Court judgement received [parking eye] - but no summons ever received!

My husband received two parking tickets from Parking Eye,

which against my advice he ignored.

 

He has now received two court judgements with costs of over £300.

 

How can they have gone to Court without sending us a Court Summons.

 

Is he able to appeal as we were never sent the court date.

Are you saying you did not even receive a claim form? You don’t actually get a court date, unless you defend and it goes to court.

If no claim was received then you could apply for a set aside but that will cost you £80, but if your husband ignored the claim then I would suggest paying it before it is registered as a CCJ.

Call the court and ask which address the claim forms were issued to. The claims are issued by the court, not the claimant.

Let us know what they look like later. It has not been unknown for some companies to produce documents which look like court judgments and in fact they are anything but.

True but the judgements went to the right address!

And, as you've said above, it's suspicious that both claim forms went missing.

 

That's why I am wondering if what has been received are genuine Court judgments. I can't remember which outfit used to send out these dodgy documents as it's some time ago that I heard about it, but people did take them seriously and paid up.

That was a CEL trick. As they described them an example of what may be issued.

 

Thats the first thing needs doing verify the judgements and ask the court when the claims were issued.

 

I can see a problem with the set aside trying to convince a Judge that you never got the claims yet received the judgements.

 

I do hope Hubby didn't hide them or as they say there may be trouble ahead!

You mention the word 'summons' this normally applies to a Magistrates Court hearing, not a County Court Claim.
