    • Okay so potentially it may not even get sold on? Just the default left for 6 years then gone? but if it is sold on ill get a letter from the DCA which is the notice of assignment? Sorry what is the different between a default notice and a default cal marker? yes, i may try and work arrangements out with the OCs after the breathing space but I'll see my circumstances then thank you again for all your help and patience, I really appreciate it and apologies If i am too fast or repeating myself.
    • receiving a default NOTICE (forget simple default cal markers) does not mean it will get sold on... OC's very very rarely do court themselves.  if it does you would receive a Notice of Assignment from the debt buyer/DCA.  as for reduced payment if it remains with the OC and they issue a DN, no harm in trying but lets get all your ducks inline first. dx  
    • okay thanks do you know how long it will take for it to get to the DCA or could the OC try and issue a CCJ? even though it's unlikely also for example would the OC agree to a reduction and a small payment over a super lengthy period of time if agreed? Rather than go through chasing apologies again for all the questions, just trying to understand all the possible scenarios.

    • depends what the fees are, typically nothing can be added once judgement is passed bar litigation costs. on document retention time limits etc at least 6yrs previous must be held though many hold complete info. as for acronyms and abbreviations ideally yes they should

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, after last car we had, (another thread on here) we got a new car well an 06 plate.

 

Today I had no option but to take to local garage as clutch popped!!! (Took for service they said it was loose, was booked in for Tuesday) the garage said need to be kept with them till Tuesday, as parts need to be ordered, I'm ok with this as the company we purchased from are paying. My only dilemma is my partner now has no car to get to and from work, he works 30 miles away from we're we live.

 

The finance company are just saying fingers crossed the work can be done by Friday evening! Very unlikely with a new clutch and gear box and cailpers needed, we have looked at renting but can't as do not have enough and no credit card. Any advice on what we could get finance company to do please

They could give you a courtesy car.

Doubt it. Firstly a courtesy car is what it says and is down to the dealer or repairing garage to supply one IF they have one. It is NOT an entitlement. You might be able to convince the supplier to provide a hire car under the consequential loss route but this is very risky and suggesting this might well put the supplier on the back foot so to speak. I take it that the repairing garage are aware of that the supplier is paying and that they have it in writing as they have a legal lien on the car and probably won't release until they have been paid.

Garage have been paid by finance company. We have asked on several occassions for a courtesy car, but get well we can't make one from thin air, my partner will lose 312 for not being able to get to work til next week .

Not a rare car, so you should give them a deadline by which to complete the work and return the car to you in fully working order. Make time of the essence and tell them if the car isn't returned by that date you will hire a car and bill them for it.

Ok so car was taken back up to them on a truck as clutch went pop, they said just the linkage had gone and it cost them £100 for tow truck for an £18 job, I did offer to get the garage used on other parts to fix it, now they personally driving my car 135 miles back up to me, with my petrol I put in, I took a picture it had 333 miles of petrol left so I'm hoping it comes back with a min of 300, they told me no as I wasted there time and money, and they still have not fixed suspension which is leaking!!!

 

Can I have them for damages?

Lost wages, had to use public transport as have a child that can not walk probably, so just to go on school run had to use a bus. We were under the impression the gears and clutch had been done in October, my partner now faces losing his job as had no means of transport to work, we paid to go on a trip to Birmingham to cadburys world, (have the receipt here) and were unable to as no car to go, and can not rearrange cadburys as car went in on Thursday and was too short notice to cancel the trip and get refund.

if you believe they have breached the contract you had with them, then send them a letter (recorded) with a breakdown of your losses and request payment.

 

Only when they reply, (or don't) will you know the next step.

 

So who said the gearbox and clutch had to be changed and who told you the calipers had to be changed ?

Took it to 3 different garages, vauxhall 1st as we didn't believe it had a full service so got it done, and they list the problems, never mentioned it to next garage being ford, who said same problems and thought being a private garage who again. Said same, contacted company who paid a garage part of the good garage scheme to fix certain problems, we were under impression clutch and gears done, a few weeks later it pops! (I screamed!) I ring company and had to have a full blown argument with them as they wanted us to drive it 135 miles to them, made clear gears gone it can't drive, so they sent two truck and then they rang after few days of having for saying it was an 18 pound job to do linkage, I then said what about clutch, he said when that goes we will do that, I made clear it gets done or I want all my money back. They do that and the a week later we got car back after someone drove it back, and I took it back to vauxhall everything has been done but the suspension

I don't remember you saying anything about the suspension?

 

I can't see where you say they have replaced the calipers?

 

There is no need to do anything to the clutch if there is nothing wrong with it. The clutch cable is what controls the clutch so it that goes then it naturally follows that the clutch wont operate.

I know scrap yard would be easy, but finance have said they want new parts!! Worse thing is I know a scrap yard owner really well n parts R there! But finance R insisting new.

 

Finance can only insist on new if they are paying for it, there is no requirement for the seller to fit new.

Calipers done, sorry so much going on, clutch is worn but it all sorted on that, we paying for suspension as can't keep taking it back and fourth, they only open Monday to Friday and with kids in school and both working, would be a lot of hassle

Ok had the car back a week. And it has happened again, won't go into second gear without force! Told car finance company and got well it was ok when it was here and drove it all way back to you. The car is due to go to vauxhall this week to go on diagnostic machine to see if that brings anything up.

 

I've got a camera in car, showing that it did it the day we got it back and I drove the agency who drove my car back to train station, (was not happy about this but in a way glad he witnessed it) on camera you have audio so can hear the grind then me getting frustrated turning car off, then back on, and it happening again and me having to pull over on a few occasions to rest the engine.

 

Again no courtesy car available, so got a rental company who will help us with a small van (anything to get partner to work over christmas and new year period) and I shall be billing the company

I work for a company connected to the motor trade. We took one of our vans into a Vauxhall dealer for a clutch problem under warranty. When we went to pick it up the fault was still there. We asked for the service manager and told him again what the fault was, but they had changed the wrong part. They reluctantly agreed that our diagnosis was correct, and that we would have to leave the van with them again, which caused us a lot of inconvenience. Just because a garage is a main dealer, it's no guarantee of a proper job.

I know, but it the finance company that sent it to vauxhall, and because an agent they hired drove it home and said it was fine, my partner now faces being sacked if he does not get to work, and they are insistent that the car is fine. I've got it on camer with audio showing it bur apprently my driving is bad (on a roundabout going into second and stalled in middle of busy roundabout ) now I just want to hand car back and get my money, that is my plan now

i think you will find that 3 months of ownership will put you in the 'accepted' class and only a judge could decide otherwise. It's very, (with lots of verys) unlikely that the dealer will want it back.

There is a chance that if the car really was fitted with a new gearbox, very doubtful, he might just accept it, but there is 3 months of depreciation to take into consideration.

We reported problems in September, before the 3 month stage, and according to CAB if any problems arose on the car within 1st 6 months of owning the car, it is assumed the problem was there when he car was purchased, we have FOS involved now

 

I don't car if dealer don't want it back, that there problem, I now have 3 reports from different garages over the problem, all saying they clutch and gear is worn, the linkage has been replaced but wrong, the shock absorbers are still leaking, we have stopped driving the car, and have hired a van, (no cars avail) if it goes to court I'm fine with that, the mechanics who have carried out work up here are happy to come with me
