Agressive bailiff? or DCA? banging on my door , shouting through letterbox

I suffer from depression after losing my job.

 

I've been unable to find another one and I'm trying the best I can to get a job.

 

without a job I haven't been able to pay my bills and have fallen into serious debt.

 

Couple of days ago around 6pm I had someone banging at my door and shouting through my letter box aggressively, saying that he had a delivery for me.

I could see he had a white envelope in his hand but he didn't want to post it?

 

He carried on for about 20 minutes banging, shouting and trying to look through my windows.

Then he went away and he reversed up in a new Mercedes car,

he had parked out of site and just stared at my house for awhile and then drove off.

 

I could see the anger in his eyes, it was like I had done him wrong but I've never met this person in my life before! I've also not done wrong to anyone.

 

I think this was my first experience of a bailiff and it's made me feel sick!

 

I just can't believe someone who you don't know can come to your property and harass you like a thug trying to mug you in the street!

 

I thought it was 2013 and not the 1800's but it's like these people are a law to themselves?

 

I don't know what he wanted and it's been a couple of day now without another visit.

 

I've been told you don't have to talk to bailiffs and this one was psycho!

Have to be honest and say it sounds more like a debt collector/repo/process server than a Bailiff who would usually just post the letter.

Yeah I should of put debt collector rather than bailiff. Do they all act in this intimidating manor or I'm I just unlucky? Do they have the right to treat people like this?

in all truth THEY HAVE NO LEGAL POWERS WHATSOEVER!!

 

they are NOT BAIIFFS.

 

just some bloke on commission to fleece people

 

if he does come back

 

tell him to LEAVE your property or you will call the police.

I put this notice (below) on my window as advised by some one else.

Under Common Law for people to be able to visit this property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that the occupier revokes the license under Common Law for any representatives to visit this property and if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

Sadly Jez, I doubt your average debt collector can read. If you did it in crayon using simple images.....

I know this may be strange advise and you may be advised not to do it but, if you do they will wonder if you will actually do the what you say, if he/she is a Doorstep collector he will run, If he is a Bailiff he will respond as such, tell you what he wants, you do not have to let a Bailiff in he will give you the letter you need to find out what it's all about, but with the door locked!!! you can always talk to him through the door.

 

Ask him/her what they want and ask for their ID, then if they refuse just say I'm calling the police they then will A Scarper B they show their ID you can note this down, then inform us, C ask him to put in writing what he is doing there, and ask him why he is banging on the door in such a way, if he refuses all of your request take a Photo of him/her as they leave, knock on the window so he/she turns around, then you can still call the police, but at least they will have an exact description of the attendee, I have done this many times and it worked for me.

I think for anyone on CAG to give you any advice, we need to have some brief details of the debts that are currently being chased. Can you post some details of the debts being chased, but do not be specific by giving exact amounts or the company you owe money to.

 

e.g Type of debt (council tax, court fine, TV licence, other tax due, credit card, car finance, mortgage or rent ) and how much approx £xxxxx

 

What local help are you receiving ? Council tax benefit, Housing/Mortgage type benefits, Job Seekers/ESA, Citizens Advice or local debt advice charity. If you look in your local directory/newspaper there may be a local debt advice charity or Citizens Advice bureau who can offer you some help and point you in the right direction. The longer you leave it before getting advice, the worse it will get. As soon as your creditors are aware of your situation, then you should be given time to resolve matters and this should stop the level of hassle they might put you through otherwise.

The type of debt I have is 8 credit cards, 1 non secure loan, bank charges, Water, and I'm behind on my mortgage. Not including the mortgage debt I'm 28,000 to 32,000 in debt.

I'm on JSA, Council tax benefit and just getting help with mortgage interest payments.

Yeah they called again at today 8pm but there was 2 of them in the same car. I froze and couldn't bring myself to answer them.

The only really recent DCA letters are from: -

I haven't had any other letters from any other DCA for months.

 

I will have to get an up to date list from my debts because Noddle.co.uk is not showing the correct info?

 

No I didn't answer. It was dark and there were 2 of them. They didn't leave a letter. I know they don't have any legal powers but I've not dealt with these sort of people face to face.
