    • Your concern regarding the 14 days delivery is a common one. Not been on the forum that long, but I don't think the following thought has ever been challenged. My view is that they should have proof of when it was posted, not when they "issued", or printed it. Of course, they would never show any proof of postage, unless it went to court. Private parking companies are simply after money, and will just keep sending ever more threatening letters to intimidate you into paying up. It's not been mentioned yet, but DO NOT APPEAL! You could inadvertently give up useful legal protection and they will refuse any appeal, because they're just after the cash...
    • The sign says "Parking conditions apply 24/7". Mind you, that's after a huge wall of text. The whole thing is massively confusing.  Goodness knows what you're meant to do if you spend only a fiver in Iceland or you stay a few minutes over the hour there.
    • Hi and thanks It looks like they ticked all the boxes to me but I'll try and upload the notice. I was wondering if a witness to late delivery might be considered proof - I'm assuming they posted it as normal but Royal Mail stuffed up delivery. If not then they're really saying it just has to be posted within 12 days of the incident, regardless of when it is received. Annoying! edit ok thanks Honeybee here's my 2nd (actually 3rd) attempt at anonymising, copying and uploading the notice! Sorry about the state of it - I sat on it while distracted by my dog 🙃 pcn front.pdf pcn back page.pdf
    • ROFL - dont get upset just because someone (quite a lot of someones) dont want smart meters - well unless you get paid for it .. in which case ...   I assume you haven't been with Octopus long enough to be on one of the very long fixed price tariffs they offered before the prices went bonkers .. and that you dont use your electricity in the evening/lunch time if you think the 'agile type tariffs are good value .. let alone worth installing a smart meter for - high price a good disincentive for an evening cuppa eh? Let alone all your computer/tv etc time in the peak price evening or lunch time. - and boy do those peak prices instantly hammer your bill when those Russian and middle eastern issues kick off.   I would only have considered a smart meter if solar panels had been an option for me - but roof is oriented completely the wrong way. Oh - and My opinion hasn't changed since the smart meter trials 40 years ago, because neither have the issues (well not enough) but I'm happy for you. Be happy for me.
    • Hi. I'm afraid I've had to hide your post with the pdf files to keep this anonymous for you. You've left the PCN reference number and your car reg showing. Could you edit that and repost please? HB

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

This news is surely going to destroy the Legal Loan Sharks.

Now in London and Birmingham.

I just hope the Banks somehow do not interfere.

The Banks may find themselves in trouble again with people like Bank Of Dave In Burnley

http://www.burnleysavingsandloans.co.uk/about-us/

And Spark down South

http://sparksal.co.uk/

Offering loans to local businesses at mates rates, and good interest rates to investors.5%

All net profits going to charity.

And Community banking as well.

Maybe a financial revolution is arriving.

It sounds like the Legal Loan Sharks are soon going to run out of food.

And just as the Subprimers did vanish,to be forgotten in the mists of time.

This is good news indeed :)

If only it became more widely advertised and people started to save just a few pounds a month with Credit unions, PDLS might be stamped out of existence :)

Hi Citizenb

This news will soon be known all over Great Britain.

All i would like now is for the Church Investment team to pay for the IT platform at the Post Office.

Link the Credit Unions to the network.

Archbishop Welby said in a blog a few weeks back.It will take ten years to compete.

He pledged to Compete the lenders out of business.

He was wrong

This is the quickest way possible.

Keep to your pledge,i will not forget.Invest.

Then you can get on with Church business. And have a smile on your face. You helped compete the legal loan sharks out of business,as you said you would.

And one last thought Credit Unions do a lot more than Loans, take a look at your local one today.

Hi renagadeimp.

This is why i would like the It platform set up at Post Offices. To link things up.

Perhaps the old Postmaster being authorised to grant small loans.Everything linked up.

Let me guess 14,500 post offices reaching perhaps 90% of people in Great Britain within a couple of miles of getting to them.No costly bus rides, drives etc.

I am always talking about the Credit Unions,so this next week i will join my local one.And write a small article on how it went.

I will go down to their office, have a chat if possible,i have forms from a payday loan protest i did with Gordon Marsden MP for Blackpool.South

Here is the story if anyone has time.

If anyone has details of local CUs, perhaps they can post the details here :)

That is great news frustrated. If some of the larger companies could do this nationally, it would be brilliant.

Hi all, I have just been approved for a loan with the company I work for. They have their own credit union, over 12 months all I'm paying back in interest is £67.49! Over 1 year, absolutely no comparison to the sharks of payday loan companies! So pleased I joined. So my advice would be to people if they can join one near them then do it!

I have not had time to wander down to my local credit union, but soon will i assure you.And tell the story.

I have seen great ideas from the Credit Unions.Saving clubs Christmas clubs many many things.I think i will put some on so you realise how cool these places are.

Why did i not join years ago.

You save with them,a little, they lend to local people, spend in the local community who then pay back.

Then you may get a little interest.A bonus that beats the Banks any day.

And makes you happy.

A chap in America went to the local Credit Union, they said,"nice haircut you have had"

What do the Banks say to you, "Next"

Here is what my local Credit Union does. What does yours do.Tell me.I find it interesting

Credit Union Member Benefits

  • Free to join
  • Easy access savings accounts
  • Christmas savings accounts, locking in your money until Christmas
  • Pay in by payroll deduction, direct debit, post office or pay-point or direct from your benefits.
  • Free life protection doubles your savings for your family in the event of your death
  • Annual dividend payments
  • Access to affordable loans at bank-beating interest rates
  • Free life protection to pay of your loan in the case of your death
  • No set-up fees
  • No arrangement fees
  • No early settlement fees
  • Owned and run by its members
  • keeps our money working for us here in the Fylde Coast

I am ashamed to say, that I did plan to look for one locally to me and have been completely side-tracked. I have stuck a post it note on the screen so I don't forget :)

It's a company who iv worked for for 13 years so I know what I'm entering into with so much information given to me from my employer. I'm also saving with them what I can and got free life insurance too. Excellent! More people joking these, the less people will need to apply for payday loans with massive APR and the hassle of repaying.

I can also add money to it using my members card via pay point which is handy and safe! Savings and Christmas club. Will also only allow what you can afford and because I'm an employer they can check that I'm in receipt of what wages I say I am. Paying over a longer period of time is so much better. I wish I had discovered this a long time ago

This thread is a lot quieter than i thought it would be so lets have a lighter look at things.

I am sure there are some on these payday loan threads that are naturals at making prose, poems, rhyme whatever.

Till the next person who comes on to say they have joined the credit union, help me make some verses up to this tune.

There is a reason.I am soon releasing a documentary to compete with Wongas new one to be released soon.At the same time hopefully.

I want a theme tune to sing to the payday lenders.Straight at them, down their throats, through their letter boxesCan you help me make verses up.I thank you.I will start it off mmm,try to.

1st verse.

Now i am a Credit Union man

Amazed at what i am

I say what i think

That the Legal Loan Sharks stink

Yes i am a Credit Union man.

( Phew, that will do for me.Who wants a go at the second verse,or improve on the first.)

I have spotted the posts below. This is so exciting,we will together have the sharks on the run.CitizenB you sure do rock.I have a friend who is in Germany,on tour,a singer amongst other things.I will risk it,send him the tune, see if he will sing these words.,i will risk it,why not.He may,he may not.Worth a try.I think i will play it again.I just hope you can not hear me.

With a hell of a shout, it's "Out WONGA out!"

And the rise of the Pay Day Loans fall
