Ok, after my panic I phoned the Court this morning who said that it was not necessary for me to send them any paperwork at all (unless I didn't intend on attending the hearing, which I do as they have changed the date to after my holiday). All I had to do was turn up on the given day and that is it...

So the Court hearing is now for 17th May, but I go on holiday on 5th - 16th. This doesn't leave much time for any correspondence with barclays, so I was thinking of calling them about Tuesday next week, informing them that I will not be in the country to respond to them, and to ask if they wish to settle now rather than turn up in Court?

What does everyone think? Is that a good idea?

you could try or you could go on holiday and forget about em and when you get back turn up in court next day , get a judgement against em and send in the bailiffs.

Ha ha! I'd love to do that but I don't think my nerves can take much more. I'll update my schedule of charges and give them a call on Tuesday or Wednesday as encouragement to settle the case asap!

Going to have a look through some threads to see what actually happens at a Small Claims Hearing and see what I'll need to prepare, just in case Barclays don't want to play beforehand!

I received a letter from the Mercantile Court confirming the 17th as the new court date and today, on the off chance phoned Barclays Litigation Dept to ask if they would like to settle. Adrian Ruffhead wasn't around to take the call so I asked of anyone else could help. This guy came on who said that they have been informed of the new court date too.

I asked of they would like to settle but they said no, there was no reason for why they would want to settle, so basically see me in court on the 17th!

This surprised me to be honest, because tomorrow is the last date we will be able to settle without going to court, as we get back late on the 16th, and then have to attend court on the 17th.

Maybe I should try and phone again tomorrow and see if I can get through to the Ruffhead man himself.....

Not feeling too great about it all now.

Think I'll look through the threads to actually see what is going to happen in Court at the Small Claims Hearing, what I'll need to take and what the hell to say!

BARCLAYS settled in full 2 days before the court date! They phoned me on holiday to see why I hadn't replied to their offer letter which was sent the day after I went away! The whole thing was sorted within minutes.

What a relief, so for all my worrying I didn't have to go to court this morning, and my bank account looks very healthy!

Thanks everyone for their help on this site, I wouldn't have known where to start without it. Donation on it's way.

Also could a Mod please move this to the WON cases place please?!

just interested, as i have just had a settlement from RBS for the exact amount i calimed for £557.63 - even down to the 63p!!!

08/02/07-Prelim letter & SOC sent to Barclays

22/02/07-LBA & updated SOC sent to Barclays

23/02/07-Prelim letter and SOC sent to RBS

05/03/07-Offer letter recd from RBS - full settlement, no conditions. Accepted

08/03/07-Paid in full from RBS:D

12/03/07-Offer from Barclays - less than 1/3 of the full amount, rejection letter sent with updated SOC:mad:

26/03/07-Claim #2 against RBS...Prelim letter and SOC sent (same account, more charges since settling last claim!)

18/05/07- recfd offer from RBS for full amount claimed, accepted!

25/0507-recd offer from barclays for full amount!!!! yippee!!! acceptance sent

26/0507-recd letter from barclays saying that they have closed my account???? help!?

Congratulations to you too!

My claim started off being £495 but with the court fees and interest the total was £695.77. It should have been a few quid more than that because of the daily rate of interest, but as I was on holiday and didn't take any of the information with me, I knew it was around that much so took it! Very glad I did too.

I just hope I don't have to go through this again!!
