Hi sorry if this has been talked about before but I can't see much on my phone.

Years ago Lloyd's tsb gave me a huge overdraft while I was a single parent on benefits and been silly I blew the lot.

 

I ended up not been able to afford the fees so switched to Halifax to avoid them.

They passed it on to a collection agency called credit security who I've had an agreement and been paying it back to years.

 

I've just been checking my credit file out and found that they are defaulting me every month even tho I'm paying and have an agreement.

Is this normal?

Other old accounts show I have an agreement in the past before they were paid up and closed but not this one.

 

Is there anything I can do to stop them doing this?

Woah woah woah...!!!

 

Youve switched from Lloyds to Halifax?!?!?!?

 

They are part of the same group and can offset any positive balance against any debt if under the same banking body!!!

First off i would run from Halifax as fast as you can...

They wont default you every month i believe that the default has been served it just shows as defaulted on the credit file... once settled itll show "Settled or Partially Settled " on your Credit Report

I've been with Halifax years and not had a problem with them.

I knew they ware part of the same group but since Lloyds aren't chasing me for the debt it's been fine.

 

I'm registered with check my file and they show it as every month it's defaulted?

I don't really understand how these things work just thought it should show an agreement since I am paying.

as long as there is a default date in the debt summary

they can mark it howthey like

 

if you are in a payment arrangement, that's probably less than what 'should' be paid

so they can mark it if they wish.

 

as long as you've not got

loads or AP on a debt month after month

or

a D month after month

where the debt HAS GOT A DEFAULTED date

you are ok

 

if the debt HAS NOT GOT A DEFAULTED date

you need to complain and loudly.

if you have years of AP or D.

 

a debt will vanish from you CRA file completely

on the defaults 6th birthday

REAGDLESS to if you pay it off or not.

who is shown as the owner on the cra file?

CSL or LLoyds

and are your payments to CSL showing?

 

if the debt is still with Lloyds

 

pers i'd tell CSL to do one

pay the OWNER, no need to involve a no powers DCA.

you are under no legal obl to pay CSL anything.

 

esp if you do it by a card?

I have just had the ICO say that its unlikely Lloyds have complied with First principle of DPA for the same issue. After you went into difficulty they should have defaulted you within 3-6 months from when you failed to pay them i.e when the bad markers start to appear (as a guide).

 

The Information Commissioner wrote technical guidance on the filing of defaults in 2007. Essentially if they put the default on after the 6 months it puts you in a worse position than had you made no attempt to pay at all. So in my case they put the default on over 12 months from when I fell into difficulty.

 

My understanding is that the default won't come off after 6 years if the account is still active? I thought it was 6 years from the date the account was settled/satisfied?

once a default reaches its 6th birthday

paid or not

 

the whole debt vanishes never to return
