC. Tell them you did not realise what you were doing was wrong.

 

You have two young children and that will go in your favour. A very close friend of mine was in a similar position to you (except her xh never stayed overnight with her and they weren't a couple at all however he paid one bill and came to the house to help with the children most days as she has severe psychosis) and the end result is she now has to pay back the money she claimed at an affordable rate. No court action despite the total being £34,000. So don't panic, but do get support.

Not judging, I understand how difficult situations sometimes lead to less than acceptable solutions when desperate.

 

When you say 'gave notice of marriage' what do you mean?

The reason I ask is I had a client who had applied at the registry office for something to do with the inpending marriage, and this triggered an IUC for living together, because the address they used for the application was hers.

even though we break up every two weeks? I really dont want to be seen as a proper "couple" as like i said we are more apart then together.

 

I hate the idea of losing my money and having to rely on him, as he cant even look after himself atm which is why hes on a mates sofa.

 

I rang the JCP up the other day to change appointment, and they have said ic an bring my toddler with me as i have no childcare. He seemed lovely on the phone, but now im worried. I have nothing to hide, other then the fact i do have a partner but he doesnt live with me. hes not on rent book ect. I dont want him to have to move in just because of this.

I pay all the other bills. this seems very unfair :(

 

and the give notice was at the council office to sign for the registar, he couldnt put his mates address down as he wouldnt be able to marry as hes not in the catchment area. x

well if/when we was married id of told them and stopped my benefits. I have a three year old with development delays, i cant afford to work atm which is another reason were not living together. So if i didnt mention to them he pays for sky, what would they say then?

 

im really worried and panicking :(

Where does his mail go? Where is he registered for doctors and dentists?

Has he taken any loans out from your address?

Where is his car registered to for insurance? What address does he give for work?

All question they will ask and will know the answers to...

 

They would know he pays for sky they have access to your credit files...

 

Even though you are not living together as such, they will ask about the above.

Does he pay rent to his friend? Has he a rent agrrement?

If so this will help your case.

It must be hard for you at the moment :(, are you taking anyone with you to the interview?

his mail comes here, hes reg at drs to here but never goes, isnt reg to dentist.

 

 

i will admit... i have applied for loans/online shopping stuff in his name. when iw as really bad with pnd, i used his details and mine to try and open ones. even though he has no idea.

 

so im going to prison then, and my money going to be stopped is the answer.

No no you are not going to prison. Far from it.

Does he know about the loans, you will have to tell him.

I honestly think you could do with speaking to CAB or Welfare Rights, they can help you

I think on what you have said they may well do a living together on your claim after the interview.

It would be up to a decision maker to decide what will happen with your claim.

Someone came out two years ago, and i told them then that he comes and stays, but doesnt live here. they were happy with this. I told the man on the phone about this and he said that this is the same sort of thing, and that he just wants to ask some questions, and the only reason its there is because of recorded.

 

im so stressed i could cry. i havent even been able to tell my dad because im so ashamed.

i have noone to take with me, i have to get there on the bus, and i have to take my two year old son with me.

he pays rent but no writen agreement x

I think I would ring and get the interview delayed and try to seek some help..

CAB or similar

Please stop worrying you will be ok, all you can do is be honest with them.

They are ok they are just doing their job

I think you are going to have to tell him about the loans

And you need to tell your dad.

Get his friend to write a statement about him staying there

Is he seeking help for his temper?

If so can you get something to support this, you can explain this is why he doesnt live with you full time yet

and he wont until he gets himself sorted

When is the interview?

CAB can off er advice and may be able to recommend a solicitor, you may be entitled to legal aid

Also

You can also get help over the phone. Community Legal Advice is a free and confidential advice service paid for by legal aid. If you live on a low income or benefits they can give you free advice and help you to prepare for your interview over the telephone. You can contact them on 0845 345 4 345.

maybe ring these tomorrow, you are on I.S its a means tested benefit

This is what has triggered the investigation.

If you need a solicitor for an IUC and your only income is benefits you do not pay for the solicitor so I would advise you to get one. My son had an IUC a few months ago for different reasons to yourself he had to pay as he works but he was told by two solicitors that we contacted that anyone who has no other income definatley does not pay for the solicitors time.
