ASDA Car Parking / Dispute payment on Credit Card

My friend's BF has just had a bailiff appear on his doorstep,

asking for £450 for a ASDA (colchester) parking fine or they will take his car.

 

The parking fine apparently occurred in march,

no fine , notification was ever received by the BF,

but my friend suspect's it relates to this time in march.

 

the bailiff mentioned this had gone to court,

but also the BF had no notification of this (the BF had never had any notification of any parking fine).

 

The BF is unemployed and couldn't pay the £450, so in the moment he got his mum to pay the £450 which she did.

 

At the moment i am trying to ascertain whether this was on a Credit Card or Debit card.

 

My question is this

1. if the payment was on a Credit Card, can this payment be disputed and withheld ,

as technically the CC issuer at this point has made the payment.

The disputed payment being based on further investigation into the charge.

 

2. By definition , the BF has had no documentation, is there a way to find out from the Court about any judgement

 

3. £450 seem's excessive

 

I suspect this is a Bailiff [problem],

that there was no court judgement,

and being on a Private car park ,

they are trying there luck and well it worked.

 

I've asked my friend to photograph the Car Park signage and determine whether it was a Credit Card

as i feel as the charge has been paid,

the only practical way to get this back would be via the CC disputed payment.

if there isn't then this 'bailiff' isn't a bailiff at all, they'll be a doorstep collector. You should be able to argue that the payment was made under duress by false representation.

What proof did he show that he was a bailiff? I am pretty sure you can dispute this amount with the bank as I'm quite sure anyone on the doorstep would distress you did they leave some form of receipt? That might be able to tell you who they was.

oh dear this sounds rather suspect

 

get a section 75 going on the credit card NOW!!

 

if it was a debit card get a chargeback running.

 

bailiff my foot!

 

shall we guess guys... lets think who it might have been...

 

just a thought....

 

did he actually have a credit card machine with him?

most true bailiffs do, dca's don't.?

 

please don't tell me he escorted her to go and get cash out...please...

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Advice as above....This Stinks, ASDA car parks are free for three hours max stay.

 

You could always telephone Northampton County Court Bulk Centre and your Local Court to see if there has been a real default Judgement registered against you.....If there has, you need to fill in the court form to have the judgement set aside assuming it is a real judgement and real bailiffs appointed by the court for a warrant of execution as you knew nothing about the case and did not receive the original court papers.

 

If not call the police.

yes! obtaining money by deception is a criminal offence. go get em!
