Severn Trent got a ccj against my hubby and it was for two properties ( one ccj though) we didn't query the amount at the time, it's paid by AoE, we the received a letter from Debeo debt collectors wanting 75.00, phoned severn Trent to find out that it was for 1st property and was given the dates related to it.

 

That's the problem we had left the property on the dates in question so we sent in the council tax final bill and severn Trent recalculated the outstanding bill (ccj one) so instead of it being nearly 2000 pounds it came in at 1200 and ssomething.

As the original amount is wrong for the ccj how do we get that set aside?

Also the 1st property amount was placed within the ccj but has now been taken of the bill as we weren't living there.

Some amount has been outstanding so we were paying 5 Aweek of of that and also paying through partners wages as AoE we have now been threatened with court for non payment but it's in the ccj because severn Trent haven't informed the courts the ccj amount was wrong in the 1st place

Hi Leigh - how was the judgment obtained? by default? admission?

 

Write to Severn Trent explaining in clear terms what has happened and how/when they have agreed the lesser amount to be payable.

 

Explain that they need to inform the court to amend the amount of the judgment. Give them 14 days to respond and explain if they failed to reply, you will be making an application to the court for:

 

1. The amount of the CCJ to be varied;

 

2. The terms of the AoE to be varied;

 

3. The costs of making the application.

 

Give them 14 days to respond.

 

I think this would be a good starting point.
