    • They have defended the claim by saying that the job was of unsatisfactory standard and they had to call another carpenter to remedy. My husband has text messages about them losing the keys a second time and also an email. What do they hope to achieve??? Most importantly,  as far as I have seen online, now I need to wait for paperwork from the court, correct?
    • The Notice to Hirer does not comply with the protection of Freedoms Act 2012 Schedule  4 . This is before I ask if Europarks have sent you a copy of the PCN they sent to Arval along with a copy of the hire agreement et. if they haven't done that either you are totally in the clear and have nothing to worry about and nothing to pay. The PCN they have sent you is supposed to be paid by you according to the Act within 21 days. The chucklebuts have stated 28 days which is the time that motorists have to pay. Such a basic and simple thing . The Act came out in 2012 and still they cannot get it right which is very good news for you. Sadly there is no point in telling them- they won't accept it because they lose their chance to make any money out of you. they are hoping that by writing to you demanding money plus sending in their  unregulated debt collectors and sixth rate solicitors that you might be so frightened as to pay them money so that you can sleep at night. Don't be surprised if some of their letters are done in coloured crayons-that's the sort of  level of people you will be dealing with. Makes great bedding for the rabbits though. Euro tend not to be that litigious but while you can safely ignore the debt collectors just keep an eye out for a possible Letter of Claim. They are pretty rare but musn't be ignored. Let us know so that you can send a suitably snotty letter to them showing that you are not afraid of them and are happy to go to Court as you like winning.

    • My defence was standard no paperwork:   1.The Defendant contends that the particulars of claim are generic in nature. The Defendant accordingly sets out its case below and relies on CPR r 16.5 (3) in relation to any particular allegation to which a specific response has not been made. 2. Paragraph 1 is noted. The Defendant has had a contractual relationship with MBNA Limited in the past. The Defendant does not recognise the reference number provided by the claimant within its particulars and has sought verification from the claimant who is yet to comply with requests for further information. 3. It is therefore denied with regards to the Defendant owing any monies to the Claimant, the Claimant has failed to provide any evidence of proof of assignment being sent/ agreement/ balance/ breach or termination requested by CPR 31.14, therefore the Claimant is put to strict proof to: (a) show how the Defendant entered into an agreement; and (b) show and evidence the nature of breach and service of a default notice pursuant to Section 87(1) CCA1974 (c) show how the claimant has reached the amount claimed for; and (d) show how the Claimant has the legal right, either under statute or equity to issue a claim; 7. As per Civil Procedure Rule 16.5(4), it is expected that the Claimant prove the allegation that the money is owed. 8. On the alternative, as the Claimant is an assignee of a debt, it is denied that the Claimant has the right to lay a claim due to contraventions of Section 136 of the Law of Property Act and Section 82A of the consumer credit Act 1974. 9. By reasons of the facts and matters set out above, it is denied that the Claimant is entitled to the relief claimed or any relief.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Dear all,

 

I have just recieved a claim from Northampton County Court from Bryan Carter solicitors. The claimant is Pheonix Recoveries.

 

It is relating to a £9k loan which I took out from Lloyds TSB.

 

I had an arrangement to pay Bryan Carter 100 pounds per month but due to financial issues I couldnt keep up with the payments.

 

1 Day after recieving the claim form I recieved a letter from Bryan Carter saying that they have now issued litigation proceedings.

 

I havent contacted Bryan Carter yet or filled anything in on the claim form.

 

I am just looking for some advice as I dont want a CCj going on my file!

Is there anything I can do to prevent the case going to court?

 

ANy advice would be greatly appreciated.

In the first place, well done for posting here nice and early. You would be amazed at how many people don't.

 

If you have access to a scanner, can you please upload the claim form so we can see the Particulars of Claim, making very sure that you cover up anything which can identify you personally?

Particulars of the claim:

 

The claimants claim is for the balance due under an agreement which is now all due and payable

 

The defendent agreed to pay monthly instalments under account number XXXXXXXXXX but has failed to do so

 

And the claimant claims the sum of £8806.36

 

The claimant also claims interest thereon pursuant to S.69 County court act 1984 limited to one year to the date hereof at the rate of 8% per annum amounting to £704.51

 

 

Amount claimed: 9510.87

Court fee: 190.00

Solicitors costs: 100.00

Total amount: 9800.87

That is a shame. For once, Carter is not splitting his claim.

 

Firstly, if this is a loan, there should be an agreement. Have you at any time requested a true copy of the agreement by making a CCA request? If not, I would do that now. The agreement is covered under the CPR requests I will cover in a minute, but I would still make this separate request. This is a direct request made to Phoenix, so it cuts out Carter altogether.

 

Then you will need to request information under the Civil Procedure Rules. Under CPR 31.14, you are entitled to an exact copy of any document mentioned in the Particulars of Claim. In this case, that is just the agreement.

 

CPR 18 is far more wide ranging. It does cover the agreement, but also other evidence as well. Even though CPR 18 covers the agreement, I would still make the CPR 31.14 request, as it relates specifically to the one most important document in this case, and they will have to supply the document or blatantly ignore the request.

I also require a statement of account as laid out also within Section 78(1).if there weren’t any terms and conditions then please confirm this in your response

 

I am entitled to receive the information on request. I enclose a payment of £1.00, which represents the fee payable under the Consumer Credit Act 1974. Please note that these funds are not to be used for any other purpose.

 

I note that section 172 outlines that statements by creditors are binding where made under inter alia section 78(1) and I take this to be that any reply made in response to this request is binding upon you. Therefore you should ensure that all documents requested are supplied. Any missing documents will be considered not part of the agreement and could therefore affect the enforceability of anything you send.

 

I understand that Consumer Credit (Prescribed Periods for Giving Information) Regulations 1983 (SI 1983/1569) at regulation 2 sets out the required time frame for compliance with this request as being 12 working days from receipt.

 

Should you fail to comply with my request as outlined above, I shall consider the account in dispute. I am aware that where a creditor fails to supply the requested information the creditors rights to enforcement are restricted until such time as they comply. I am also aware that there are certain terms that are required to be within the “Agreement” and should these terms be mis-stated or not present the agreement can be rendered unenforceable in law.

 

Notwithstanding the above, I note that the Consumer Credit (Cancellation Notices and Copies of Documents) Regulations 1983 (SI 1983/1557) at Regulation 3 allows the Signature box and signature to be omitted in a copy document but the copy document must contain all the terms off the agreement contained within the signed executed original document.

 

I respectfully request that you provide a copy of the original agreement signed by myself that you hold on file and while I accept that you can omit the signature box for the purposes of compliance with my request, you will be aware that any challenge to the agreement in court would require the signed copy of the original agreement. If you still reject this, please provide clarification on the status of the Original Credit Agreement and confirm either that you hold the original signed agreement on file or a copy of it on microfiche or that you no longer hold the file.

 

Also please provide details of who I may address a subject access request to under the Data Protection Act 1998 section 7 so that I may obtain a copy of the original agreement should you fail to forward a copy in respect of this request.

 

Therefore I look forward to receiving this information within the time frames as indicated above.

This is the CPR 31.14 letter, adjusted to your circumstances. This needs to go to Carter as that is the address given for all letters to be sent to which relate to this case. Send Special Delivery and do not sign -

CPR 18 Letter. This one demands far more information, but is rarely complied with. If it isn't complied with, there are ways to chase it later.

I have received a recent court claim from your organisation. In order to file a defence and counter claim I require some information. Given that this matter is now the subject of legal proceedings, you are obliged to disclose under the Civil Procedure Rules, the information and documents detailed below.

 

The information must be furnished within fourteen days of the receipt of this letter. If you fail to comply, this will be reported to the Court, a copy of this letter will be provided as evidence to the same and an Order enforcing your compliance will be sought.

 

1. A true copy of the executed credit agreement and any terms and conditions that applied to the account at the time of default and at the time the account was opened. True copies of any notice of assignment and/or default notice or enforcement notice that you or the original creditor sent me, with a copy of any proof of postage that you hold.

e. Specific details of the fees/charges levied by any other agency in respect of this account and a detailed breakdown of said fees/charges and what each charge relates to and on what date said fees/charges were levied.

f. A genuine copy of any notice of fair use of my data as required by the Data Protection Act 1998

g. A list of third party agencies to whom you have disclosed my personal data and a summary of the nature of the information you have disclosed.

h. Copies of statements for the entire duration of the credit agreement.

 

 

3. Any other documents you seek to rely on in court.

 

 

I will require this information within the next fourteen days. I must advise you that if the information is not forthcoming, it will be reported to the Court that you are trying to frustrate proceedings and denying me the opportunity to file a defence and counter claim.

So I will get these letters sent off. I take it if they fail to provide what I ask for they have no case to claim is that the principle. SOrry for sounding a little bit dumb but what am I trying to prove here?

I have acknowledged service and defended the whole claim. Letters will be sent off at lunch time. Watch this space and I will post what replies I get from Mr Carter.

 

ScabHunter - many thanks for all your help to get me this far! Without your guidance I would probably just have ignored it.

 

I hope I get a good outcome! Looks like many people have had some success against him! I am praying his luck hasnt changed!

 

Xmas eve is the last day for me to file a defence, see if he gets back to me in time!

I wouldn't hold your breath while waiting for Mr Carter to send you information, he started a case against me in Sept...

 

because I had no knowledge of what alleged debt he was refering to I sent a CPR part 18 request which he has so far ignored and we are now at the AQ stage

 

they had to be in 14 days ago mine was in on time, but Mr Carter has so far not sent his in.

 

He seems to run a mile when cases are defended or when requests are made for further information.

Mr Carter has recieved mr CPR31.14 and CPR18 letters. I wonder what I will get back from him. In one way i'm kind of excited but in another i'm very nervous. Just praying his paperwork isnt up to date otherwise I may not have a leg to stand on :(

Sorry what is a POC?

 

And yes i'm contesting the whole claim. I just hope he bottles out on my case too! I dont usually have that sort of luck though!!
