OH's Cap1 debt, CSL/Cougar Financial wont accept £10PCM

OK I am getting confused.

 

Both my husband and I have accounts with capital One.

 

I negotiated payment plans and was successful with mine offering £10 per month.

 

However for some reason they wouldn't accept the same for my husband,

despite sending and I&E form showing we could not afford more.

 

Then he received a letter from Cougar asking for urgent contact.

 

Phone calls started which I did not answer.

 

I emailed several times offering £10 per month - emails were never acknowledged,

however, letters were then received stating that the proposal was completely unacceptable.

 

Yesterday, another letter was received saying they were disappointed "reasonable proposals" to clear the debt

had not been made and that, unless payment is made to Credit Solutions Limited,

the account may be returned to Capital One Bank (Europe) for further action...

.. Is that usual?

 

Why return the account back to them?

 

I thought they would then start threatening visits etc??

 

Any advice on how to deal with this?

Only action you should take is to ignore the dca completely and negotiate with the oc.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

The account would be returned to Cap1 for consideration of a court claim, a DCA acting on behalf of the creditor cannot start a claim.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

What you have offered, start paying now, it doesn't matter if they don't like it, just pay it and pay it monthly. Should this go to court and you show the judge your budget sheet and the payments you are making, he will be very angry that you are not denying your debt and are trying to pay it off but they have decided to take it further.

 

If £10 each is all you can afford, this will never get to court, so make a standing order to the OC and continue those payments until such time that you can revue them. It's the reliability of payments more than the amount that counts.

It makes absolutely no sense at all that you are basically working of the same budget sheet - they accept your payment proposal and not hubby's !

 

As advised, continue to make the payments that you have confirmed are all that your budget sheet supports. That way you have the high ground if they decide to proceed with litigation.

 

What you really need to ensure is that they have ceased adding charges and interest - there is absolutely no point in paying a reduced sum only to see the debt increase.

It seems Capone, rely quite often on the usage of a card and the credit limit to assess how they will treat any requests for 'payment' plans, the more the card is used and the higher the limit they seem to reject offers out of hand.

who owns this debt?

 

go get his cra file and check.

 

if its still with cap1

 

then totally ignore any DCA

 

they can do nothing to him.

 

pay cap1 direct by YOUR internet banking webportal

the £10PCM

 

and GET reclaiming Penalty charges and PPI.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
