I used to have a credit card with Vanguis,

and for two and a half years have had all kinds of problems with them.

 

In 2011 my income dried up as a result of government cuts which removed my workstream.

I was unable to pay Vanguis as a result;

prior to this I had paid my balance in full or near enough every month.

 

I started to receive telephone calls from them up to 10 times each day,

and each time they called they demanded money on the spot.

 

The sums varied and every time they called I had to explain my circumstances afresh.

Their staff were in general abusive and unco-operative. This continued for well over a year.

 

Despite my paying PPI to the firm every month,

they delayed sending me the forms to claim for several months.

 

When I finally received them I returned them,

and discussed the case with them over the telephone

at which point I was assured that there was no problem with them.

 

I then heard nothing for approximately three months and the telephone calls continued.

 

One afternoon I received a call from them and I mentioned this policy;

they told me that I could not claim under it as I was not eligible to claim,

and their representative atempted to intimidate me.

 

During a heated conversation with them I began to suffer severe chest pains which continued after the call ended.

I called my GP and was seen shortly afterwards.

For two to three weeks afterwards my left arm was numb and I suffered 'pins and needles'..

. the classic symptoms of a stroke.

 

I logged the calls from this firm over a sample period

and they were being received at a rate of six to ten per day.

I estimate that I have received over two thousand calls or attempts to call me from them.

 

In 2011 I reported them to the Ombudsman Service, who sought 'permission' from Vanguis to pursue the case;

needless to say such permission was not forthcoming.

 

After my stroke in 2012 I complained again to the Ombudsman

who rejected my complaint on the grounds that Vanguis disallowed it as my response was 'out of time',

despite my having received no correspondence from them to respond to.

 

Finally, the Ombudsman agreed to look at it again.

By this time the telephone calls had stopped,

yet Vanguis continued to charge me increasing sums every month for their Repayment Option Plan

despite them plainly having no intention of honouring it.

 

In summer 2013 the telephone calls began again,

and somehow they managed to get hold of my father's telephone number and began to call him.

His telephone account is in his name, he lives nowhere near me, he is a war veteran of 87 and in poor health.

 

While visiting him, I learned that they had been calling him;

he was distressed by the calls and harrassment from Vanguis,

and the stress it caused him led to him being admitted to hospital where he remains.

 

Vangius has damaged the health of two people; myself and my father.

I have been informed by that I have absolutely no legal right of redress against them for the actions

they have taken against me.

I have sought additional advice and help and none has been forthcoming.

Requests I have made for help have not been answered.

 

In Britain in 2013 outfits like Vanguis act with impunity the authorities appear to have no powers over them.

Complaints are ignored or casually dismissed and we, the victims of their greed, suffer. The Ombudsman is no help.

have a read of the Harrison V MBNA case

 

theres no reason why you could not take then to court the same.

 

as for the ROP.

get it reclaimed.

 

they'll owe you £1000's.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Are they still calling you in this manner ?

 

There is a letter in the CAG library and also a recent judgment "Roberts v HBoS" which will give you some idea, that there is indeed something you can do about this. Another thing to do is call them from a payfone and update your numbers this way the calls stop, it worked for me, been there done that got the tee shirt, dx100uk is right, get the claim in they will not repay most but some, cancel the ROP if they refuse get it in writing, now stay off of the phone and don't go through security, check out my posts about Vanquis, with help here it will end one day but it will get worse if you don't update those numbers straight away.

 

 

Send them the harassment letter then make sure you send it recorded delivery to them, keep a log of all calls received from the at both numbers, the more you state that its beyond a joke then they will have a much harder time in court defending it.

I have asked them verbally to desist from calling me several times now, and complained in writing to the Ombudsman about their calls. I have also reported them to the police for the calls, and yet the bcalls continue. They now use a **** outfit called MacKenzie Hall to call me and this outfit calls me several times each week.

 

I'm not interested in sending them any letters asking them to desist from calling me. I now want to sue them... but I do not know how to go about this.

You need to send them a cease and desist letter! Otherwise it'll just spiral out of control and they will believe they can walk all over you.

I have one in draft form to send to them this week. I loathe and despise Vanguis more than I can say after what they have done to me and to my family.

 

I also have nothing but contempt for the Ombudsman service, which is biased in favour of these ****, and it is also racist in the way it handles these cases.

Here's an update. On Monday I sent off a Cease and Desist letter by recorded delivery, instructing them and their agents not to call me again..

On Wednesday I received an attempted call from MacKenzie Hall and this morning one of them actually telephoned me using a number I am not familiar with.

 

Evidently these people have no intention of complying with my requests and have now left themselves open to prosecution.

Can someone help me and tell me what area of the law covers telephone harrassment with regard to an alleged debt?

 

I wish to investigate the possibility of suing Vanguis and/or their associated companies for the telephone harrassment both my father and I have been subjected to over a long period of time.

 

All advice and suggestions warmly welcomed.

If you wish to make a claim against them for harassment it would be in the civil court (small claims). Have a look at the two cases mention, Harrison v Link http://www.bailii.org/ew/cases/EWHC/Mercantile/2011/B3.html

Before starting any claim i would think about talking to a solicitor who specialises in such cases. You should be able to find one that gives a free initial consultation

 

You have accused the Fos of being racist, dare i ask what makes you say that? If true then I would contact your MP as well as the chief ombudsman who is I think Natalie Ceeney
