    • hi all. bit of advice please. I had a Three contract up until November last year. At £11pcm for 24mths. Paid every month on time via their online portal. When I ported over, I received a letter from Three thanking me for being a customer blah blah blah.. It also said IF I owed anything a final bill will be sent. No final bill ever received - I get a phone call around the first week in December form an Indian sounding man who was extremly difficult to understand. Said he was calling from Three, and wanted me to confirm my details - something of which I didnt as something didnt sit right. He said I could log into my account and review my bill as I owed money and then hung up. After the call I thought I'd best log into my account just in case.  Couldnt log in. Account access denied. Logged on to chat - they said as I ported over and I was no longer a customer my access was suspended. Couple of weeks later I had another call from a local area number and answered again it was some Indian guy telling me I owed money, wanting me to confirm details. I refused and he said details will be sent out to me to my email on account and my home address as it was important. Once again nothing.. 15th Dec I received an email from PastDue in my name RE Three. Email stated they were contacting me about Three an I should receive a letter soon regards to this matter. Says about visiting their website.  22nd Jan another email form Pastdue. Stating they have yet to receive a response to the letter, and they had already sent me an email about this. We will continue to contact you until this matter is resolved. Again asks me to login. 23rd Jan letter received dated 13th Jan. Titled "We are here to help keep your Three Services"  Claiming I owed "Airetime Balance £201.43" and contract period was 26/11/2019 to 25/11/2020 States "We have been appointed by Three to recover the amount of £201.43. If you pay this amount in full Three may be able to waive the cancellation fee and reconnect their service for you" - what cancellation fee / re connection??? I ended the contract giving the 30days notice and paying the last bill.. Then the normal crap about its important to pay. If I'm experiencing difficulties etc. Now both December and  January Credit reports from ClearScore, Credit Karma, Credit Expert, Totally Money and Equifax all show Three as Closed and balance as Zero. (Date Satisfied /closed 17th Nov, bal 0, last updated 30th Nov) I've had nothing from Three. As far as I'm concerned I owe nothing as no final bill and no access to the portal. Should I email PastDue and do a prove it & attach proof of Credit Reports being £0 or do I do something else?  
    • Hi she did say she was cancelling and returned the equipment. It looks like they put her on a rolling contract for 24 months when she phoned before trying to reduce her payments as they kept going up. I know Sky haven't done that to me. She didn't see that email as she's had lots of stressful situations. No.letter in post or when she originally phoned about reducing her bill well over £100 they didn't tell her about this contract. Like you say there should be recordings. BT mobile contract is separate to broadband and the cancellation fee is for the broadband. They have blocked her mobile so she can't use it and that is a contract. She is phoning CAB in the morning and checking through her paperwork. I'm quite happy with Sky as they tell you upfront what is happening and have never rolled over my contract. Thanks for taking time to reply it is much appreciated.

      Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
      So I issued the claim on day 15 and they requested more time to respond.
      They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
       
      I opted for mediation, and it played out very similarly to other people's experiences.
       
      In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them. 
       
      In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
       
      In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
       
      To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
       
      So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

Hi i have used this site on a few occasions and would appreciate any advice on the following mess.

At present I am on holiday and had a cash shortfall (as always) so I typed in payday loans and proceeded to fill in the required areas only to find I was passed from one company to another all with promise of immediate payment, to cut a long story short as of 27/8/13 I have been charged varying amounts from the following companies

Money warehouse

Smile

Merry wood loans and a couple more ranging from £27 to £69.99.

 

Having looked into this I realise these companies were brokers and these are membership fees, the original amount I needed was £300 well the amount taken out of my account this week has surpassed the £300, I have been reading on here re this so have done the following rang the bank, to no avail as they are saying its my own fault and I willingly gave my details, contacted each company requesting a refund on there Cancel policy although I feel things went to smoothly, I am being bombarded with up to 80 emails a day and 30 phone calls a day. So I have taken advice from here and transferred my remaining money into another account, which is to pay direct debits, yesterday I transferred £30 for a D/D only for Smile to take £28 of it , I have had to cancel a lot of the d/d as I wont have the money to pay them until I get the refunds that I am due, following the horrendous year I have had, this holiday payed for by my parents has turned into a living night mare, any advice would be greatly accepted and appreciated and I apologise sincerly for my total act of stupidity.

Hi tricia44,

 

The broker companies have to refund you the broker fee minus 5 GBP which they can keep. Most of the companies you listed will do this if you request it in writing (e.g. email), although they have up to 30 days to do so (which I guess leaves you short of money for this month if you were looking for a payday loan in the first place).

So make sure to send each of these companies a request for refund.

 

I would also report them to the OFT as it seems they have passed you around which should not happen (they should only pass you to actual payday lenders, not other brokers). The OFT will then investigate, but they will not get involved in your case directly.

 

As a word of warning: Do not take out a payday loan. Never. Ever. There must be another way. Ask your local credit union. If you are starving, go to a food bank. If your car is not working, hitchhike to work. Ask friends or family for help. Anything really, but not a PDL. Even in your current situation please do not take out a payday loan. There is such a high risk that it will spiral out of control very quickly. You might start borrowing 300 GBP to get you over this month, but where do you take the 390 GBP next month to pay the PDL back? I started only with a 100 GBP PDL loan a few years ago and ended up in the tenth of thousands of debt, paying over 1000 GBP in interest alone month after month.

Who did you speak to at the bank regarding charge back.

Did you ask for charge back

If your card provider rejects your chargeback claim, you can take your case to the Financial Ombudsman Service within six months of your final correspondence.

 

I see the payments came out on 27/8/2013-so you should get all money back.Or most of.

If you sent instructions to cancel within the cancel policy period

If you do not get your money back,well,let battle commence.

The passing round problem needs looking into perhaps.

I hope this is reasonable advice.

Hi and thank you for your reply's and encouragement.I am going to update my situation and ask for info regarding yet ANOTHER costly incident. Firstly as things stand:

27/8 Loans Direct took £69.75

27/8 My loan took £1.00

28/8 My loan added £1.00

29/8 Merrywood added £1.00

29/8 Go Cheap took £64.99

29/8 Money-warehouse took £27.31

29/8 Merrywood took £1.00

29/8 My loan took £69.99

30/8 Merrywood took £69.95

2/9 Smile finance took £26.34

4/9 Money warehouse added £27.31

4/9 Smile finance added £26.34

5/9 Loans Direct added £69.95

9/9 go cheap loans added £64.99

10/9 I rang the bank today to be told that another company has taken £64.99, this hasn't shown up on my statement as yet, but has definitely gone from my account. I will update further when I no who this is.

 

Well I don't no where to start, following advice from here the 4 company's that have refunded me, have been very good I told them of this stupid situation I have got myself into and that my D/D had gone unpaid including my mortgage, gas and electricity and they more or less gave me immediate refunds, I am still waiting on My loans and Merrywood.

 

My loans have said I should have the refund by Friday, but Merry wood are a different ball game, I have rang several times, I think its the same girl that answers and gives different names, she is so rude.although she is saying I am in a queue for a refund, she will not give me confirmation via email or any other method, that I am actually getting one, today she told me not to ring again and has said that she has emailed me with confirmation ( she hasn't) anyway to cut a long story short I don't think I am going to get my refund, I am so angry and feel so stupid.

 

 

Whilst on this terrible journey, something else has come to light a company called Shoppers Discount and Rewards have been taking £10 pm from me, I had no idea this was happening, when I rang they told me whilst paying my Freemans Catalogue a popup appeared offering me £10 discount to which I clicked on, as of then I was a paying member,because I have never used this service they told me I could get 3 months money back £30 but when they told me I had been paying this from October 2010, I kicked up a terrible fuss and they have sent me a form to fill in to get the total amount £360 back, my question is has anybody had any dealings with them and is it likely that I will be refunded ?

Never feel like that.

You have been targeted by predators with slick advertising methods,that is all.

How long they plan these,or who helps them set these things up i do not know.

I will look deeper into Merrywood ,see what i can come up with.

I will be back.Just up to a few things at the moment.

Also,will take a look at the problem with Shoppers Discount and rewards.

And remember it is only people like you who tell us,and others about these kind of problems

that we can try to get to grips with things.

 

Just think where this money,your money has perhaps been invested in.

MMM,to many just thinks.Have to come up with something else.

 

Say 10000 people had 50 pound taken for 6 months.500,000 pound.

 

Just imagine if they invested your money that you did not get your loan with anyway.

In say,the new investment vehicle for paydayloans coming soon.

Promising 40% net. For 6 months

A really rough est here but £105,000 profit to them for doing nothing.

Using other peoples money.Wow, can you see,grrrr

Just letting you know,i am going on a mission now.

To find out about Merrywood

Will not yet bother with My Loans as they have promised you a refund by Friday

But if not will do more research and ideas of how to tackle them.

Say 2000 applications a day 7 days a week@ 69.95

979,300 pounds- just saying.

Does not mean anything yet.And hopefully my maths are correct.

And that is just one company

Holding your money for different times,say a week, a month,six months.

Doing what with. Interesting.

Perhaps some do not get back,do you have to apply or is it automatic payback.

Complaint 1--There are many.

 

i have not money in my accouny all gone. i need claim they money me back refund. i am very upset its very expentive not cheap make me despressed and worry about my council rent every weekly 71.49. please they money me back post cheque not my visa debit.

.I was looking for a short term loan and when this company tried to take the payment the first time it was declined due to lack of funds. I thought that this was the end of it and certainly didn't expect the payment to be taken almost a week later. I can't find anywhere that it says that the transaction will be attempted again if it failed the first time. I am in receipt of E S A and I can't afford this loss. The whole reason that I was looking for a short term loan was because I needed money not because I wanted to spend it needlessly. I really need to get this money back but I don't know how to go about it. Merrywood Loans seem to have an answer for everything.

I do not mind having a good chinwag with these kind of firms.If possible.

Maybe it would be a good idea to send a registered letter to his address.Maybe i will.Just time gets in the way of many things.

Methinks another potential article for next months CagMag

 

Although your first post (to me anyway) wasn't that clear, are you saying that you went to ONE website, filled in the details and then they passed you on to another and the second passed you on to another etc. As far as I know that is the only way they could fleece you continuously.

 

This is the boring bit. Before ticking that box, check the terms and conditions first. If they don't have a link for the terms and conditions before you apply-bargepole comes to mind.

Also, do your research too. You may think you are working with different companies but in reality, you could be dealing with one company with mutiple trading names.

If you are asked to deal with any matter via private message, PLEASE report it.

Hi and thank you so much for the responses, the amount taken today was from Loan plus more, I have contacted them and have to put it in writing for a refund, a few of these companys have free post for these letters , I chose recorded delivery just to help matters, the refunds have been in full, they havent even taken the £5 suprisingly, I have rung Merrywood 3 times today and there not answering there phone and none of them found me a loan as I didnt proceed any further with the hundreds of leads that began hassling

me, I have also spoken to the bank ( Nat West) again today who are saying they cant help as I gave my details, ggggrrrrr I am so angry. I Live in Manchester but am currently considering a one way ticket to Timbucktoo :0)

seeing you lay things out like that Tawnyowl has made me realise how terrible theses companies are, I feel like I am coping quite well, due to the help and advice on here, but I feel desperation and sadness for others that arent so lucky to be getting support and help

WHy put it in writing, get to your bank and start chargeback proceedings. And get those companies blocked. Dont listen to the phone monkeys who will tell you that you cant stop payments. You can stop them anytime you like and the bank MUST comply.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Hi just to clear things up, I applied to the first company thinking instant cash and when the reply came back it was saying they would contact in 24/48 hours as this was no help I went to the next one and got the same response, I made a further 2 applications still blind to the fact theses companies were Brokers, within an hour I was bombarded with 100's of calls and text and at least 40 emails per day, the following day the money started coming out, at this point the penny finally dropped, what a total fool I had been

No ramble to me,once again you have told us of your experience with them.That may help others caught this way.

I have only just started looking at them,i will spend a little more time on them.

Suppose you have now filled your form in,sent off,and now awaiting reimbursement of £360.00.

Have they said you will definitely get this amount.

At the moment for a while i will leave them be.

Maybe give them a phone to see if your payment has been sent.

Hi there, I have also stupidly fallen into this trap. I usually avoid payday companies but I had a problem and didnt want to rely on my dad to sort it as I normally do. When I saw the companies I honestly thought that they were proper payday companies, however I then got to the next page on them and saw the charges so I came of the page as soon as I noticed them buy by the time I realised I had already given my card details which I assumed was for security checks. I should have taken more time but was in a rush trying to sort finances so I could solve the issue I had on my own that I stupidly overlooked the small print.

 

With the 2 companies that got me was myloans. co.uk and merrywood I contacted my bank as soon as I noticed the money I contacted my bank (ban of scotland) as I wasnt expecting such large transactions from my account. I said that I never authorised the payment as I thought I cancelled it before completion to which I was told that I authorised it as soon as I gave my card details and that there was nothing the bank could do. However they advised me to contact both companies and request a refund, this was when I looked through their terms and conditions and saw the right to cancel, the bank also gave me information for the comapny so they could reverse the charge immediately.

 

First one was merrywoods on 11/9/2013 - I phoned them at 9:15 am and explained the situation she said that they could cancel my account and give a refund which would take about a week. I asked if I could get an email confirming this and she agreed and sent one straight away the email gave me a link to go to a system message mail] which says that its been passed to the cancelations team and that they would refund the money to my account and that it noramlly takes 3-5 wiorking days for the refunds to clear.

I will give them til the 18/9 before contacting them again.

I also got a woman however she was friendly and nice to me at least, if that helps.

 

The other was myloans.co.uk in 12/9/2013 - I phoned them and also explained the situation to them and they said that they could issue a refund, however I would need to fill out a cancellation form that they could sent me via post or email, so I chose email hoping this would be the quicker option. I received the email about 2 hours later and it contained a word document which I filled out and sent back to them asking them to reply confirming receipt of the email containing the cancellation form. About an hour after I sent it I received an email thanking me for returning the cancellation form and confirming that my application will be cancelled and that I'd be refunded within 30 days.

 

I feel that the repsonses so far are positive however I did some looking around which is how I found this thread and I'v noticed all complaints but only one saying they got a refund which was a cheque from myloans.co.uk. This has left me worried that there could be a strong chance of this money being gone. My hop is that since I have emails from both companies stating the refund, if they fail to issue the refund, mt hope is that I could get my banks help although from their initial response I find this unlikely but worth a shot.

 

Sorry for the long rant but I saw this and though that if I posted here I could get some feedback and also update this to hopefully help tricia44 issue. Id also like to thank you for this thread as it has giving me a lot more information and relieved some of the stress so thank you all in this thread.

Update for myloans.co.uk - 16/9 - phoned to try to get a date regarding the refund. Was told that the refund is put down for 10th October and that it would be paid into the bank account via BACS, which normally takes 2-3 working days. They also said that the refund was for the full ammount. So I shall leave it till the 15th October and see if I get the refund.

Youre being too soft with them. They should be refunding you immediately and not in a month's time

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Go to the bank,ask for Chargeback.I do not trust these companies.

Why should you wait.Tell the bank you want Chargeback.

 

Chargeback troubleshooting

 

If you have any trouble when putting in a claim to your credit or debit card provider, ask to speak to a supervisor.

Chargeback is not very well known about and some bank staff may not be aware of this rule.

If your card provider rejects your chargeback claim, you can take your case to the Financial Ombudsman Service within six months of your final correspondence.

Thanks for the advise , ye I'm 20 so this is all new to me so I appreciate all the advice that you have to offer.

 

Update: I phoned the bank for a chargeback as suggested, they passed me over to the disputes team who told me they cannot dispute those transactions and advised me to contact the companies, after I explained I already had again, the guy told me that they still could not dispute the transactions and do a charge back for this and advised me to contact trade and standards regarding the companies to seek legal advise. Is there anything else I can do?

Tricia44 is waiting for refunds---and Shoppers direct.refund which could be a record breaker.

Let us perhaps wait a while longer before we pursue things further.

And i would like to know,how do they refund you if you do not ask after 6 months and you do not get a loan.Is it automatic payback.

Trying to say what if you forget to ask for a refund.Does the payment you sent after getting no loan 6 months later-just returned to you-or forgotten about.Does this happen.Surely not.

Sometimes perhaps i go to deep,think the worst.

Because if it did,my feathers would fall out.And my quill would be sharpened,at the ready.
