    • The incident was 03rd March 2024 - and that was the only letter that I have received from MET 15th April 2024 The charge I paid was at the Stansted Airport exit gate (No real relevance now - I thought this charge was for that!!).   Here is the content of email to them (Yes I know I said I was the driver !!!!) as said above -  I thought this charge was for that!! "Stansted Airport" Dear “To whom it may concern” My name is ??  PCN:  ?? Veh Reg: Date of Incident: 03rd March 2024 I have just received a parking charge final reminder letter, dated 10th April 2024 - for an overstay.  This is the first to my knowledge of any overstay. I am aware that I am out of the 28 days, I don’t mean to be rude, this feels like it is a scam My movements on this day in question are, I pulled into what looked like a service station on my way to pick my daughter and family up from Stansted airport. The reason for me pulling into this area was to use a toilet, so I found Starbucks, and when into there, after the above, I then purchased a coffee. After which I then continued with my journey to pick my daughter up. (however after I sent this email I remember that Starbucks was closed so I then I walked over to Macdonalds) There was no signs about parking or any tickets machines to explains about the parking rules. Once at Stansted, I entered and then paid on exit.  So Im not show where I overstayed my welcome.. With gratitude    
    • Just to enlarge on Dave's great rundown of your case under Penalty. In the oft quoted case often seen on PCNs,  viz PE v Beavis while to Judges said there was a case for claiming that £100 was a penalty, this was overruled in this case because PE had a legitimate interest in keeping the car park free for other motorists which outweighed the penalty. Here there is no legitimate interest since the premises were closed. Therefore the charge is a penalty and the case should be thrown out for that reason alone.   The Appeals dept need informing about what and what isn't a valid PCN. Dummies. You should also mention that you were unable to pay by Iphone as there was no internet connection and there was a long  queue to pay on a very busy day . There was no facility for us to pay from the time of our arrival only the time from when we paid at the machine so we felt that was a bit of a scam since we were not parked until we paid. On top of that we had two children to load and unload in the car which should be taken into account since Consideration periods and Grace periods are minimum time. If you weren't the driver and PoFA isn't compliant you are off scot free since only the driver is liable and they are saying it was you.

    • Doubt the uneconomic write off would be registered, unless you agreed to accept write off settlement of the claim. It is just cosmetic damage. All that has happened, is that the car has been looked at and they realised the repair costs are going to exceed the value of the car. If the car is perfectly driveable with no upcoming normal work required to pass next MOT, your current Insurers will continue Insurance and you can accept an amount from third party Insurers to go towards you repairing the scratched bodywork.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi think I can now say im a member of the been ripped of by Barber Car Sales Group. Ive got a baby due in December and decided to free up some cash and change my mint Subaru Impreza for an older model so I could get the babys room kitted out. Saw an advert on Ebay for a impreza that was older but still looked nice and the advert said part ex and swaps considered it was Barber Car Sales. I went down had a look at the car and did the deal with 'Dave' Mr Virdi for my car and cash he said he didnt have the cash there but gave me a deposit to confirm the deal. All ok so far I got a phone call from 'Dave' a week later saying he had my cash and we needed to do the deal that day which I thought was strange but went with it. Drove to the Barber Cars sales site signed the paperwork collected the cash and drove away in my new car. Now comes the bad bit I recieved a letter in the post from the DVLA less than a week later saying thakyou for your application for the V5C but we are unable to issue it until the car has had its VIC test to prove it is fit to go back on the road after its accident repair and to confirm that the repair has been done to a high standard. I carried out an HPI check on the car which 'Dave' says he does on every car to find out the car is a cat C recorded car in 2011 and has not been inspected to confirm the repair is good enough for the car to even be on the road let alone sold by a garage at full retail. So I contacted 'Dave' and he admited he was not aware of the car being recorded I asked for my money back and now this has been over 3 weeks and I think Barber Car Sales Coventry, Longford Road have fallen of the face of the earth because they dont answer the phone to me or my texts and Im left with a dangerous car that shouldnt be on the road what a mistake I made going to these people wish I had googled there name first cant believe they are still in business can anyone advise me as to what I should do next cheers

outline as many details as possible and I'm sure someone will be able to give you some decent advice...... although I will say from reading other peoples experiences with this guy/garage I think you are in for a long hard battle to get anything back from them. You could also consider getting a VIC check done and having the car inspected for safety.

Have you physically been able to get back to the dealer and have you reported it to Trading Standards via CAB? I suggest you send a letter by recorded mail asking for all you money back and your previous car otherwise you will need to take civil action. Give them 10 working days.

hi thanks for your response I have nt been physically back to the garage because i was concerned about how a scoundral like this might react to me but I have reported it to Trading Standards and they are very interested in the case and have asked for me to foward all the infomation i have onto them. CAB advised me to send him a letter as you have recorded delivery cant believe this company are still trading.

I had no issues with a gentleman called Dave. I got perfect service and he was very open to me about the comments about him on here. I always judge people on a one to one basis and on this occasion I found him and his staff very friendly and helpful. It's easy to make bad comments but it's only fair to place a good comment. I have no issues passing this dealer onto other people and I will use them again no problem. Steve

I would go and get the car inspected at a garage.it might be cat c but it could get that if the parts where 2 expensive and someone has used some 2nd hand parts to fix it so it might still be safe so might not be a total loss.

Zumbanikki. It doesn't matter what category it is written off at. The seller is legally obliged to informthe buyer it is a write off.

 

We are finding in the motor trade that many traders are paying higher than average prices to buy their stock. But what they aren't doing is the remedial work to bring it up to retail standard.

When the customer complains about their car they refuse their legal obligations. Even if you then get a court order you will battle hard to see any money. The garage name and ownership changes on a regular basis.

You need to keep an eye not only on the subject, but the date the thread was opened. This one is almost 12 months old and like in a lot of threads, the original poster never came back to let anyone know how he got on.

It is experience within the trade conniff. My stock comes from local garage trade ins and auction sales. In both cases I and other traders are told or witness the sale at auction. See the vehicle go for considerably more than its CAP price. You then see it advertised at some garages. You can see the margin in these vehicles and that they have not been prepaired to retail standard. The midlands is a particularly bad area for this practice.

 

My report to admin was the removal of wording in my post which completely changed the tone of my post. This was unfair to me and to the users that will find the information of help.

I had no issues with a guy supposedly called Dave either yet I have learnt today that he is apparently the owner and will appear all teary eyed in order to get you off the pitch... they're all bad

I don't think 'dave' even knows who he really is anymore!
