      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi pitz11 - FLA is my last resort. Will write to them if I have no response from the insurance company. will update as soon as I have any news.

Just to clarify when you say your writing to the insurers you mean the insurance underwriters mine are Bennett Gould and partner what would I write to them just basically that the ppi was sold in error and want a refund

We were in the same situation - window loan from 1999.

 

 

After being given the run around from G E and then the underwriters

- go to the company

- but the company does not exist anymore

- we made a complaint to the FOS about the underwriters

- which had eventually become part of CGU and then Aviva

(we did not know this at the time;

 

 

after several months Aviva made us an offer which was very nice !

 

 

At the time we did this the FOS had a special team for these cases.

 

Don't let them give you the runaround - go back to the FOS and chase the underwriter

Thanks for the encouragement - I will definitely get onto fos.

 

 

Although they called me to say that they cannot help anymore, nothing was sent in writing.

 

 

They asked me explore the possibilities on other avenues such as looking into

third parties, insurance and anyone else I can think of who may be linked to the window company.

 

 

So I will start writing to everyone I can think in this process.

 

 

I know the Administrators, but the underwriters may be able to help.

Hi sorry to hijack this thread but I am in the same boat and a little bit further down the line then you

 

I have just received response from Aviva

 

exactly the same situation

 

the window company has gone bust

 

GE money do nothing

 

FOS sent my details to Aviva

 

Aviva refused

 

saying I was not mis sold and told me to take it up with the broker from the window Company

 

4 years to get this response

 

I am appealing their decision

 

as the broker is selling their product so they are responsible to administer the broker is acting correctly

and I to was told that I had to take out PPI for both my husband and I

 

two seperate insurances as it was a joint loan and we wouldnt get the loan without the PPI will keep you posted how it goes with Aviva

with the broker taking their commission?

Hi Is your claim for just £25.00? I don't have any experience dealing with Courts. I would let it go as I am sure court fees will be higher.

 

No the fee is 25.00 the value of the claim is £1600

oh sorry - I got it wrong. I would pursue it via courts then. But I don't know what other charges and costs it would involve though. I am sure someone here will advise you. Good luck.

 

I have not even started anything regarding my issues with GE or insurance yet - but when I find some time I would tackle these.

thanks dx100uk,

 

i have found the original paperwork

 

which staes that payment protection plan was arranged by

bennett gould & Partners limited (lloyds insurance brokers)

 

should i just go to a small claims court and take the chance for the sake of the small court fees

and see if i can get any joy down that route,

 

any help would be really apperciated as i think theres not much else i can really do

Harmony windows sold the windows the finance was provided by first national now ge money and the ppi is arranged by Bennett Gould and partners ltd (Lloyd's insurance brokers)

 

Hope makes more sense
