    • There's a thread somewhere about someone sending the baillifs against Wizzair that is quite hilarious. I would love to see someone do the same to Ryanair. Question is, should you be the one to take that role. You are entitled to the £220, if your flight was from the UK. If it was TO the UK I suppose it is more of a grey area... though the airlines I know have been using £220 as standard. Not that surprising for Ryanair, the worst cheapskates in the universe, to go for the lower amount, and if you forward this to the CEO he will probably have a jolly good laugh and give his accountants a verbal bonus. After all he's the one who said and I paraphrase "F*** our customers, they'll fly with us again anyway". While we would all love to see Ryanair get wooped in court again, I have to join my fellow posters in thinking it's not worth the hassle for (hypothetically) £7 and not sure it will expedite the payment either. It's already an achievement that you got them to accept to pay.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Dear all,

I am writing to ask advice on some issues that have arisen since I had a guitar in for modification with an independent “specialist” or luthier.

The guitar came back with a variety of issues and the job was clearly not performed correctly on closer inspection. The issues that have arisen are due to poor workmanship, lack of attention to detail and general negligence.

The guitar was worth around £1700 but has had its value significantly reduced due to the luthiers' poor workmanship.

It will cost quite a bit to get it put right – potentially a very big job.

I now need to either:

  1. Get the guitar in proper order,
  2. be adequately compensated for the loss in value or
  3. receive a new guitar.

Thus far I have managed to cancel the cheque for £150 that I made as payment for the work.

I would not consider giving him the guitar back to try and correct his mistakes.

I wrote the cheque because I had not had chance to take a close look at the guitar which revealed many issues.

Do I need to see a solicitor?

The person is operating from home under a company name and was recommended to me.

I would be very grateful for any advice I could receive on how to proceed with this matter.

Thank you.

Background on the issue, possible repair costs, have you discussed this with the repairer? basically whatever you can think of. The reason i say this is because, if he isnt willing to accept blame or repair it correctly, then you may have to take legal action. If that ends up being the case, then you will need as much info and evidence as possible ( including photos), to back up your claim.

The key thing with a dispute like this is evidence. Make sure you get good photos of the guitar and any other evidence you can find before making repairs.

In an ideal world you would approach the repair person with proof of what has gone wrong and try to agree a solution. If he has genuinely not performed the service with reasonable care and skill, and he refuses to put it right, then you would have to bring a county court claim in the small claims track.

Sorry forget what I last posted!

Yes I will be gathering evidence. Also the professionals who have seen the guitar said they will back up my claim.

Not discussed yet but have sent him a letter detailing the issues.

I've had other professionals look at it and the are as appalled as I am. They are willing to back me up and state it was an unsatisfactory job.

I will be taking detailed photos.

The job coast £150 (but I canceled the cheque). To put it properly right will be well in excess of that.

Should I get a quote from some other repair man?

Cheers

Get an independant report done and keep a copy. You then need to contact the repairer, supply them with the report and give them a timeframe to fix the item to your satisfaction. Failure to do so will result in legal action. You also need to keep everything in writing. Do NOT use the phone.

Make sure you keep the letter short and sweet, concise, and do not ramble on.

Simply state what happened, and what you want in resolution. Give them a timeframe to do this. Normally 7/14/28 days but entirely your choice ( you have to give them the opportunity to rectify the problem). Then once the time frame has elapsed, you can use MCOL and get the legal ball rolling.

Not likely you would get legal aid for something like this. However bringing a small claim yourself is not that difficult, as long as you take care to comply with court deadlines and have evidence to back up what you are alleging.
