    • There's a thread somewhere about someone sending the baillifs against Wizzair that is quite hilarious. I would love to see someone do the same to Ryanair. Question is, should you be the one to take that role. You are entitled to the £220, if your flight was from the UK. If it was TO the UK I suppose it is more of a grey area... though the airlines I know have been using £220 as standard. Not that surprising for Ryanair, the worst cheapskates in the universe, to go for the lower amount, and if you forward this to the CEO he will probably have a jolly good laugh and give his accountants a verbal bonus. After all he's the one who said and I paraphrase "F*** our customers, they'll fly with us again anyway". While we would all love to see Ryanair get wooped in court again, I have to join my fellow posters in thinking it's not worth the hassle for (hypothetically) £7 and not sure it will expedite the payment either. It's already an achievement that you got them to accept to pay.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'm sure many of the candidates families, particularly those with young children, look forward to having mummy or daddy home more once things settle down - whenever that might be!

I am going to vote later on today, I've never voted Conservative or Labour and the local Lib Dems are killing the town, so I will vote either to save a local hospital (which I did last time) or something else - and it won't be the Green party either - I don't believe their policies are 'consumer friendly' and have cost a lot of money.

I thought LOL meant Lots of Love:lol:

Wonder if the cons will build affordable rented property or just let the private renting get out of control.

Wonder if they will keep the bedroom tax.

Wonder what the cuts will be in benefits.

Yes we will start to see lots of con policies now and I understand it will be speedy so it won't be long before the people know whether they agree with it or not. I believe they will want to weaken the unions, they have a gripe with the BBC well it's not privatised is it and they're not in the cons pockets like lots of the media. A channel with the fear of adverts! It's the 80's again with Marge reincarnate Anna Soubry, same hair same voice. There's no free shares in Lloyds as far a I know, i'm being facetious, will hear about that sale soon.

Looks like the 85 people who own 75% of the world's wealth were bidding on a Picasso last nite.

It is a real eye opener when you see a painting being sold for $179 million, when there are thousand dying in the mediteranean sea trying to migrate to Europe for a better life. Also in Asia, there are about 8,000 migrants at sea trying to get to Malaysia, fed up with the poor conditions in Bangladesh and Burma.

I am not a fan of right wing economics which seems to be about worshiping wealth and hoping for some trickle down effect to everyone else. When you have so much money in so few hands, the world is going to become very unstable and there will be another major economic collapse. In the EU, Greece will default on debt by the Summer and you could see Italy struggle later in the year. Would not surprise me if the Tories were recommending to come out of the EU by the time of any referendum.

The way I see it is we are all at different levels of the pyramid. Building the pyramid keeps us all busy.

So we are all part of a pyramid scheme, where only a few will get the money ! Sounds about right.

What I do not understand is a financial system that has broken and is now being supported by governments who I thought were capitalists. The cost of the Bank bailouts, providing help to buy schemes and quantative easing etc. Does not make any sense to me. It is not just a UK issue, but it is now worldwide. Australia is now struggling with debt and they have a huge mining industry. But when China starts to slow down, in the new world we are in, then it affects the world. The US is no longer as dominant as it was and globalisation has led to a more fragile world.

Go back 10 years ago and listen to Gordon Brown and other talking about globalisation, as if it was going to lead to prosperity for a lot more people. That is only ever going to be the case, if they expand the world money supply and to increase the pace of development. The world has to adapt to the rising human population and the demands that come from it. If you don't meet those demands in many countries, then you will see a lot of migration and it is very difficult to deal with. You will also see a lot of conflict, as we are seeing now, with rebels/terrorists taking over parts of countries.

We could do with some help from you.

The secret bankers, pharmaceuticals, we all know profit before people. The financial gurus investing so much money over time in them i.e pensions. You get a hand in glove situation. It seems they want $36 bil which is to be raised globally, to get interested in producing more efficient antibiotics. Personally, it seems to me their whole business needs a good overhaul as questions need to asked if drugs are being held back and is mankind being compromised by them. IMO there's plenty of private money which can pay them, people don't want to hear it's a UK tax responsibility. UK want China to take a lead roll at the meet up next year. Interesting, the news says £1 bil, wonder if that's the amount the UK is expected to raise. I expect this will all become more clear during the day. Panorama covering this next Mon.

It can take a long time to produce new drugs and they may have some in development, but they have to go through trials, before they can be licenced for use.

I think that plant Earth naturally controls some things and population is probably one of them. Scientists are always trying to stay one step ahead of bacteria and they sometimes don't keep up.

Did the manufacturer have a factory in the UK about 15 years ago ? Some companies set up factories in the 90's/early 2000's in places like south Wales. The government have them grants. That when countries like Slovakia joined the EU, some of these companies moved their production to where they could obtain better grants. The EU helped new members attract companies, even if it meant factories/jobs moving from one EU country to another.
