    • OK, so I've rather unfairly picked up a CCJ from a business overdraft debt that's been going on for years. I had court claim forms in 2014 which I managed to stave off. and again in sept 2016. This time I've acknowledged the service, filling in what I thought was the correct amount I thought I owed. I've since had the personal guarantee paper copies in my possession and I owe £21K. I sent them back along with a new address for all correspondence to be sent to, and then agreed to a Tomlin order to pay debt off monthly.  Now, these were sent back and forth and eventually signed, but apparently only partially. So DD was set up at same time, in Jan 2017. over next couple of months we paid, and also go letters to sign new Tomlin which we ignored as it was signed. In March we got another TO with 7 days to sign it and send back. We had one day to get this to them and phoned to say it wouldn't be there, that's ok they said, well extend it, just keep paying and send it back asap, we did send recorded (since lost receipt). We assumed they'd got it, and didn't hear a peep from them. Until July 18, when I found id got a CCJ from Feb that year. I've logged a complaint with solicitor, and had a response, they are denying any knowledge of anything. They had no TO so took it to court without my knowledge.  I didn't think there was anything I can do. However, as it turns out, the court sent papers to an old address even though solicitor had new address for 13 months, and address for correspondence was on the claim papers I sent back. Upon closer inspection the numbers are all wrong too, nor a lot but its about £200 adrift. We called their office too within the 30 day notice period, oddly they have no record of that.  And all this is on a "Business Charge Card Guarantee" …. anyone explain that?? In the mean time we've paid £5K+ of the debt off. At no point did anyone in the process let us know we'd had the CCJ logged against us. Is that right?? Or legal? I was intending to get it set side, but was told by them it was pointless. Just want to get back to point A. Paying it isn't the problem, it getting the CCJ reset. Please Help!!!
    • same with jaguar s-types etc. all kind of weird issues if the battery is on the way out or the terminals/earth straps are not reconnected tightely/properly.   mine was the earthing strap to the gearbox, was rotted and got knocked during the gearbox oil change.
    • what have they got that they can respond too that counters your SB defence? zilch.   as with every erudio claimform or PAPLOC thread on CAG you solely got the claim because for whatever reason , to that date, everything was ignored.   once a response is made they go away.   default CCJ avoided. you must read up and understand how arrows [erudio!!] operate
    • so won by a section 75 claim under the consumer credit act then   consequential losses are also covered by section 75 as the card provide is equally liable as you've already found out   as for the dealer and court there is no time limit, well 6yrs I believe   though it would be a tough battle but made slightly easier as BC coughed up. but again what would you in all reality 'win' probably go bust or change name
    • It was settled by Barclaycard because I bought the car using my VISA credit card. Do you know if there is a time limit for taking the company to court to claim the consequential expenses incurred?

I'm sure many of the candidates families, particularly those with young children, look forward to having mummy or daddy home more once things settle down - whenever that might be!

who????

A Scottish solicitor at the Govan Law Centre and absolutely tireless campaigner who, amongst other many other things is part of the FCA.

He is also staunch Scottish Labour and strongly opposed the independence vote in Scotland.

I don't generally have much time for the legal profession but Mike uses his talents to help people.

Termi has linked to wiki but there's not much on there for some reason.

I am going to vote later on today, I've never voted Conservative or Labour and the local Lib Dems are killing the town, so I will vote either to save a local hospital (which I did last time) or something else - and it won't be the Green party either - I don't believe their policies are 'consumer friendly' and have cost a lot of money.

They should make voting compulsory but have a box for "none of the above" and then you might well see some decent candidates

I thought LOL meant Lots of Love:lol:

Wonder if the cons will build affordable rented property or just let the private renting get out of control.

Wonder if they will keep the bedroom tax.

Wonder what the cuts will be in benefits.

Yes we will start to see lots of con policies now and I understand it will be speedy so it won't be long before the people know whether they agree with it or not. I believe they will want to weaken the unions, they have a gripe with the BBC well it's not privatised is it and they're not in the cons pockets like lots of the media. A channel with the fear of adverts! It's the 80's again with Marge reincarnate Anna Soubry, same hair same voice. There's no free shares in Lloyds as far a I know, i'm being facetious, will hear about that sale soon.

Looks like the 85 people who own 75% of the world's wealth were bidding on a Picasso last nite.

It is a real eye opener when you see a painting being sold for $179 million, when there are thousand dying in the mediteranean sea trying to migrate to Europe for a better life. Also in Asia, there are about 8,000 migrants at sea trying to get to Malaysia, fed up with the poor conditions in Bangladesh and Burma.

I am not a fan of right wing economics which seems to be about worshiping wealth and hoping for some trickle down effect to everyone else. When you have so much money in so few hands, the world is going to become very unstable and there will be another major economic collapse. In the EU, Greece will default on debt by the Summer and you could see Italy struggle later in the year. Would not surprise me if the Tories were recommending to come out of the EU by the time of any referendum.

So we are all part of a pyramid scheme, where only a few will get the money ! Sounds about right.

What I do not understand is a financial system that has broken and is now being supported by governments who I thought were capitalists. The cost of the Bank bailouts, providing help to buy schemes and quantative easing etc. Does not make any sense to me. It is not just a UK issue, but it is now worldwide. Australia is now struggling with debt and they have a huge mining industry. But when China starts to slow down, in the new world we are in, then it affects the world. The US is no longer as dominant as it was and globalisation has led to a more fragile world.

Go back 10 years ago and listen to Gordon Brown and other talking about globalisation, as if it was going to lead to prosperity for a lot more people. That is only ever going to be the case, if they expand the world money supply and to increase the pace of development. The world has to adapt to the rising human population and the demands that come from it. If you don't meet those demands in many countries, then you will see a lot of migration and it is very difficult to deal with. You will also see a lot of conflict, as we are seeing now, with rebels/terrorists taking over parts of countries.

The secret bankers, pharmaceuticals, we all know profit before people. The financial gurus investing so much money over time in them i.e pensions. You get a hand in glove situation. It seems they want $36 bil which is to be raised globally, to get interested in producing more efficient antibiotics. Personally, it seems to me their whole business needs a good overhaul as questions need to asked if drugs are being held back and is mankind being compromised by them. IMO there's plenty of private money which can pay them, people don't want to hear it's a UK tax responsibility. UK want China to take a lead roll at the meet up next year. Interesting, the news says £1 bil, wonder if that's the amount the UK is expected to raise. I expect this will all become more clear during the day. Panorama covering this next Mon.

It can take a long time to produce new drugs and they may have some in development, but they have to go through trials, before they can be licenced for use.

I think that plant Earth naturally controls some things and population is probably one of them. Scientists are always trying to stay one step ahead of bacteria and they sometimes don't keep up.

Did the manufacturer have a factory in the UK about 15 years ago ? Some companies set up factories in the 90's/early 2000's in places like south Wales. The government have them grants. That when countries like Slovakia joined the EU, some of these companies moved their production to where they could obtain better grants. The EU helped new members attract companies, even if it meant factories/jobs moving from one EU country to another.
