hi all,

i owe 1400 council tax,

 

this debt went to the bailiff,

 

who said i should pay 74.00 weekly,

 

i then phoned council who said they would tell bristow and sutor that i could pay 60.00 a week instead.

 

The woman i dealt with from council insisted this was what i had to pay,

even though i kept saying i could not manage it.

 

I am now in a state with mortgage and other things and dont have enough to live on,

 

is there anything i can do to reduce this,

 

any advice will be very welcome,

if you can pay certainly NEVER pay the bailiff

 

do it to the council directly via YOU internet banking portal.

 

what is the debt all about?

 

this year?

last year?

 

all you other debts bar CTAX/mortgage/elec/gas should be reduced to the minimum

 

get those priority debts paid off

 

the rest can swing Dixie.

The council are incorrect wit that you can pay the council direct

The bailiffs have a liability order they may call it a court order/warrant what ever they call it it's a liability order nothing else

 

They will fail to tell you that there is

no right of entry for them

no police

no locksmith

Do not let bailiffs in if you have a car tuck it away for now

Pay money directly to council what you can afford

so that's not the most recent on that would be 2013/14?

 

trying to workout why it is so high

 

are the council asking for all this year till april 2014 because you defaulted

if so that's wrong.

 

I think you should also try getting your household deemed vulnerable?

is your son likely to remain so even when home?

hi sorry yes it is this years 2013 2014,

 

its 1,403.33 for the whole year,

 

i dont know what to do really,

 

i cant afford 60.00 a week,

 

and my son is suffering from mental health issues,

 

and has done so for the last ten years,

 

if i dont pay the weely amount,

 

the bailiffs will probably take my car as its all i have of any value,

 

and i need it for work.

So you could be classed as vulnerable? Have you contacted the council to get the debt taken back, so bailiffs are a non-factor?

 

Regardless, you shouldnt be dealing with the bailiffs, deal with the council direct. Hide the car a good 5-10 min walk away, so they cant get it, and deny them access to your home.

 

All they can do then is charge a max of two visit fees.

 

Pay the council direct and there is bugger all they can do.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

ok lets resit this a bit now we have the relevant info.

 

your son has been mentally ill for +10yrs

 

this classes your household vulnerable under these guidelines.........

Vulnerable situations

Enforcement agents/agencies and creditors must recognise that they each have a role in ensuring that the vulnerable and socially excluded are protected and that the recovery process includes procedures agreed between the agent/agency and creditor about how such situations should be dealt with. The appropriate use of discretion is essential in every case and no amount of guidance could cover every situation, therefore the agent has a duty to contact the creditor and report the circumstances in situations where there is evidence of a potential cause for concern. If necessary, the enforcement agent will advise the creditor if further action is appropriate. The exercise of appropriate discretion is needed, not only to protect the debtor, but also the enforcement agent who should avoid taking action which could lead to accusations of inappropriate behaviour.

Enforcement agents must withdraw from domestic premises if the only person present is, or appears to be, under the age of 18; they can ask when the debtor will be home - if appropriate.

Enforcement agents must withdraw without making enquiries if the only persons present are children who appear to be under the age of 12.

Wherever possible, enforcement agents should have arrangements in place for rapidly accessing translation services when these are needed, and provide on request information in large print or in Braille for debtors with impaired sight.

Those who might be potentially vulnerable include:

'

the elderly;

'

people with a disability;

'

the seriously ill;

'

the recently bereaved;

'

single parent families;

'

pregnant women;

'

unemployed people; and,

'

those who have obvious difficulty in understanding, speaking or reading English.

 

this applies to the whole HOUSEHOLD 'a' vulnerable person resides there.

so have you ever made the council aware of this?

are you/he getting any benefits regarding this?

you SHOULD BE.

this will probably include CTAX benefit too to some degree.

 

lastly for this bit...

 

the council has demanded the full year because you have broken their 'agreement'

and they have an LO on your now.

 

THEY are the ones that control this.

ideally you need to get them onboard YOUR CASE

[the year can be divided by monthly payments up until march 2014

 

so about £280PCM minus any benefit your might be entitled too

 

can you tell us about your son & benefits & if you've ever told the council please

 

we need [tonight]

to get you an action plan together to ring the council with.
